According to item 4 of article 74 of the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan" PRIKAZYVAYU:

1. Approve:

1) Acceptance procedures of the constructed object in operation by the owner independently according to appendix 1 to this order;

2) form of the acceptance act of the constructed object in operation by the owner independently according to appendix 2 to this order.

2. To provide to committee on cases of construction and housing and communal services of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of acceptance of the constructed object in operation by the owner independently (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan" (further - the Law) and determine procedure for acceptance of the constructed object in operation by the owner independently.

2. Action of these rules extends to the objects specified in Item 1 of article 74 of the Law.

Chapter 2. Procedure for acceptance of the constructed object in operation by the owner independently

3. In case of acceptance of the constructed object by the owner availability independently is required:

1) the architectural and planning task issued by the local executive body performing functions in the field of architecture and town planning (except for reconstruction (re-plannings, re-equipments) rooms (separate parts) of the existing buildings which are not connected with changes of the bearing and protecting (outside) designs, engineering systems and the equipment and not providing additional withdrawal (cutting) of the parcel of land);

2) specifications (in need of connection, additional connection of object to sources of engineering and utility support and/or increase in loadings);

3) sketch (conceptual design) / engineering design;

4) executive geodetic surveying of actual position of engineering networks and/or buildings (constructions) (except for the objects specified in subitems 4), 11), 13), 16), 17), 19) of Item 2 of article 60 of the Law).

4. In case of completion of building and construction works, the owner after receipt of the notice in writing from the contractor on readiness of object (if the asset construction was performed by contract method) starts acceptance procedure of the constructed object in operation.

5. In case of acceptance of the constructed object in operation the owner:

1) is accepted by object in operation with execution of the acceptance act of the constructed object in operation by the owner independently in form, according to appendix 2 to this order (further - the act);

2) is checked by observance of requirements of the sketch (conceptual design) / the engineering design, the issued initial materials (documents) for designing of object and the existing normative and technical documents;

3) is checked by compliance of the performed building and construction works, the applied construction materials (products, designs) and the equipment to the sketch (conceptual design) / to the engineering design, and also the state (interstate) standard rates if the asset construction was performed by contract method.

The act of input of the constructed object approves 4) in case of reconstruction (re-planning, re-equipment) of rooms (separate parts) of the existing buildings and constructions which are not connected with change of the bearing and protecting (outside) designs, engineering systems and the equipment with the designer on compliance of developed earlier engineering design.

6. Signature date of the act is considered date of the commissioning of the facility accepted by the owner independently.

7. The act is the exclusive initial document in case of registration of property right for the constructed object.

8. The act with appendix of executive geodetic surveying of actual position of engineering networks and/or buildings (constructions) is subject to obligatory accounting in the local executive bodies performing functions in the field of architecture and town planning in information system of the state town-planning inventory.
