About approval of the List and Rules of use of technical means of customs control

1. Approve:

1) the List of technical means of customs control according to appendix 1 to this order;

2) Rules of use of technical means of customs control according to appendix 2 to this order.

2. Declare invalid the order of the Minister of Finance of the Republic of Kazakhstan of May 29, 2015 No. 334 "About approval of the List of technical means of customs control and Rules of use of technical means of customs control" (No. registered in the Register of state registration of regulatory legal acts 11532, published on August 17, 2015 in information system of law of Ad_let).

3. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the established legislation procedure to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. This order becomes effective after ten calendar days after day of its first official publication.

List of technical means of customs control

Technical means of customs control are subdivided into the following types:

1) the automated system of accounting of vehicles;

2) technical means of control of carriers of audio and video information (wearable video recorders, video cameras, cameras, tape recorders, videorecorders, players of all systems and formats, telemonitors, TVs, special computer control systems, photo, film, slaydproyektor, devices for viewing by the microfiche, devices for deleting audio-, video information);

5) technical means of visual observation (optical devices of observation, field-glasses, monocular and stereopipes, devices of night vision, and also the local (closed) systems of survey television - network of TV cameras, uncontrollable or remotely-controlled from the single control panel, and control monitors);

6) the automated system of determination of weight and dimensional parameters of vehicles and video surveillances;

7) technical means of radiation control (dosimeters, radiometers, portable and stationary spectrometers, stationary systems of detection of the sharing and radioactive materials);

8) the customs intraskopichesky equipment including equipped with image processing and analysis systems (stationary, figurative and mobile systems of not intrusive examination);

9) technical means of search (metaldetectors, mirrors customs, probes customs, endoscopes, customs lamps and lamps, devices for determination of change of density, thermal imagers).

Rules of use of technical means of customs control

Chapter 1. General provisions

1. These rules of use of technical means of customs control determine procedure for use of technical means of customs control.

2. Technical means of customs control - complex of the special technical means used by bodies of state revenues in the course of customs control of the physical persons, goods and vehicles moved through customs border of the Eurasian Economic Union, and also the physical persons crossing customs border of the Eurasian Economic Union for the purpose of reducing time of carrying out customs control and identification of the facts of offenses in the field of customs affairs.

Chapter 2. Procedure for use of technical means of customs control

3. The official of body of state revenues exercising customs control depending on forms of customs control and specifics of movement of physical persons, goods and vehicles determines need of use of these or those technical means of customs control.

4. In case of customs observation the following technical means of customs control are used:

1) the automated systems of accounting of vehicles applied for visual and the automated control over the vehicles which are driving/leaving on customs area of the Eurasian Economic Union by automation of their registration on the state registration registration plates.
