RESOLUTION OF BOARD OF NATIONAL BANK OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of determination of solvency of banknotes and coins of national currency of the Republic of Kazakhstan

According to the Law of the Republic of Kazakhstan of March 30, 1995 "About National Bank of the Republic of Kazakhstan", for the purpose of enhancement of procedure for determination of solvency of banknotes and coins of national currency of the Republic of Kazakhstan the Board of National Bank of the Republic of Kazakhstan DECIDES:

1. Approve Rules of determination of solvency of banknotes and coins of national currency of the Republic of Kazakhstan according to appendix 1 to this resolution.

2. Recognize invalid regulatory legal acts of the Republic of Kazakhstan according to the list according to appendix 2 to this resolution.

3. To management on work with cash (Abisheva T. T.) in the procedure established by the legislation of the Republic of Kazakhstan to provide:

1) together with Legal department (Sarsenov N. V.) state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this resolution the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this resolution on official Internet resource of National Bank of the Republic of Kazakhstan after its official publication;

4) within ten working days after state registration of this resolution submission to Legal department of data on execution of the actions provided by subitems 2), 3) of this Item and item 4 of this resolution.

4. To management on consumer protection of financial services and external communications (Terentyev A. L.) provide within ten calendar days after state registration of this resolution the direction it to the copy on official publication in periodic printing editions.

5. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Galiyeva D. T.

6. This resolution becomes effective after ten calendar days after day of its first official publication.

Rules of determination of solvency of banknotes and coins of national currency of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of determination of solvency of banknotes and coins of national currency of the Republic of Kazakhstan (further - Rules) are developed according to the Law of the Republic of Kazakhstan of March 30, 1995 "About National Bank of the Republic of Kazakhstan".

2. Rules establish procedure for making of transactions by determination of solvency of banknotes and coins of national currency of the Republic of Kazakhstan, except the coins made of precious metals, and separate transactions with them after determination of authenticity and solvency by branches of National Bank of the Republic of Kazakhstan (further - branches of National Bank), banks of the second level, the National operator of mail and the organizations performing transactions on collection of banknotes, coins and values (further - authorized banks), in case of implementation of activities for recalculation, sorting, packaging, storage of banknotes, coins and values.

Chapter 2. Determination of solvency of the banknotes and coins of national currency of the Republic of Kazakhstan which are valid legal tender currency

3. Solvency of banknotes and coins of national currency of the Republic of Kazakhstan (further - banknotes and coins) is their capability to act as legal means of payment in the Republic of Kazakhstan.

4. The authentic banknotes which did not void legal means of payment, are not withdrawn from circulation and withdrawn from circulation, kept at least 70% (seventy percent) from established by National Bank of the Republic of Kazakhstan (further - National Bank) the sizes of banknotes, and the signs (written or digital) which are designating their nominal and having insignificant damages (if they do not interfere with determination of authenticity of banknotes), including shabby belong to payment banknotes.

5. The authentic coins including defective (damaged), which are legal means of payment, not withdrawn from circulation and withdrawn from circulation, kept irrespective of nature of damages written and (or) digital signs on obverse (face), reverse (back) or herd (side surface) and also both parts of the coins relating to bikolorny (the coin consisting of two and more components made of different metals) belong to payment coins.

6. Authentic banknotes and coins are the banknotes and coins introduced into circulation by National Bank and which are not counterfeit.

7. Payment banknotes are subdivided on:

1) suitable for the address;

2) shabby;

3) withdrawn from circulation.

8. Payment coins are subdivided on:

1) suitable for the address;

2) defective (damaged);

3) withdrawn from circulation.

9. Banknotes and coins, suitable for the address, are the banknotes which do not have the damages specified in Item 10 of Rules and the coins which do not have the damages specified in Item 11 of Rules.

Banknotes, suitable for the address, and coins are subdivided into banknotes and coins in issued packaging and on the banknotes and coins which are in circulation.

The banknotes sorted on calculating and sorting machines having the anguishes which are not followed by loss of part of the square of banknote belong to suitable banknotes.

10. Shabby banknotes are the banknotes having the following damages:

1) the texts which are filled in with dyes, including having put with the spreading paints;

2) the having foreign texts, including:

processed by special chemical powder which are visible in case of ultra-violet light;

the blocking machine-readable signs;

3) the broken-off banknotes which are stuck together or not stuck together parts of which undoubtedly belong to the same banknote and together constitute the area at least 70% (seventy percent) from the banknote size established by National Bank;

4) lost more than 1% (one percent) of the area from corner or edge, but at the same time the kept at least 70% (seventy percent) of the banknote size established by National Bank;

5) the having anguishes which are stuck together by transparent adhesive tape;

6) the having openings, punctures and holes from 3 (three) and more millimeters in the diameter, except as specified, when availability of punctures on banknote demonstrates its repayment;

7) the having attritions which led to loss of the image of banknote;

8) burned and burned, but at the same time the kept at least 70% (seventy percent) of the banknote size established by National Bank;

9) the surfaces of the front and (or) turnover parties having pollution which led to decrease in the image and brightness of banknote. Pollution is meant as condition of banknotes which is characterized by darkening of surface of banknote owing to availability of dust, dirt, oils and other pollutants;

10) the papers having loosening and lost rigidity.

11. The defective (damaged) coins are the coins having the following damages:

1) flattened, made a hole, bent, nadpilenny, broken, shabby (except the coins subjected to machining (corrugation);

2) etched in acid, with we will sing any metals;

3) damaged in case of impact of high temperature;

4) the written and (or) digital signs which changed the initial color, but kept on obverse (face), reverse (back) or herd (side surface).

12. The payment shabby banknotes which arrived in authorized banks, the defective (damaged) coins are sorted, not released, transferred to branches of National Bank and exchange on the banknotes and coins suitable for the address.

13. The banknotes and coins withdrawn from circulation are banknotes and coins of old sample which are legal means of payment and being in parallel circulation with banknotes and coins of new sample.

14. Payment banknotes and coins (except shabby banknotes and the defective (damaged) coins) in the territory of the Republic of Kazakhstan are accepted for all payment types and money transfers.

15. Payment shabby banknotes and the defective (damaged) coins are accepted by authorized banks for all payment types and money transfers without restrictions.

Chapter 3. The banknotes and coins which are not legal means of payment in the Republic of Kazakhstan

16. To banknotes and coins, not being legal means of payment belong:

1) the banknotes and coins which voided legal means of payment;

2) counterfeit banknotes and coins;

3) not payment banknotes and coins;

4) the rejected banknotes and coins.

17. The banknotes and coins which voided legal means of payment are the banknotes and coins withdrawn from circulation, and also the extinguished banknotes and corrugated coins.

18. The banknotes and coins withdrawn from circulation are banknotes and coins of old sample which stopped being legal means of payment based on the decision of National Bank on retirement.

19. The extinguished banknotes are the banknotes subjected to special machining (piercing).

The characteristic of signs of repayment is carried by National Bank to authorized banks.

20. Corrugated coins are the coins subjected to special machining (corrugation).

The characteristic of signs of corrugation is carried by National Bank to authorized banks.

21. Counterfeit banknotes and coins are the remade banknotes, and also banknotes and coins having counterfeit signs. The signs specified in Items 22 and 23 of Rules belong to strong indications of counterfeit of banknotes and coins.

22. The remade banknotes are the banknotes introduced into circulation by National Bank, but having stickers, the nadrisovanny or printed texts or figures changing nominal of banknotes. Appearance of the remade banknote is similar to type of authentic banknote of other nominal.

23. The banknotes and coins which are not authentic and in any manner the reproducing appearances of authentic banknotes and coins, and also the banknotes consisting of several fragments, one of which is counterfeit, belong to the banknotes and coins having counterfeit signs.

24. Counterfeit banknotes and coins are not subject to exchange, return to the client and are reported to law enforcement agencies of the Republic of Kazakhstan.

25. The banknotes which lost 50% (fifty) and more percent from the size established by National Bank, the banknotes having text "ULG І", OBRAZETS, "SPECIMEN", MULYAZH, and also the banknotes having fragments of authentic banknotes and having cuts with traces of glue and (or) adhesive tape are not payment.

26. The coins which did not keep the written and (or) digital signs on obverse (face), reverse (back) or herd (side surface) and also having text of MULYAZH are not payment.

27. Banknotes and coins in case of which production the visible variation from specifications is allowed (discrepancy of the size, anguishes, discrepancy of numbering, lack of graphical representation (one and more), availability of blots, combination of paints, combination and (or) the indistinct image of stamping) are rejected. Banknotes and coins are recognized rejected after conducting examination of National Bank.

28. The banknotes and coins which are not legal means of payment are not subject to acceptance for implementation of payments and money transfers.

Chapter 4. Implementation of transactions by determination of solvency of banknotes and coins and separate transactions with them after determination of solvency and authenticity

29. Doubtful banknotes and coins are the banknotes which kept more than 50% (fifty percent) of the area of the sizes of banknotes established by National Bank having the damages complicating determination of authenticity of banknotes, and the coins having the damages, misstatements complicating determination of authenticity of coins.

30. Doubtful banknotes and coins are accepted by authorized banks and go for examination in branches of National Bank for determination of authenticity and possibility of exchange.

31. The banknotes and coins recognized as examination by authentic are subject to exchange for banknotes, suitable for the address, and coin.
