1. Approve the enclosed Rules of forming, maintaining the database of dactyloscopic information of persons on which the decision on certification of the identity of the seaman of the Republic of Kazakhstan is made.

2. To provide to committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective since January 1, 2021 and is subject to official publication.

Chapter 1. General provisions

1. These rules of forming, maintaining the database of dactyloscopic information of persons on which the decision on certification of the identity of the seaman of the Republic of Kazakhstan is made (further - Rules) are developed according to the subitem 1) of article 34 of the Law of the Republic of Kazakhstan of December 30, 2016 "About dactyloscopic and genomic registration" and determine procedure for forming, maintaining the database of dactyloscopic information of persons on whom the decision on certification of the identity of the seaman of the Republic of Kazakhstan is made.

2. In these rules the following basic concepts are used:

1) authorized body (further - authorized body) - the central executive body performing management in the field of merchant shipping and also in limits, stipulated by the legislation the Republic of Kazakhstan, - cross-industry coordination;

2) the identity certificate of the seaman (further - ULM) - the identity document of the owner working at board of the ocean ship (except for the warship) as a part of its crew, and also the vessel of the swimming mixed (river sea) used for the purposes of the merchant shipping studying in educational institution and directed to vessels for practical training;

3) Item of production, issue and control ULM - the Item performing functions on reception of an application on issue of ULM, to removal of biometric data of the applicant, personalisation of ULM, check and issues of ULM, to accounting of the issued ULM and transfer of data in the database of dactyloscopic information, to accounting of the ULM forms;

4) the coordination center - the center performing processing of requests from immigration services or other competent authorities of foreign states concerning authenticity of ULM issued in the Republic of Kazakhstan;

5) the database of dactyloscopic information (further - the database) - base of biometric these persons on whom the decision on certification of the identity of the seaman of the Republic of Kazakhstan is made.

3. Information system ULM is intended for complex automation of processes of production, issue and control ULM in authorized body in the field of sea transport which provides information exchange between Item of production, issue and control ULM and the coordination center on the basis of single information and technological infrastructure.

4. Functioning of the database is performed within information system ULM.

Chapter 2. Procedure for forming and maintaining database

5. The database is created and kept by Sea port administration in Item of production, issue and control ULM.

6. Forming and maintaining the database include:

1) introduction of the biographical particulars specified in the questionnaire statement about issue of ULM according to appendix 1 to the Rules of registration, issue, replacement, delivery, withdrawal and destruction of the identity certificate of the seaman of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of August 27, 2013 No. 863, and biometric data of the applicant by scanning of fingerprints of hands;

2) updating of data in the database, in the course of replacement (issue of new) or delivery of ULM according to the legislation of the Republic of Kazakhstan;

3) storage of biometric data in barcode type on ULM.

7. The database is created and kept in electronic form. Maintaining the database is performed in the conditions providing prevention of unauthorized access to the database.

8. Unloading of biometric data from the database in external systems is not allowed.
