1. Approve enclosed:

Rules of implementation of monitoring and control of implementation of the self-sustaining infrastructure projects provided by Items 1, of the 2 and 11 list of the self-sustaining infrastructure projects realized by legal entities in whose financial assets resources of the national welfare fund and (or) the pension accruals which are in trust management of the state-owned managing company on returnable basis, the Government of the Russian Federation approved by the order of November 5, 2013 No. 2044-r are placed;

changes which are made to acts of the Government of the Russian Federation.

2. To the Ministry of Finance of the Russian Federation in 2-month time from the date of entry into force of this resolution to approve form of the agreement on submission of reports and other additional information of implementation of the self-sustaining infrastructure projects provided by Items 1, of the 2 and 11 list of the self-sustaining infrastructure projects realized by legal entities in whose financial assets resources of the national welfare fund and (or) the pension accruals which are in trust management of the state-owned managing company on returnable basis, the Government of the Russian Federation approved by the order of November 5, 2013 No. 2044-r, procedure for bank maintenance and use of resources of the national welfare fund for their financing concluded between the legal entity specified in the subitem "b" of Item 3 of the Rules approved by this resolution, and body are placed the authorized Government of the Russian Federation on implementation of monitoring and control of implementation of the specified projects.

I. General provisions

1. These rules establish procedure of monitoring and control of implementation of the self-sustaining infrastructure projects provided by Items 1, of the 2 and 11 list of the self-sustaining infrastructure projects realized by legal entities in whose financial assets resources of the national welfare fund and (or) the pension accruals which are in trust management of the state-owned managing company on returnable basis, the Government of the Russian Federation approved by the order of November 5, 2013 No. 2044-r, and control of target use of resources of the national welfare fund for financing of projects are placed (further respectively - monitoring, control, projects, the list).

2. Monitoring and control are performed from the date of entry into force of the order of the Government of the Russian Federation of March 5, 2018 No. 224 "About procedure of monitoring and control of implementation of the self-sustaining infrastructure projects provided by Items 1, of the 2 and 11 list of the self-sustaining infrastructure projects realized by legal entities in whose financial assets resources of the national welfare fund and (or) the pension accruals which are in trust management of the state-owned managing company, on returnable basis" and about day of return of the projects raised for financing of resources of the national welfare fund or exception of the project from the list are placed.

3. Participants of monitoring and control are:

a) the federal executive body or State Atomic Energy Corporation "Rosatom" authorized by the Government of the Russian Federation on implementation of monitoring and control (further - authorized body);

b) the legal entities specified in Items 1, of the 2 and 11 list as initiators of projects (further - initiators of projects);

c) the credit institutions conforming to the following requirements:

availability at credit institution of the general or universal license of the Central bank of the Russian Federation;

availability at credit institution of own means (capital) in the amount of at least 25 billion rubles;

finding of credit institution under direct or indirect control of the Central bank of the Russian Federation or the Russian Federation.

II. Procedure for representation and consideration of documents within monitoring and control

4. The initiator of the project for the purpose of monitoring and control:

a) conducts separate financial accounting of resources of the national welfare fund for the purpose of ensuring control of target use of resources of the national welfare fund for what opens the separate bank account with restrictions (the special mode) of carrying out account transactions in the credit institution conforming to the requirements established by these rules (further - the special account);

b) enlists into the special account:

the resources of the national welfare fund raised for financing of the project by placement of securities;

the means charged earlier off special account and returned to the initiator of the project by partners under the unexecuted (not completely performed) agreements;

own and raised funds from other accounts in credit institutions for their further use for the purpose of financing of the project (if necessary);

c) transfers funds from the special account for payment of the goods, works and services (including advance payments) which are directly connected with project implementation.

Money transfer of National welfare fund, the attracted to financing of the project, stipulated in Item 2 lists, due to placement of the preferred shares which arrived into the special account, on other settlement accounts of the initiator of the project on account of expense recovery for the purposes provided by the passport of the project approved by the Government of the Russian Federation, earlier suffered by the initiator of the project at the expense of own or raised funds, in the amount of, not exceeding the size of own means of the initiator of the project which are earlier directed to them to the special account is allowed.

Money transfer on account of compensation earlier suffered by the initiator of the project, stipulated in Item 2 lists, expenses is performed by credit institution after submission of the project by the initiator as confirmation of the incurred expenses of the following documents:

payment orders on transfer of funds for the special account from other accounts of the initiator of the project;

payment orders on payment for work and the services which are directly connected with project implementation;

acts of the performed works and the rendered services directly connected with project implementation;

invoices (if necessary) for the performed works and the rendered services directly connected by project implementation;
