Regulations on territorial defense

1. General provisions

1. The regulations on territorial defense are developed for the purpose of implementation of article 23 of the Law of the Republic of Tajikistan "About defense" and determine organizationally - precepts of law in the field of territorial defense in the Republic of Tajikistan, establish the basic principles, powers and obligations of state bodies, organizations, irrespective of them organizationally - legal form and officials of the Republic of Tajikistan in this area.

2. In the present the Provision the following basic concepts are used:

- territorial defense - complex of nation-wide soldiers and special events for protection of sovereignty, territorial integrity and the constitutional system of the Republic of Tajikistan;

- the plan of territorial defense - the actions plan approved by the President of the Republic of Tajikistan the actions plan, directed to implementation of measures for territorial defense of the Republic of Tajikistan for protection of sovereignty, territorial integrity and the constitutional system of the Republic of Tajikistan for maintenance of the mode of warlike situation;

- authorized body in the field of territorial defense - the state body performing state policy in the field of territorial defense;

- governing bodies of territorial defense - organizationally - the regular structures created based on bodies of the public, military and local authority for the organization of territorial defense, management, its expansion and maintaining;

- control centers the headquarters of zone (area) of territorial defense - the equipped place from which the administrative board and officials of governing bodies of territorial defense exercise control of subordinate forces;

- controls - means of wire and radio communication, information transmission media intended for management of forces of territorial defense;

- forces of territorial defense - rifle battalions (companies), summary mobile and destructive groups (groups), it is emergency - rescue groups, groups (groups) of self-defense;

- military forming of zones (areas) of territorial defense - the rifle battalions, (companies) of zones (areas) of territorial defense created with expansion of territorial defense of military management by local authorities for accomplishment of tasks of territorial defense.

3. The purpose of territorial defense is:

- protection and defense of frontier and other important state objects from attack of the opponent;

- giving to defense of the state of national nature;

- creation of conditions for steady functioning of state bodies and organizations, establishment and maintenance of the modes of emergency and warlike situation;

- increase in opportunities of military organization of the state in case of military threat and in wartime.

4. Tasks of territorial defense are:

- cover and defense of sites of frontier out of strips of responsibility of areas of fighting of connections and parts of Armed Forces of the Republic of Tajikistan;

- protection and defense of important state objects;

- protection and defense of constructions on the communication line;

- prevention and suppression of diversions and acts of terrorism;

- ensuring introduction and maintenance of the mode of emergency and warlike situation;

- fight against illegal armed groups and diversionno - prospecting forces of aggressor;

- content, protection and providing routes of promotion of troops, organization of commandant's service;

- participation in mitigation of consequences of subversive and terrorist acts, mass riots and use of weapon by the opponent;

- accomplishment of separate fighting tasks together with other military structures of the Republic of Tajikistan.

5. Forces of territorial defense are:

- military forming (rifle battalions (companies)) created by bodies of local military management from among the citizens staying in inventory of 2-3 categories;

- summary mobile destructive groups (groups) created from number of persons employed of territorial authorities of internal affairs, public service of protection of Mukhofiz of the Ministry of Internal Affairs of the Republic of Tajikistan, internal troops of the Ministry of Internal Affairs of the Republic of Tajikistan;

- groups (groups) of self-defense of areas of territorial defense created from among inhabitants of local population;

- groups and groups of self-defense of the organizations, organizations and companies created of number of persons employed of the organizations, organizations and companies irrespective of patterns of ownership;

- the militarized protection of the organizations, staff of private security institutions;

- the rescue groups created from among staff of territorial headquarters of Committee on emergency situations and civil defense under the Government of the Republic of Tajikistan, internal troops of the Ministry of Internal Affairs of the Republic of Tajikistan, employees of medical institutions, the fire protection open for joint-stock holding company of "Barka Tochik", organizations of water utility.

2. Powers of the President of the Republic of Tajikistan and state bodies in the field of territorial defense

6. President of the Republic of Tajikistan:

- performs the common directorship of activities of state bodies in the field of territorial defense in the Republic of Tajikistan;

- determines authorized body in the field of territorial defense;

- determines the purposes and tasks of territorial defense in the Republic of Tajikistan;

- considers the report of the Government of the Republic of Tajikistan concerning territorial defense;

- issues decrees concerning territorial defense;

- approves the plan of territorial defense of the Republic of Tajikistan;

- approves standard infrastructure of zones (areas) of territorial defense;

- by means of authorized body performs management of territorial defense;

- performs other powers according to the legislation of the Republic of Tajikistan.

7. Government of the Republic of Tajikistan:

- determines the approved functioning and interaction of state bodies in the field of territorial defense;
