1. Approve:

1) Rules of purpose of customs examination for carrying out by other authorized expert organization (expert) according to appendix 1 to this order;

2) Rules of attraction for conducting customs examination of the expert (specialist) who is not the official of bodies of state revenues according to appendix 2 to this order.

2. Recognize to invalid:

1) the order of the Minister of Finance of the Republic of Kazakhstan of August 3, 2010 No. 391 "About approval of Rules of involvement of the expert (specialist) who is not the official of bodies of state revenues for conducting customs examination" (it is registered No. 235 is published in the Register of state registration of regulatory legal acts No. 6431, on September 8, 2010 (26296) in the Kazakhstanskaya Pravda newspaper);

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on the Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), and 3) of this Item.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of purpose of customs examination for carrying out by other authorized expert organization (expert)

Chapter 1. General provisions

1. These rules of purpose of customs examination (further – Rules) are developed for carrying out by other authorized expert organization (expert) according to Item 2 of article 466 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" (further – the Code) and determine procedure for purpose of customs examination for carrying out by other authorized expert organization (expert).

Chapter 2. Procedure for purpose of customs examination for carrying out by other authorized expert organization (expert)

2. Customs examination is appointed concerning goods, customs, transport (transportation), business and other documents, and also means of identification of such goods and documents.

3. Customs examination is appointed by body of state revenues.

The decision on purpose of customs examination is made by body of state revenues within 3 (three) working days from the moment of receipt of the notification from authorized customs authority on impossibility of involvement of other authorized expert organizations (experts).

4. The choice of other authorized expert organization (expert) for conducting customs examination is performed according to the Law of the Republic of Kazakhstan "About public procurements".

Rules of attraction for conducting customs examination of the expert (specialist) who is not the official of bodies of state revenues

Chapter 1. General provisions

1. These rules of attraction for conducting customs examination of the expert (specialist) who is not the official of bodies of state revenues (further – Rules), are developed according to Item 1 of article 467 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" (further – the Code) and determine procedure for involvement of the expert (specialist) who is not the official of bodies of state revenues (further – the expert (specialist)) for conducting customs examination.

2. The authorized body of state revenues involves the expert (specialist) to carrying out researches and (or) testing in case of impossibility of conducting such examination by customs experts.

Chapter 2. Procedure for attraction for conducting customs examination of the expert (specialist) who is not the official of bodies of state revenues

3. The authorized body of state revenues according to the Law of the Republic of Kazakhstan "About public procurements" carries out public procurements on provision by experts (specialists) of services in carrying out researches and (or) testing, with use of special and (or) scientific knowledge.
