About formation of National service of health of Ukraine

Cabinet of Ministers of Ukraine decides:

1. Form National service of health of Ukraine as the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Health.

2. Approve Regulations on National service of health of Ukraine which are applied.

3. Bring in the scheme of the direction and coordination of activities of the central executive bodies by the Cabinet of Ministers of Ukraine through the corresponding cabinet ministers of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of September 10, 2014 No. 442 "About optimization of system of the central executive bodies" (The Official Bulletin of Ukraine, 2014, No. 74, the Art. 2105), the following changes:

Regulations on National service of health of Ukraine

1. The National Service of Health of Ukraine (NSHU) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Health who realizes state policy in the sphere of the state financial guarantees of medical attendance of the population.

2. NSZU in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine accepted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

3. The main objectives of NSZU are:

1) realization of state policy in the sphere of the state financial guarantees of medical attendance of the population according to the program of the state guarantees of medical attendance of the population (the program of medical guarantees);

2) accomplishment of functions of the customer of medical services, medicines and medical products according to the program of medical guarantees and for the budget programs which manager is NSZU;

3) submitting for examination of the Minister of Health of offers on ensuring forming of state policy in the sphere of the state financial guarantees of medical attendance of the population.

4. NSZU it agrees to the tasks assigned to it:

1) generalizes practice of application of the legislation on the questions which are within its competence develops offers concerning enhancement of legal acts, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, regulatory legal acts of the ministries and in accordance with the established procedure submits them for consideration of the Minister of Health;

2) the analysis and forecasting of needs of the population of Ukraine for medical services and medicines and medical products for the purpose of project development of the program of medical guarantees carries out, implementation of strategic purchases of medical services and reimbursation of medicines according to the program of medical guarantees;

3) is developed by the draft of the program of medical guarantees and drafts of specifications and conditions of purchase of medical services in the program of medical guarantees, makes offers concerning rates and adjusting factors;

3-1) determines reference healthcare institutions and analyzes expenses of such institutions on medical attendance in the procedure established by the legislation;

3-2) provides offers and consultations concerning forming, structures, functioning and increases in efficiency of network of healthcare institutions of the state and municipal pattern of ownership, structure and functioning of hospital districts;

3-3) analyzes incomes and expenditure statements of suppliers of medical services for the purpose of carrying out calculation of rates and adjusting factors and implementation of other powers, stipulated by the legislation;

Concludes 4), changes and stops agreements on medical attendance of the population and agreements on reimbursation;

5) performs the measures providing target and effective use of means according to the program of medical guarantees including actions for check of observance by suppliers of medical services of the requirements established by procedure for use of means of the program of medical guarantees, conditions of agreements on medical attendance of the population by monitoring implementation by the method provided in the Standard form of the agreement on medical attendance of the population according to the program of medical guarantees approved by the resolution of the Cabinet of Ministers of Ukraine of April 25, 2018 No. 410 "About agreements on medical attendance of the population according to the program of medical guarantees" (The Official Bulletin of Ukraine, 2018, No. 45, the Art. 1570) - with the changes made by the resolution of the Cabinet of Ministers of Ukraine of October 6, 2021 No. 1067, and also monitoring of agreement performance about reimbursation by pharmaceutical institutions;

Receives 6) and processes personal data and other information on patients, necessary for implementation of the powers (including information on the state of health, the diagnosis, data received during physical examination of patients), suppliers of medical services, subjects of managing who perform economic activity based on the license for implementation of economic activity on retail trade by medicines and signed the agreement on reimbursation (further - pharmaceutical institutions), irrespective of pattern of ownership and subordination with observance of requirements of the Law of Ukraine "About personal data protection";

7) is provided by functioning of electronic health care system (further - system), determines the directions of its development, carries out verification of data in system, approves technical requirements to electronic medical information systems;

8) provides maintaining the registers which are part of electronic health care system, other state electronic bases and registers, other information systems in the sphere which is within its competence;

9) performs payment on rate for the medical services rendered to patients (including medical products) and medicines under agreements on medical attendance of the population according to the program of medical guarantees and other agreements on medical attendance of the population;

10) is performed by cost recovery of medicines under agreements on reimbursation according to the program of medical guarantees;

11) provides to person information on him containing in electronic health care system and the information about persons which sent requests concerning the specified information according to the legislation;
