About approval of the Concept and Action plan for 2018-2020 o of communitarian police activities

For the purpose of accomplishment of the functions of police provided in article 23 of the Law No. 320 of December 27, 2013 on activities of police and the status of the police officer (The official monitor of the Republic of Moldova, 2013, Art. No. 42-47, 145), with subsequent changes and amendments, DECIDES: the Government

1. Approve:

1) the Concept about communitarian police activities, according to appendix No. 1;

2) the Action plan for 2018-2020 about communitarian police activities, according to appendix No. 2.

2. Implementation of the Action plan will be performed at the expense of the means approved in the law on the government budget for the corresponding year and also from other sources which are not prohibited by the law. Estimated cost of actions will be adjusted during implementation of the Plan, taking into account amounts of the means which are available in the government budget.

3. Recommend to bodies of local public authority to assist in limits of the powers assigned by the law, to accomplishment of the above-stated Plan and also to sign agreements on cooperation with local divisions of police for the purpose of accomplishment of tasks on creation of climate of safety for inhabitants of the corresponding administrative and territorial units.

4. To impose control of execution of this resolution on the Ministry of Internal Affairs.

Concept of communitarian police activities

I. Introduction

In recent years the law-enforcement system of the Republic of Moldova was exposed to important reforms, at the same time special attention was paid to segment of ensuring public order and safety, fight against corruption and reforming of justice which actually are the main components of rule of law.

In the course of reforms the constituting structures of the Ministry of Internal Affairs (further - the Ministry) made significant progress, for example, creation in 2013 of the General inspectorate of police as the separate organization whose important role consists in implementation of policy in the field of public order and safety, protection of the rights and freedoms of citizens, the state-owned and private property.

The functional analysis of the Ministry which is carried out in 2015 by group of the international experts was performed taking into account experience and proper European the practician in general and, in particular, practicians of countries of source of members of the international team. In particular, it is noted that the Ministry already successfully accepted number of the European front lines the practician in the field of management of borders, management of migration and shelter, fight against organized and cross-border crime, evolutions which led to liberalization of visa regime. At the same time, also number of gaps according to the procedure of the organization and functioning of the organizations subordinated to the Ministry which affected trust of citizens to these organizations is revealed, and number of recommendations about implementation of modern concepts, especially concerning work of police is offered.

In view of the fact that fundamentals of philosophy which recover the European police systems is orientation to society by means of the high-quality public service ensuring safety of members of society one of recommendations of the Report it is directed to implementation of the concept of Community Policing (communitarian police activities) and in work of police of the Republic of Moldova.

Models of communitarian police activities were tested and implemented both in the European space, and on both American continents, certainly, with the conceptual distinctions determined generally by specifics of communities in which they function. The ideas and the practicians connected with new model of communitarian police activities can bring considerable benefits to the countries of Central and Eastern Europe in strengthening feeling of safety and trust in communities and increase in efficiency of police.

II. Regulatory framework

The legislation of communitarian police activities consists of the national legal system, international treaties and conventions which party the Republic of Moldova is.

Determination and implementation of this Concept will be regulated by the following regulations:

European convention on human rights protection and fundamental freedoms;

European code of police ethics;

The constitution of the Republic of Moldova of July 29, 1994;

The law No. 436-XVI of December 28, 2006 on local public authority;

The law No. 98 of May 4, 2012 on the central branch public management;
