About approval of "Procedure for accomplishment of the individual program of employment and form of the reporting"

For the purpose of ensuring execution of the second paragraph of subitem 1.1.4 of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic of June 30, 2017 "About unemployment insurance" of August 5, 2017 the No. 1569 Cabinet of Ministers of the Azerbaijan Republic decides No. 765-VQ:

1. Approve "Procedure for accomplishment of the individual program of employment and form of the reporting" it (is applied).

2. This resolution becomes effective since January 1, 2018.

Procedure for accomplishment of the individual program of employment and form of the reporting

1. General provisions

1.1. This Procedure and form of the reporting are developed based on article 17.8 of the Law of the Azerbaijan Republic "About unemployment insurance" and determine procedure for accomplishment of Public service of employment by local authorities under the Ministry of Labour and Social Protection of the population of the Azerbaijan Republic (further - Service) the individual program of employment for the unemployed, and also form of the reporting on execution of the individual program of employment.

1.2. The individual program of employment - the document developed for the purpose of assistance to employment and return of the unemployed to the labor market and determining specific amount, type and completion date of active measures of employment.

1.3. The performance report of the individual program of employment - the report establishing participation of the unemployed in the active measures of employment provided in the individual program of employment.

1.4. Other concepts are used in this Procedure in the values determined by the Law of the Azerbaijan Republic "About unemployment insurance".

2. Request for receipt of the individual program of employment

2.1. On person registered as the unemployed for the purpose of assistance to its return again to the labor market and to employment by Service the Individual program of employment is constituted.

2.2. Person registered as the unemployed within 5 (five) working days after registration receives the individual program of employment, having been in local authorities of Service at the place of residence (based on the identity document) or having undergone online consultation.

2.3. Consultation is conducted for determination for the purpose of development of the individual program of employment of opportunities of the unemployed in job search and job security.

2.4. During consultation the following is established:

2.4.1. requirements to suitable work in case of its possible offer;

2.4.2. obligation or non-obligation of the requirement of occupational work;

2.4.3. need of increase or enhancement of qualification;

2.4.4. term of working experience;

2.4.5. interests in the choice of sort of employment;

2.4.6. availability of the special circumstance required to place of employment in connection with health and marital status;

2.4.7. availability of the requirement for remoteness of place of employment from the residence;

2.4.8. requirement for the salary size;

2.4.9. availability of this or that requirement under the terms of work and to operating mode;

2.4.10. level of opportunities of independent job search;

2.4.11. possibilities of independent preparation of personal leaf of data;

2.4.12. possibilities of independent presentation of personal leaf of data on potential place of employment;

2.4.13. knowledge of interview stage on place of employment where the personal leaf of data will be shown.

2.5. Local authorities of Service, having entered "the Employment Subsystem" (further - PZ) "Centralized electronic Information System" (further - TsEIS) the Ministries of Labour and Social Protection of the population of the Azerbaijan Republic, make assessment taking into account required yielded and results of consultation, possibility of necessary active measures of employment for finding of work, and also current status of the labor market, and issue to person information on preparation of personal leaf of data, its presentation on the chosen place of employment, interview stage on place of employment, active measures of employment and, having constituted the individual program of employment, assure him the strengthened digital signature (Appendix No. 1).

2.6. The individual program of employment is displayed in private electronic office of the unemployed and certified by the unemployed the strengthened digital signature, and in case of absence at the unemployed of the digital signature the individual program of employment is printed out by local authorities of Service, signed by the unemployed, and the scanned copy is entered into system.

3. Procedure for accomplishment of the individual program of employment

3.1. After receipt of the individual program of employment in electronic procedure or on paper the unemployed starts together with local body of Service its accomplishment.

3.2. The active measures of employment established in the individual program of employment are performed by the unemployed in terms and the sequences, established by the program.

3.3. In case of identification in the first 5 (five) working days of execution of the individual program of employment of the circumstances able to become the reason for the termination of its execution or change of the program, the unemployed reports about it in PZ and discusses these circumstances in local body of Service, and in case of recognition of the reasons proved on it the new individual program of employment is constituted. In this case execution of again constituted individual program of employment is considered from new date.

4. Submission of the report on accomplishment of the individual program of employment

4.1. The performance report of the individual program of employment is constituted by PZ for every month (Appendix No. 2). Having entered private electronic office, the unemployed before the termination of the last working day of this month submits the report, having confirmed it in system in electronic procedure. In case of coincidence of the last day of confirmation of the report to the day off (in the holiday, other non-working days) the report can be confirmed the next working day.
