1. Approve enclosed:

1) Rules of confirmation of placement of goods in places of temporary storage according to appendix 1 to this order;

2) Rules of making by bodies of state revenues of the customs transactions connected with document registration, provided for goods placement on temporary storage and issue of confirmation about their registration, according to appendix 2 to this order.

2. Declare invalid the order of the Minister of Finance of the Republic of Kazakhstan of March 31, 2015 No. 249 "About some questions of customs transit and temporary storage of goods and vehicles" (it is registered in the Register of state registration of regulatory legal acts at No. 10884, it is published on July 28, 2015 in information system of law of Ad_let).

3. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of confirmation of placement of goods in places of temporary storage

Chapter 1. General provisions

1. These rules of confirmation of placement of goods in places of temporary storage (further - Rules) are developed according to Item 6 of article 165 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan" (further - the Code) and determine procedure for confirmation of placement of goods in places of temporary storage.

2. The concepts used in these rules are applied according to the Code.

Chapter 2. Procedure for confirmation of placement of goods in places of temporary storage

3. Before submission of documents, the goods confirming placement in places of temporary storage, the carrier, other persons having powers concerning goods or their representatives, place goods and (or) vehicles in places of temporary storage.

4. For placement of goods on temporary storage the carrier, other persons having powers concerning goods or their representatives, represent to body of state revenues the transport (transportation), business and (or) customs papers containing data on goods, the sender and the receiver of goods, the country of their departure and appointment.

Such documents are submitted to body of state revenues in electronic form or on paper in the cases provided by the customs legislation of the Eurasian Economic Union and (or) the Republic of Kazakhstan.

5. The body of state revenues located at the check point accepts two copies of verified copies of transport (transportation) and business documents, and the body of state revenues of appointment adopts the transit declaration.

In case of arrival of goods by rail, the body of state revenues located at the check point accepts the rail waybill of single sample, and also two copies of verified copies of the rail waybill and business documents, and the body of state revenues of appointment adopts the transit declaration.

In case of arrival of express loads air transport, the express carrier represents to the body of state revenues located at the check point, three copies of the Register of accounting of express loads in form according to appendix 2 to these rules in which information on all express loads which arrived according to one air waybill is specified.

6. The documents submitted to body of state revenues for confirmation of placement of goods on temporary storage contain:

marks about completion of customs procedure of customs transit;

name of the place of temporary storage and accounting number of the place of temporary storage.

Accounting article number, the temporary storage placed in the place, is created according to the following scheme:

where:

11 and 22 - respectively a day and month of registration;

33 - two last figures of the current year;

444444 - sequence number according to the book of accounting of the goods placed in the place of temporary storage.

7. In cases of temporary storage of goods in places according to article 165 of the Code, on the submitted documents the address of the storage location and date of placement are specified temporary storage.

In case of placement of goods and vehicles in places of temporary storage according to article 170 of the Code are in addition represented:

the written application of person in any form having powers concerning goods;

the document confirming ensuring payment of customs duties, taxes;

in case of placement of goods and vehicles in places of temporary storage, provided by the subitem 2) of Item 1 of article 170 of the Code, the copy of the document, confirmatory that the territory in which there is other place of temporary storage, belongs to the receiver on the property right or is used by it on the lease right;
