About approval of the Regulations on procedure for conducting checks of subjects of entrepreneurship

For the purpose of increase in efficiency of checks of activities of subjects of entrepreneurship, according to the Law of the Kyrgyz Republic "About procedure for conducting checks of subjects of entrepreneurship", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on procedure for conducting checks of subjects of entrepreneurship according to appendix.

2. Recognize invalid:

- the order of the Government of the Kyrgyz Republic "About procedure for conducting checks of subjects of entrepreneurship and determination of the list of the authorized bodies having the right to conducting checks of subjects of entrepreneurship" of November 6, 2007 No. 533;

- the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of November 6, 2007 No. 533 "About procedure for conducting checks of subjects of entrepreneurship and determination of the list of the authorized bodies having the right to conducting checks of subjects of entrepreneurship" of June 27, 2008 No. 347;

- the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic of November 6, 2007 No. 533 "About procedure for conducting checks of subjects of entrepreneurship and determination of the list of the authorized bodies having the right to conducting checks of subjects of entrepreneurship" of September 25, 2008 No. 536;

3. This resolution becomes effective after fifteen days from the date of official publication.

Regulations on procedure for conducting checks of subjects of entrepreneurship

1. General provisions

1. This Provision determines procedure and procedures of conducting checks by authorized bodies, forming, approvals of plans of the checks, reports on results performed (information on execution of plans), protection of the rights of entrepreneurs when conducting checks.

2. In this Provision the following concepts are used:

the checking sheet - the document including the list of requirements to activities of the subject of check which non-compliance attracts threat of life and to health of the person, the environment, valuable interests of citizens, legal entities and the states;

subjects of entrepreneurship - the physical persons and legal entities registered in the procedure established by the legislation of the Kyrgyz Republic and performing on the risk and under the property responsibility the activities which are not prohibited by the legislation with revenue generating purpose irrespective of their forms of business and patterns of ownership;

subjects of check - the legal entities, individual entrepreneurs, branches and representations registered according to the procedure, established by the legislation of the Kyrgyz Republic;

authorized bodies - the executive bodies authorized according to the legislation of the Kyrgyz Republic on implementation of checks of subjects of entrepreneurship.

3. Scheduled inspections are carried out according to plans of checks which are created based on strategic plans.

The strategic plan is created for year and includes quantitative indices in each direction. The strategic plan is approved with authorized body on development of entrepreneurship till November 15 of the year preceding year of conducting planned inspections.
