About approval of the Technical regulation about the main safety requirements to explosives for civil application, placement in the market and control over explosives for civil application

Based on Article 18 and line item of the 12th appendix No. 3 to the Law No. 235 of December 1, 2011 on activities for accreditation and assessment of conformity (The official monitor of the Republic of Moldova, 2012, Art. No. 46-47, 136), with subsequent changes and amendments, DECIDES: the Government

1. Approve the Technical regulation about the main safety requirements to explosives for civil application, placement in the market and supervision over explosives for civil application it (is applied).

2. This resolution becomes effective after 24 months of date of publication in the Official monitor of the Republic of Moldova, except for Items 9, of 53, of 54, of 56, 57 and 83 Technical regulations about the main safety requirements to explosives for civil application, placement in the market and supervision over explosives for civil application which will become effective from signature date of the Agreement on assessment of conformity and recognition of industrial products between the Republic of Moldova and the European Union.

3. To entry into force of the Agreement on assessment of conformity and recognition of manufactured goods between the Republic of Moldova and the European Union:

1) placement in the market of the explosives marked by the mark of conformity of SM put according to Law No. 235 provisions from is allowed

On December 1, 2011 about activities for accreditation and assessment of conformity;

2) the producer or his authorized representative - the legal entity with the location in the Republic of Moldova puts the sign SM in case assessment of conformity of the explosives for civil application intended for the national market is performed by the conformity assessment bodies recognized by the Ministry of Internal Affairs, way of use of the procedures provided in Chapter VI of the Technical regulation about the main safety requirements to explosives for civil application, placement in the market and control over explosives for civil application. It is forbidden in the conditions provided by this resolution, drawing on the same explosives of civil application of mark of conformity of SM and marking of SE;

3) the Ministry of Internal Affairs recognizes bodies which perform assessment of conformity of explosives for civil application, held for use in the markets of the country provided in Chapter VI of the Technical regulation about the main safety requirements to explosives for civil application, placement in the market and control over explosives for civil application;

4) requirements to the notified conformity assessment bodies are applied also to acknowledged conformity assessment bodies. When holding procedures for assessment of conformity the acknowledged bodies performing assessment of conformity of explosive for civil application constitute the test certificate on standard sample;

5) the procedure of the notification corresponds to the procedure of recognition;

6) the list of acknowledged conformity assessment bodies, specific requirements for which they were acknowledged and identification numbers of bodies affirm and staticized by the order of the Ministry of Internal Affairs which is published in the Official monitor of the Republic of Moldova;

7) provisions of this resolution to marking of SE are applied also to the sign SM.

4. To the Ministry of Internal Affairs within 24 months to determine the list of the national standards contradicting the European standards and to approve by the order the list of national standards which accept the harmonized European standards applicable to explosives for civil application.

5. Obligations of the producer, his authorized representative, the importer or the distributor, legal entities with the location in the Republic of Moldova concerning the explosives for civil application which are present at the market under the sign of SM correspond to those that are provided by this resolution for explosives of civil application with marking of SE.

6. Declare invalid appendix No. 1 to the Order of the Government No. 138 of December 10, 2009. "About approval of some technical regulations" (The official monitor of the Republic of Moldova, 2009, Art. No. 51-52, 218).

7. To the Ministry of Internal Affairs, before entry into force of this resolution to develop the plan of implementation of the Technical regulation about the main safety requirements to explosives for civil application, placement in the market and control over explosives for civil application.

8. To impose control over accomplishment of this resolution on the Ministry of Internal Affairs.
