1. Approve the enclosed Rules of determination of the amount of payment for provision of the space data and materials containing in the state funds of space data.

2. Recognize to invalid:

the order of the Government of the Russian Federation of June 25, 2012 No. 626 "About approval of Rules of determination of amount of remuneration for use of materials and data from federal, territorial and departmental kartografo-geodetic funds, the being objects of exclusive right" (The Russian Federation Code, 2012, No. 27, the Art. 3736);

Item of 31 changes which are made to acts of the Government of the Russian Federation, approved by the order of the Government of the Russian Federation of March 6, 2015 No. 201 "About introduction of amendments to some acts of the Government of the Russian Federation" (The Russian Federation Code, 2015, No. 11, the Art. 1607).

Rules of determination of the amount of payment for provision of the space data and materials containing in the state funds of space data

1. These rules establish procedure for determination of the amount of payment for provision of the space data and materials containing in the state funds of space data.

2. These rules do not extend to cases of provision of the state sea navigation charts from fund of space data of the federal executive body performing functions on development and realization of state policy, normative legal regulation in the field of defense.

3. The payment for provision of the space data and materials containing in the state funds of space data includes:

a) payment for use of the space data and materials which are not copyright objects or remuneration for use of the materials which are the copyright objects containing in the state funds of space data;

b) payment for rendering services in provision of the space data and materials containing in the state funds of space data which cost is established by Federal Registration Service.

4. The payment for use of the space data and materials which are not copyright objects and remuneration for use of the materials which are copyright objects is subject to transfer in the federal budget or the budget of appropriate subject of the Russian Federation according to the budget legislation of the Russian Federation.

5. The amount of payment for use of the space data and materials which are not copyright objects or remuneration for use of the materials which are the copyright objects containing in the state funds of space data (RP) is determined by formula:

Depending on the provided space data and materials basic unit of account are one square decimeter of graphical representation on the scale of its creation, or data on one Item of geodetic, leveling, gravimetric networks, parameters (keys) of transition between the state system of coordinates both local and international systems of coordinates, or one shot of aerial photography or results of remote sensing of Earth, or one leaf of cartographic works and editions (atlases), the reference documentation.

7. The cost of basic unit of account by provision of the space data and materials containing in federal and departmental funds of space data and also in fund of the space data of the federal executive body performing functions on development and realization of state policy, normative legal regulation in the field of defense, depending on type provided in use of space data and materials is established by Federal Registration Service.

The cost of basic unit of account by provision of the space data and materials containing in regional funds of the space data, depending on type provided in use of space data and materials is established by the supreme executive bodies of the government of appropriate subjects of the Russian Federation.

8. Depending on the conditions of use of space data and materials provided in the agreement signed by accession, or the license agreement about provision of the rights to the materials which are copyright objects the following values of coefficient P are established:

a) production of one and more copy (copy) of space data and materials or their parts in any material form without right of disposal to the third parties - 1;

b) production of one and more copy (copy) of space data and materials or their parts in any material form with right of disposal to limited circle of the third parties - 1,8;

c) production of one and more copy (copy) of space data and materials or their parts in any material form with right of disposal to unrestricted circle of the third parties - 2;

d) processing of space data and (or) creation of derivatives (conversion) of materials or their parts without right of disposal to the third parties - 1,5;

e) processing of space data and (or) creation of derivatives (conversion) of materials or their parts with right of disposal to limited circle of the third parties - 2,8;

e) processing of space data and (or) creation of derivatives (conversion) of materials or their parts with right of disposal to unrestricted circle of the third parties - 3;

g) placement of space data on the Internet and bringing materials to general data by means of the Internet - 2.

9. Values of coefficient With are established depending on duration of term of the use of space data and materials provided in the agreement signed by accession or the license agreement on provision of the rights to the materials which are copyright objects:

up to 5 years - 1;

5 - 10 years - 1,2;
