About approval of the List of waste
This Order of the Government shifts the Decision of the Commission 2000/532/EC of May 3, 2000, the replacing Decision 94/3/EC establishing the list of waste according to part (a) of Article 1 of the Directive 75/442/EES of Council on waste and the Directive 94/904/EC of Council establishing the list of dangerous wastes according to part (4) article 1 of the Directive 91/689/EES of Council about dangerous wastes, with the last amendments made by the Decision of the Commission 2014/955/EU of December 18, 2014 about change of the Decision 2000/532/EU establishing the list of waste according to the Directive 2008/98/EC of the European Parliament and Council published in the Official magazine of the European Community L 226 of September 6, 2000.

1. This document is submitted by the qualifier of waste, including dangerous.
2. For the purpose of this List the following concepts mean:
dangerous substance - the substance classified as dangerous owing to compliance to the criteria of physical danger, health hazard or danger to the environment established by the national legal system on classification, marking and packaging of substances and mixes;
heavy metal - any compound of antimony, arsenic, cadmium, chrome (VI), copper, lead, mercury, nickel, selenium, tellurium, thallium and tin, and also the specified materials in metallic form as they are classified as dangerous substances;
the polychlorinated biphenyls and the polychlorinated terphenyls (PHB) - mix, according to the determination established in the subitem a) Item 3 of the Regulations on the polychlorinated biphenyls approved by the Resolution the Government No. 81 of February 2, 2009;
transitional metals - any of the following metals: any compound of scandium, vanadium, manganese, cobalt, copper, yttrium, niobium, hafnium, tungsten, titanium, chrome, iron, nickel, zinc, zirconium, molybdenum and tantalum, and also these metals in metallic form, in that measure in what they are classified as dangerous substances;
stabilization - processes which change degree of danger of mix of waste and transform dangerous wastes to harmless waste;
hardening - processes which change only physical condition of waste when using additives, without change of their chemical properties;
partially stabilized waste - the waste containing dangerous components which were not completely turned into harmless components after stabilization process and which can be released to the environment on short, average or long term.
3. In this List waste is classified in dangerous and harmless and forms basis for determination of dangerous properties of withdrawal.
3) the criteria determined in appendix 3 to the Law No. 209 of July 29, 2016 on waste, including those which reflect are applied to assessment of dangerous properties of waste:
a) availability of dangerous substances which lead to emergence of the withdrawal having one or several dangerous properties;
b) the extreme values relating to each substance. In case substance is present at waste in quantity below its extreme value, substance shall not join in calculation of threshold value;
c) concentration of substances in the corresponding withdrawal and other criteria;
5) if dangerous property of separate withdrawal was estimated on the basis of the test performed using methods of the testing held with use of the applied test methods and by use of concentration of dangerous substances as directed of appendix 3 to the Law No. 209 of July 29, 2016 on waste, results of testing shall have priority value.
5. In case of determination of dangerous waste it is necessary to take into account that:
2) the concentration limits determined in appendix 3 to the Law No. 209 of July 29, 2016 on waste are not applied to alloys of net metals in their massive form (uncontaminated by dangerous substances);
6. The types of waste classified in this List are determined individually by means of the complete code consisting of six figures.
7. Twenty categories of waste depending on source of their origin which are determined by means of the code created from the first two figures of the complete code specified in Item 6 of this List are established.

8. The main categories of waste established in Item 7, are subdivided into subcategories of waste which are determined by the code consisting of four figures.
9. For identification of withdrawal it is necessary to pass the following stages in the List of waste provided in the table 2,:
1) the source of formation of withdrawal in categories with codes 01-12 or in categories with codes 17-20 is identified and identification of the corresponding six-digit code is performed (except for codes of the waste which is coming to an end on 99). In the course of identification of withdrawal it is necessary to take into account that specific withdrawal can be classified by several categories of waste;
2) in case any of codes of the corresponding waste cannot be found in the categories specified in the subitem 1) of this Item it is checked if one of categories of waste with codes 13, 14 or 15 is suitable for this withdrawal;
3) in case any of codes of the waste specified in the subitem 2) is not applied, identification of withdrawal shall be carried out to categories with code 16;
4) in case the corresponding withdrawal is not included in category with code 16, it is classified in type of waste which code comes to an end on 99 (waste which are not included in one other category) in category of the List which corresponds to the activities determined at the first stage.
