Rules of transfer by the State committee on property of the parcels of land to lease

These rules are prepared according to the Land code of the Azerbaijan Republic, the Laws of the Azerbaijan Republic "About lease", "About land reform", the Presidential decree of the Azerbaijan Republic "About measures for rational use of the leased state-owned property" and the Provision "About Rules of Realization of the Parcels of Land on Which the Privatized State Companies and Objects Are Located".

Transfer by the State committee on property to lease of the parcels of land which are in state-owned property is made according to these rules.

1. Depending on documentation, the leased parcels of land are divided into several groups:

1.1. Earlier leased parcels of land on which the right inheritance of the lessor on the basis of the legislation passed to the State committee on property;

1.2. The parcels of land which are under the privatized companies and objects which privatization the buyer refused;

1.3. The parcels of land which are under the privatized companies and objects which privatization is not provided (being in general use, etc.);

1.4. The parcels of land for the first time leased (the state lands and lands which are under object).

2. In connection with leasing of the parcels of land specified in Item 1, the following documents are required:

For the parcels of land specified in Item 1.1:

a) the statement of legal entity and physical person (for physical persons - notarially certified statement);

b) earlier signed lease agreement;

c) certificate or payment documents of availability or lack of rent debt;

d) the order or the statement from the order on leasing of the parcels of land;

e) sketch or technical data sheet of the parcels of land;

e) copy of the Charter and Certificate of the legal entity.

For the parcels of land specified in Item 1.2:

a) the purchase and sale agreement of the privatized company and object and the copy of the Certificate certifying the property right;

b) the statement of legal entity or physical person for refusal of privatization of the parcel of land under which there are privatized companies and objects;

c) the statement (certified) for renting of this parcel of land;

d) technical data sheet or the sketch of the privatized company and object;

e) copies of the Charter and Certificate of the legal entity;

e) the statement from the register about realization 75 percent of shares of Joint-stock company.

For the parcels of land specified in Item 1.3:

a) the documents specified in Item 1.2 (except the subitem).

For the parcels of land specified in Item 1.4:

a) the statement of legal entity and physical person with indication of the purpose of use of the parcel of land which is in the corresponding territory (for physical persons - notarially certified statement);

b) letter consent of the corresponding local executive body;

c) copies of the Charter and Certificate of the legal entity.

3. After submission in accordance with the established procedure of the specified documents in the State committee on property Management of privatization and leasing of the parcels of land in 10-day time checks these documents, prepares the draft of the Order of SPC and about leasing of the specific parcel of land and represents it for the signature.

4. After signing of the Order about delivery of the parcel of land in lease in 5-day time the lease agreement according to the legislation is signed. The lease agreement is signed in triplicate. The first copy remains in the State committee on property, and the second at the lessee. The third copy goes to the corresponding local executive body.

5. The term of turnover of documents for the conclusion of the lease agreement is regulated by the term established for turnover of documents in the State committee on property.

6. After the conclusion of the lease agreement the leased parcel of land on the basis of the act is transferred to 5-day time to the lessee.

The leased parcels of land are subject to registration.

Behind use of the leased parcels of land to destination and timeliness of payment of the rent control is established.

7. If in 3-month time from the date of the edition the lease agreement is not signed by the State committee on property of the Order on delivery of the parcel of land in lease, it is declared invalid that is documented in the appropriate order.

8. In case of non-use of the leased parcel of land within two years or not introduction of the rent for this term the adequate measures established by the law for violation of the lease agreement are taken.

9. Termination of the lease agreement is made according to the procedure, established by the legislation.

документа, удостоверяющего личность), далее именуемый Арендатор,
действующий на основе Устава, в лице

нижеследующих условиях.
                         1. Предмет договора
     1.1. Арендодатель  на  основании  Распоряжения   Государственного
комитета по имуществу Азербайджанской Республики от "__"
_________________ 199 __ года номер ______ сдает в аренду для
временного пользования земельный участок, расположенный в городе
(районе) _______________________________ по улице (проспекту)
_____________ общей площадью ___________ кв/м, включая ______________
кв/м под постройками и _______________ кв/м открытой площади.
Арендатор принимает указанный земельный участок.
1.2. Арендная плата применяется в следующем порядке:
Годовая арендная плата за 1 кв/м земельного участка под
постройкой составляет ___________ манатов, за 1 кв/м
