About approval of Regulations about procedure for use of coupons on food

Based on part (6) Articles 3, parts (3) Article 4 and article 21 of the Law No. 166 of September 21, 2017 on coupons on food (The official monitor of the Republic of Moldova, 2017, Art. No. 364-370, 618) DECIDES: the Government

1. Approve Regulations about procedure for use of coupons on food it (is applied).

2. To impose control over the implementation of this resolution on the Ministry of Finance, the Ministry of Economy and Infrastructure and the Ministry of Health, work and social protection.

Regulations about procedure for use of coupons on food

Chapter I. General provisions

1. In these Regulations the concepts determined in the Law No. 166 of September 21, 2017 on coupons on food are used (The official monitor of the Republic of Moldova, 2017, Art. No. 364-370, 618), in the Labor code No. 154-XV of March 28, 2003. (The official monitor of the Republic of Moldova, 2003, Art. No. 159-162, 648), with subsequent changes and amendments. Also for the purposes of these Regulations the following concepts are used:

2) the range of digital series - number of the single numbers assigned to coupons on food for the purpose of ensuring their identification;

3) the forbidden products to realization - the products specified in part (3) article 6 of the Law No. 166 of September 21, 2017 on coupons on food;

4) the principle "the first came, the first left" - the principle according to which the coupons on food transferred to payment card with the earliest date of issue will be debited the first when shopping;

5) the processing companies - the companies which sign the contract with operators and which participate in any of processes of issue, distribution, issuance and payment of coupons on food.

6) it is excluded.

2. These Regulations are applied to:

1) to operators who have license for activities on application of coupons on food;

2) to employers who provide coupons on food to workers in the conditions of the Law No. 166 of September 21, 2017 on coupons on food;

3) to the trade companies / catering establishments providing services in public catering and/or sale of foodstuff.

5. Accounting of transactions with coupons on food is performed by operators by means of the information system allowing to store data in the conditions of protection and safety.

6. In case of any changes of regulations of these Regulations the coupons on food which are in circulation are considered valid during the period for which they were issued.

Chapter II. Employers

7. The employer has the right to provide to workers individual benefit on food in the form of coupons on food.

8. The employer provides coupons on food based on the order signed by the director.

9. The employer has no right to oblige the worker to receive coupons on food.

10. The worker can receive coupons on food only in the place of the main work.

11. The maximum quantity of coupons on food which the worker can receive during calendar month shall not exceed the number of the days which are actually worked the worker in the place of the main work in the month preceding month in which coupons, according to agreement provisions were provided.

12. The maximum total cost of coupons on food listed on payment card of the worker who is carrying out work in shifts shall be equal to the total quantity of the hours fulfilled within the last month, divided into eight, increased by nominal value of the coupon provided to the worker. The result is rounded according to mathematical rules to integer.

13. In case of the termination of employment relationships for any reason, the worker has the right to coupons to food the actual days fulfilled from the 1st of dismissal prior to day in which he was dismissed. The right to coupons on food stops after 60 days from the date of the termination of employment relationships.

14. In case of the termination of employment relationships the employer provides coupons on food to the dismissed person within 15 days from the date of the termination of employment relationships for the last month and for current month if coupons were not provided before date of the termination of employment relationships.

18. The employer has no right to demand from the worker payment card on which the cost of coupons was transferred to food, after the termination of employment relationships.

19. The coupon is valid for food within 6 months from the date of transfer of its nominal value to payment card of the worker.

20. The employee shall provide to the employer the declaration under own responsibility for receipt of coupons on food only on the main workplace. The declaration sample under own responsibility is established by the Ministry of Finance.

21. In case of receipt of coupons by the worker on food in two and more places of employment at the same time the cost of the corresponding coupons on food constitutes the taxable income for the worker.

22. In case the worker works for different employers the same number of hours, the main workplace is established individually by the worker by submission of the declaration under own employer's liability. The workplace in that case cannot be changed more often than once a month.
