About protection of communication lines and radiofication in the Kyrgyz Republic

For the purpose of ensuring safety cable, radio relay and aerial communication lines and radiofication the Government of the Kyrgyz Republic decides:

1. Approve the enclosed Rules of protection of communication lines and radiofication.

2. To the ministries, administrative departments, business entities irrespective of patterns of ownership all works within conservation zones of message according to the Rules approved by this Resolution.

3. To impose control over the implementation of this Resolution on the Ministry of Transport and Communications of the Kyrgyz Republic.

Rules of protection of communication lines and radiofication

1. These rules are established for ensuring safety and possibility of elimination of damages cable, radio relay and aerial communication lines and lines of radiofication as damage of these lines breaks normal work of communication and causes damage to economy and defense of the country.

2. On cable routes, aerial communication lines and radiofication:

a) conservation zones are established:

for underground cable and aerial communication lines and radiofikatsiiv the land area type along these lines determined by the parallel straight lines remote from the route of underground cable or from extreme wires of aerial lines at distance of 2 m from each party;

for sea cable communication lines and for communication cables upon transitions through lakes, water storage basins and channels - in the form of section of the water space at all depth from surface of the water to the bottom concluded between the parallel planes remote from the route of sea cable at distance of 0,25 of mile and from the route of cable upon transitions through the rivers, lakes, water storage basins and channels at distance of 100 m from each party;

for land and underground unattended repeater stations on cable communication lines - in the form of the land area determined by the closed line remote from repeater points or from border of their diking at distance of 3 m.

On trasses of underground cable communication lines the zamerny columns which are reference points are out-of-town established. In the cities passing of underground cable communication lines is determined by technical documentation.

Borders of conservation zones on trasses of sea cables of communication and on trasses of cables of communication upon transitions through lakes, water storage basins and channels are noted in places of removal of cables on the coast by signal signs;

b) break-throughs in forests and green plantings for aerial communication lines and radiofication are created:

in the plantings which are not exceeding 4 m in height - at least a distance wide between extreme wires plus 4 m (on 2 m from each party from extreme wires to branches of trees);

in plantings more than 4 m high - at least a distance wide between extreme wires plus 6 m (on 3 m from each party from extreme wires to branches of trees).

In plantings where chances of frequent fall of trees, width of glades shall be equal to distance between extreme wires plus the average height of plantings from each party. At the same time the separate trees or groups of trees growing on the edge break-throughs shall be cut down if their height exceeds the average height of plantings.

In case of passing of communication lines and radiofication across parks, gardens and reserves the smaller width of glades is allowed according to the mutual arrangement with owners of rights to use by the parcels of land.

Break-throughs for the communication lines and radiofication passing across forests and green plantings shall contain by forces of owners of rights to use by sections under which authority communication lines and radiofications, under fireproof condition are.

In parks, gardens, reserves, the woods, green zones around the cities and settlements, field-protecting afforestations, protective forest bands along automobile and the railroads, forbidden forest bands along the rivers and canals, around lakes and other reservoirs, in valuable forests laying of glades shall be made so that the smallest damage was caused to condition of plantings and loss of protective properties by them was prevented. In particular, on break-throughs the bush and young growth shall not be cut down, to be rooted out stubs on friable soils, abrupt (over 15 degrees) slopes and in the places subject to washout;

c) minimum admissible distances (gaps) between constructions of communication lines and the radiofications and the next other constructions determined by rules of construction of the corresponding constructions are established.

3. On trasses of radio relay communication lines certain land areas on which construction of buildings and constructions, and also planting of trees for the purpose of warning of their shielding action is forbidden to distribution of radio waves are determined. The arrangement and borders of these sections are provided in projects on construction of radio relay lines.

4. Within conservation zones and glades without written consent of owners of rights to use sections under which authority communication lines and radiofications are forbid:

a) perform any construction, installation and explosive works, earthwork at depth of more 0,3 of m, and also the layout of soil by means of bulldozers and excavators;

b) make the geological film-making, search, geodetic and other prospecting works connected with the device of wells, holes and soil sampling;

c) make planting of trees, have field camps, contain the cattle, warehouse materials, forages, fertilizers, to burn down fires, to arrange shooting ranges;

d) arrange drives and parking of motor transport, tractors and mechanisms, to take off-gage loads under wires of aerial communication lines and radiofications;

e) arrange moorings for the parking of courts, barges and floating cranes, to perform handling, dredging and dredging works, to drop anchors, to pass with the given anchors, chains, lots, drag harrows and trawls, to select fishery sections, to make production of fish, and also other water animals and plants benthonic tools of fishing, to arrange watering places, to make splitting and procurement of ice.

Conservation zones of aerial communication lines and radiofication in band of branch automobile and the railroads can be used by road and railway authorities for their needs without approval of the companies (organizations) under which authority these lines, but with obligatory ensuring safety of communication lines and radiofications are.

Conditions of production of works within conservation zones and glades on trasses of communication lines and radiofication, necessary for ensuring safety of these lines, are established by the Ministry of Transport and Communications of the Kyrgyz Republic (regarding construction works - in coordination with the Ministry of Architecture of the Kyrgyz Republic, regarding allocation of land - in coordination with the State land management agency and land resources under the Government of the Kyrgyz Republic).
