2. Recognize invalid:

1) the order of the Minister of Finance of the Republic of Kazakhstan of July 16, 2010 No. 356 "About approval of Rules of maintaining the customs register of intellectual property items" (registered in the Register of state registration of regulatory legal acts for No. 6386, No. 224 published on August 25, 2010 in the Kazakhstanskaya Pravda newspaper (26285));

2) the order of the Minister of Finance of the Republic of Kazakhstan of December 30, 2014 No. 599 "About introduction of amendments to the order of the Minister of Finance of the Republic of Kazakhstan of July 16, 2010 No. 356 "About approval of Rules of maintaining the customs register of intellectual property items" (registered in the Register of state registration of regulatory legal acts for No. 10224, published on March 13, 2015 in information system of law of Ad_let).

3. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining the customs register of intellectual property items

Chapter 1. General provisions

1. These rules of maintaining the customs register of intellectual property items are developed according to Item 2 of article 460 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan" (further - the Code) and determine procedure for maintaining the customs register of intellectual property items (further - the customs register of OIC).

Chapter 2. Maintaining the customs register of intellectual property items

2. Intellectual property items are subject to inclusion in the customs register of OIC after adoption of the positive decision by authorized body in the sphere of customs affairs (further - authorized body) in case of observance of the conditions established by Items 3 and 4 of article 461 of the Code.

3. The customs register of OIC is kept in electronic form in the form approved by this order.

4. The following data are entered in the customs register of OIC:

registration number according to the customs register of OIC;

name (type, image) of intellectual property item;

the name of goods, class of goods on the international classification of goods and services, according to the security document, commodity code according to the Commodity nomenclature of foreign economic activity of the Eurasian Economic Union at the level of the first six signs;

information about the owner (the name of the organization with indication of form of business or surname, name, middle name (if it is specified in the identity document) physical person, the location, the postal address, phone, the fax, the e-mail address);

name, number and date of the security document;

protection term on intellectual property item;
