According to article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity is estimated and frequency of implementation of planned actions of the state supervision (control) in the field of technogenic and fire safety by Public service is determined by emergency situations, according to appendix.

2. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of February 29, 2012 "About approval of criteria by which the risk degree from implementation of economic activity is estimated and is determined No. 306 frequency of implementation of planned actions of the state supervision (control) in the field of technogenic and fire safety" (The Official Bulletin of Ukraine, 2012, No. 30, the Art. 1115);

the resolution of the Cabinet of Ministers of Ukraine of June 4, 2015 No. 361 "About modification of appendix to the resolution of the Cabinet of Ministers of Ukraine of February 29, 2012 No. 306" (The Official Bulletin of Ukraine, 2015, No. 46, the Art. 1479).

Criteria by which the risk degree from implementation of economic activity is estimated and frequency of implementation of planned actions of the state supervision (control) in the field of technogenic and fire safety by Public service is determined by emergency situations

1. Criteria by which the risk degree from implementation of economic activity in the field of technogenic and fire safety is estimated are:

1) implementation by the subject of managing of activities on:

potentially dangerous objects, objects of the increased danger, and also objects having strategic importance for economy and safety of the state according to the list approved by the resolution of the Cabinet of Ministers of Ukraine of March 4, 2015 No. 83 (The Official Bulletin of Ukraine, 2015, No. 20, the Art. 555), and the subways (GSN B.2.3-7-2010 "Transport constructions. Subways");

the objects referred to the corresponding category on fire and explosion and fire risk (it is determined according to GOST V.1.1-36: 2016 "Determination of categories of rooms, buildings and outside installations on fire and explosion and fire risk");

2) class of effects (responsibility) of object according to the Law of Ukraine "On regulation of town-planning activities";

3) the conditional height of the building according to GSN B. 1.1-7: 2016 "Fire safety of construction objects. General requirements";

4) area of the object;

5) availability of underground and/or basement stores, rooms, constructions according to GSN V.2.2-9: 2009 "Buildings and constructions. Public buildings and constructions. Basic provisions";

6) object belonging to the monuments of cultural heritage of national and local value included in the State register of immovable monuments according to the Law of Ukraine "About protection of cultural heritage";

7) hazard rate from implementation of economic activity of the subject of managing which calculation is perfromed according to the techniques approved by the Ministry of Internal Affairs (values of acceptable, minimum and maximum permissible risk are determined by the Management concept risks of emergence of emergency situations of technogenic and natural nature approved by the order of the Cabinet of Ministers of Ukraine of January 22, 2014 No. 37 (The Official Bulletin of Ukraine, 2014, No. 10, the Art. 333);

8) rendering services, carrying out rescue and other urgent works by rescue services.

2. According to the established criteria subjects of managing treat one of three risk degrees - high, average or insignificant.

3. Subjects concern subjects of managing with high risk:

1) performing activities in the territory and/or in the rooms belonging to them on the property right, ownerships, uses:

objects of the increased danger, and also objects having strategic importance for economy and safety of the state (in the field of defense; fuel and energy complex; transport industry, the companies providing placement and storage of material values of the state reserve; aviation and space-rocket, mechanical, food industry; metallurgical, chemical complexes; polygraphies) and subways;

industrial, store buildings (constructions), outside installations which on category of fire and explosion danger belong to the category "A" or "B";

industrial buildings (constructions), outside installations which on category of fire risk belong to the category "B", of 5 thousand sq.m and more;

store buildings (constructions), outside installations which on category of fire risk belong to the category "B", of 10 thousand sq.m and more;

objects which on class of effects (responsibility) belong to objects with considerable effects (CC 3);

objects which are houses and/or constructions with conditional height more than 47 meters;

objects which are monuments of cultural heritage of national value;

objects for which the hazard rate from implementation of economic activity of the subject of managing constitutes from 5kh 10-6 to 1kh 10-5 inclusive;

2) being the public, regional, municipal, object rescue service, and also rescue service of public organization.

4. The subjects performing activities in the territory and/or in the rooms belonging to them on the property right, ownerships, uses concern subjects of managing with average risk degree:

1) potentially dangerous objects, and also objects having strategic importance for economy and safety of the state (in the field of agro-industrial complex, telecommunications and communication, scientific activities, the sphere of the standardization, metrology and certification, hydrometeorological activities, the industry of construction materials, the financial and budget sphere light for industry);

2) industrial, store buildings (constructions), outside installations which on category of fire risk belong to the category "B", the area:
