About establishment of the list of international financial institutions which bonds banks and bank holdings acquire in property, and requirements to bonds which banks and bank holdings acquire in property

According to the Law of the Republic of Kazakhstan of August 31, 1995 "About banks and banking activity in the Republic of Kazakhstan" the Board of National Bank of the Republic of Kazakhstan DECIDES:

1. Establish the following list of international financial institutions which bonds banks and bank holdings acquire in property:

Asian Development Bank (Asian Development Bank);

Asian Infrastructure Investment Bank (Asian Infrastructure Investment Bank);

Inter-American Development Bank (Inter-American Development Bank);

African development bank (African Development Bank);

Eurasian Development Bank (Eurasian Development Bank);

European Investment Bank (European Investment Bank);

Development bank of the European Council (Council of Europe Development Bank);

European Bank for Reconstruction and Development (European Bank for Reconstruction and Development);

Islamic corporation on private sector development (the Islamic Corporation for the Development of the Private Sector);

Islamic development bank (Islamic Development Bank);

Scandinavian investment bank (Nordic Investment Bank);

International Monetary Fund (International Monetary Fund);

International Finance Corporation (International Finance Corporation);

International Bank for Reconstruction and Development (International Bank for Reconstruction and Development).

2. Establish the following requirements to bonds which banks and bank holdings acquire in property:

1) the bonds having the status of the government issued securities of the Republic of Kazakhstan (including emitted according to the legislation of other states), are issued by the Ministry of Finance of the Republic of Kazakhstan and National Bank of the Republic of Kazakhstan or concerning which the state warranty of the Government of the Republic of Kazakhstan is had;

2) the bonds issued by local executive bodies of the Republic of Kazakhstan are included in the official listing of the stock exchange performing activities in the territory of the Republic of Kazakhstan;

3) bonds of foreign issuers have rating not below "In" (on classification of Standard & Poor rating agencies "s and (or) Fitch) or not below "B2" (on classification of Moody rating agency" s Investors Service);

4) bonds of issuers of the Republic of Kazakhstan are included in the official listing of stock exchange of the Republic of Kazakhstan, except for the bonds which are in category "buffer category" of the sector "debt securities" of the respective platform of the official listing of stock exchange or the bond of issuers of the Republic of Kazakhstan are admitted to public trading on the stock exchange functioning in the territory of the International financial center "Astana" or have rating not below "In" on classification of Standard & Poor rating agency "s or the rating of similar level of one of other rating agencies. For the purposes of this subitem, the bonds of issuers of the Republic of Kazakhstan which are the organizations more than 50 (fifty) percent of shares in the authorized capital or placed shares of which belong to the Government of the Republic of Kazakhstan, National Bank of the Republic of Kazakhstan or national managing holding, are recognized as the bonds of issuers of the Republic of Kazakhstan having the sovereign rating of the Republic of Kazakhstan;

5) the bonds having the status of government securities, issued by the central governments of foreign states have sovereign rating not below "VVV-" on the international scale of the Standard & Poor agency "s or the rating of similar level of one of other rating agencies.

3. Recognize invalid regulatory legal acts of the Republic of Kazakhstan, and also structural elements of some regulatory legal acts of the Republic of Kazakhstan according to the list according to appendix to this resolution.

4. To department of methodology of the financial market (Abdrakhmanov N. A.) in the procedure established by the legislation of the Republic of Kazakhstan to provide:

1) together with Legal department (Sarsenov N. V.) state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this resolution the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this resolution on official Internet resource of National Bank of the Republic of Kazakhstan after its official publication;

4) within ten working days after state registration of this resolution submission to Legal department of data on execution of the actions provided by subitems 2), 3) of this Item and Item 5 of this resolution.

5. To management on consumer protection of financial services and external communications (Terentyev A. L.) provide within ten calendar days after state registration of this resolution the direction it to the copy on official publication in periodic printing editions.

6. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Smolyakov O. A.

7. This resolution becomes effective since March 1, 2018 and is subject to official publication.
