About the Procedure for forming and maintaining the unified register of grades of agricultural plants

For the purpose of realization of Item 2 of article 4 of the Agreement on the address of seeds of agricultural plants within the Eurasian Economic Union of November 7, 2017 the Board of the Eurasian economic commission solved:

1. Approve the enclosed Procedure for forming and maintaining the unified register of grades of agricultural plants.

2. This Decision becomes effective after 30 calendar days from the date of its official publication, but not earlier than the date of entry into force of the Agreement on the address of seeds of agricultural plants within the Eurasian Economic Union of November 7, 2017.

Procedure for forming and maintaining the unified register of grades of agricultural plants

1. This Procedure is developed according to article 4 of the Agreement on the address of seeds of agricultural plants within the Eurasian Economic Union of November 7, 2017 (further - the Agreement) and determines the procedure of forming and maintaining the unified register of grades of agricultural plants by the Eurasian economic commission (further respectively - the Commission, the unified register).

2. The concepts used in this Procedure mean the following:

"the applicant of grade" - the physical person or legal entity which submitted the application for inclusion of data on grade in the national register;

"admission zone" - part of the territory of state member of the Eurasian Economic Union on which the grade is allowed it (is permitted, recommended) for use and which is specified in the national register;

"grade originator" - the physical person or legal entity of state member of the Eurasian Economic Union which created removed, revealed grade and (or) provides its preserving and data on which are entered in the national register;

"light zone" - the part of the territory of state member of the Eurasian Economic Union which is characterized by certain size of inflow of natural fotosinteticheska of active radiation and specified in the national register;

"authorized body" - the executive body or the organization of state member of the Eurasian Economic Union given authority on forming and maintaining the national register.

Other concepts used in this Procedure are applied in the values determined by the Agreement.

3. The unified register is created and kept by the Commission in Russian based on the data on grades of the agricultural plants represented by authorized bodies to the Commission in electronic form with use of the integrated information system of the Eurasian Economic Union included in national registers.

4. Authorized bodies represent for inclusion in the unified register the following data (in Russian):

a) sort and type of agricultural plant (it is specified also in Latin);

b) name of grade;

c) the registration number of grade specified in the national register;

d) data on the grade which is object of legal protection according to the legislation of state member of the Eurasian Economic Union (in the presence in the national register) (the diacritical mark of "P" - capital Latin letter P is put down);

e) year of inclusion of grade in the national register;

e) zone of the admission or light zone;

g) data on grade originator (in the presence in the national register): full name, address of the legal entity or surname, name, middle name (in the presence), residence of physical person;

h) the information about the applicant of grade (in the presence in the national register): full name, address of the legal entity or surname, name, middle name (in the presence), residence of physical person;

i) data on signs and properties of grade;

j) description of economic and biological properties of grade (in the presence).

5. Transfer by authorized bodies of the data specified in item 4 of this Procedure to the Commission is performed automatically in case of their entering into national registers, including when updating these data.

6. The data containing in the unified register are published on information portal of the Eurasian Economic Union.

Data on the grade having the same name, relating to the same sort and type of agricultural plant, 2 and more state members of the Eurasian Economic Union which arrived from national registers are published on information portal of the Eurasian Economic Union in the form of one record with one name of grade in which the data which arrived from each of state members of the Eurasian Economic Union provided by subitems "v" - "to" item 4 of this Procedure are specified.
