About approval of form of the centralized register of receivers of compensation and rules of its representation

1. Approve:

1) form of the centralized register of receivers of compensation according to appendix 1 to this order;

2) rules of submission of the centralized register of receivers of compensation according to appendix 2 to this order.

2. To department of the budget legislation of the Ministry of Finance of the Republic of Kazakhstan (Ernazarova Z. A.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective since July 1, 2020 and is subject to official publication.

Rules of submission of the centralized register of receivers of compensation

Chapter 1. General provisions

1. These rules of submission of the centralized register of receivers of compensation (further - Rules) compensations by the victim are developed according to the subitem 1) of article 5 of the Law of the Republic of Kazakhstan of January 10, 2018 "About Fund" (further - the Law) and determine procedure for submission of the centralized register of receivers of compensation (further - the register).

Chapter 2. Procedure for submission of the centralized register

2. The register is kept by the state bodies performing functions of criminal prosecution in form, according to appendix 1 to this order, according to the decision on compensation payment.

3. The register contains the following data of receivers of compensation:

1) the Surname, name, middle name (in case of its availability);

2) individual identification number of the receiver;

3) bank details of the receiver (business and identification number, individual identification code, in the presence of the current/personal bank account of the receiver, specifying of account number);

4) compensation amount.

4. Receipts (further - Fund) are enlisted in Fund of compensation by the victim into the control account of cash opened in the central authorized body on budget implementation. Use of fund is performed only on the purposes provided by the Law.

5. The register is submitted the state bodies performing functions of criminal prosecution, in authorized body on budget implementation monthly to the fifteenth, following decision about purpose of compensation.

6. The authorized body on budget implementation based on the register creates the payment order.

Payments of compensation are performed from Fund on the bank account of receivers of compensation.
