RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

About approval of the Regulations on procedure for forming and use of office housing stock of law-enforcement bodies

(as amended on 11-10-2019)

According to the Housing code of the Republic of Uzbekistan and the Law of the Republic of Uzbekistan "About law-enforcement bodies", and also for the purpose of creation of regulatory framework on providing law-enforcement bodies with service housing premises of employees the Cabinet of Ministers decides:

1. Approve Regulations on procedure for forming and use of office housing stock of law-enforcement bodies according to appendix No. 1.

2. Determine that financing:

constructions and reconstruction of apartment houses and apartments for forming of office housing stock of law-enforcement bodies it is performed in accordance with the established procedure at the expense of limits of the capital investments which are annually provided to the Ministry of Internal Affairs of the Republic of Uzbekistan when forming investing programs of the Republic of Uzbekistan and extrabudgetary funds of the Ministry of Internal Affairs of the Republic of Uzbekistan, and also other sources which are not forbidden by the legislation;

acquisitions of apartments, capital and running repair and arrangement of office housing stock of law-enforcement bodies it is performed by the extrabudgetary funds of the Ministry of Internal Affairs of the Republic of Uzbekistan and other sources which are not forbidden by the legislation.

3. Make changes to the List of persons having the right to office premises, No. 24 approved by the resolution of the Cabinet of Ministers of January 27, 2000 (the joint venture of the Republic of Uzbekistan, 2000, No. 1, the Art. 7), according to appendix No. 2.

4. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzbekiston temir yullari A. Zh. Ramatov and the Minister of Internal Affairs of the Republic of Uzbekistan P. R. Bobozhonov.

Regulations on procedure for forming and use of office housing stock of law-enforcement bodies

Chapter 1. General provisions

1. This Provision according to the Housing code of the Republic of Uzbekistan and the Law of the Republic of Uzbekistan "About law-enforcement bodies" determines procedure for forming and use of office housing stock of law-enforcement bodies.

2. In this Provision the following basic concepts are used:

office housing stock - the fund created by the Ministry of Internal Affairs of the Republic of Uzbekistan (further - the Ministry of Internal Affairs) due to construction and reconstruction of apartment houses, and also acquisition of apartments of physical persons and legal entities in the procedure established by the legislation for providing staff of law-enforcement bodies with housing or improvement of their housing conditions;

office housing - the room intended for accommodation of staff of law-enforcement bodies and members of their families, which is in apartment houses of office and municipal housing stock, provided on contractual basis for service in law-enforcement bodies;

the employee of law-enforcement bodies (further - the employee) - the citizen of the Republic of Uzbekistan who is in the service in law-enforcement bodies, having special rank.

3. Forming of office housing stock of the Ministry of Internal Affairs and providing employees with office housing is performed for the account:

constructions and reconstruction of apartment houses;

acquisitions of apartment houses and apartments of physical persons and legal entities in the procedure established by the legislation.

Chapter 2. Procedure for use of office housing stock

§1. Accounting of office housing and the employees needing housing or improvement of housing conditions

4. For the purpose of effective use and providing employees with office housing, the Ministry of Internal Affairs their account is kept.

5. The Ministry of Internal Affairs assigns office housing to law-enforcement bodies and performs annual checks of condition of its accounting and use.

6. Forms of the book of accounting and accounting cards of office housing are established by the Minister of Internal Affairs of the Republic of Uzbekistan.

7. For accounting of the employees needing housing or improvement of housing conditions, and also distributions of office housing are created:

the domestic commission of Central office of the Ministry of Internal Affairs (further - the Central commission);

the domestic commission of territorial authorities of internal affairs (further - the territorial commissions).

8. Structure Central and the territorial commissions, their rights and obligations, procedure of activities and control of their activities are determined by the order of the Minister of Internal Affairs of the Republic of Uzbekistan.

9. Office housing is provided to employees on the duty station in the following cases:

a) if the employee is not employer or the member of the family of the employer of premises according to the employment contract, either the owner or the member of the family of the owner of premises;

b) if the employee is employer or the member of the family of the employer of premises according to the employment contract, either the owner or the member of the family of the owner of premises, but has no opportunity to return daily to the specified premises with use of public transport (in connection with remoteness of the place of its stay from the duty station at distance at least 60 km);

c) in case of accommodation of the employee in premises with total area is one family member lower than the social norm of the area of housing established by the legislation. When calculating total area of premises the employee's right to additional living space is considered;

d) if the employee lives in apartments where also other families as a part of which there are patients suffering from severe forms of some chronic diseases in case of which, cohabitation with them in one apartment is impossible live;

e) if the employee lives in adjacent uninsulated rooms where two and more families in the absence of the related relations live.

To the employees appointed to position of the inspector on prevention, office housing is provided directly in the territory of execution by them of service or the territory of massifs in close proximity to the place of execution of their service.
