About approval of the Procedure for forming, maintaining and use of data of the licensed register and their representation in the Unified licensed register

According to article 19 of the Law of Ukraine "About licensing of certain types of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for forming, maintaining and use of data of the licensed register and their representation in the Unified licensed register which is attached.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Procedure for forming, maintaining and use of data of the licensed register and their representation in the Unified licensed register

1. The licensed register (further - the register) is list of subjects of managing - licensees which is created and conducted by body of licensing according to the license received by licensees as the automated system of collection, accumulating, protection and accounting of information about these subjects.

2. The register is created on the basis of national classification system and coding of technical and economic information on purpose:

maintaining in full accounting of the subjects of managing of the licensees and also issued, renewed, recognized invalid the cancelled licenses and their copies or duplicates;

realization according to requirements of the legislation of the principles of availability of publicity and openness of information on subjects of managing licensees to the interested users;

carrying out analytical researches.

3. The register is created by body of licensing separately by each type of economic activity.

4. Are entered in the register:

information about the subject of managing - the licensee (the name, form of business, the location, bank details and the identifying code of the legal entity or surname, name, middle name, the place of residence and identifitsikatsionny number of physical person of the subject of business activity, phone number, the fax);

data on body of licensing which granted the license (the name, the location, identification code);

type of economic activity according to the granted license;

date and number of the decision on licensing;

series and license number;

license effective period;

data on renewal of the license, issue of its copy or duplicate;

the bases, date and number of the order about need of elimination of violations of licensed conditions;

bases, date and number of the decision on cancellation of the license;

bases, date and number of the decision on recognition of the invalid license.

5. Sheets are entered in the register not later than the next working day after:

acceptance of licensing of the decision by body about licensing, its renewal, issues of the copy or the duplicate, cancellation or recognition of the invalid license, the order about need of elimination of violations of licensed conditions;

receipts of the message from the licensee on modification of documents which were enclosed by it to the application for licensing or its copy.

6. The unified licensed register is the automated system of collection, accumulating and accounting of data on questions of licensing of certain types of economic activity.

Manager and the holder of the Unified licensed register is GRS which keeps such register, performs Normative and methodical ensuring its functioning.

The administrator of the Unified licensed register - the state company belonging to the sphere of management of Ministry of Justice which performs actions for administration and support of the software of the Unified licensed register provides its functioning within separate virtual network, is responsible for preserving data and their protection against unauthorized access to the Unified licensed register, has full direct access to structures of the single computer database and is responsible for preserving data in the Unified licensed register, data protection from destruction.

7. Bodies of licensing shall monthly not later, than the 15th of the next period to submit data to the Unified licensed register using information and telecommunication means electronically.

7-1. Information which contains in the Unified licensed register and registers is open.

On official websites of bodies of licensing and Gospredprinimatelstva information which contains in the Unified licensed register and registers is placed, namely:

data on body of licensing (name, address);

information about the subject of housekeeping (the name of the legal entity or surname, name and middle name of the physical person - the entrepreneur);

data on the license (license number, effective period, type of economic activity).

8. Public authorities, local government bodies, citizens of Ukraine, the company, organization, organization of all patterns of ownership, international associations and the organizations, foreign legal entities and physical persons, stateless persons are users of data from registers and the Unified licensed register.

9. Sheets from registers and the Unified licensed register can be given to users with use of electronic means of communication or electronic and magnetic data carriers.

10. For use of data from registers and the Unified licensed register the payment which amount is approved by the Ministry of Economic Development in coordination with the Ministry of Finance is levied.

Public authorities are exempted from payment for use of data from registers and the Unified licensed register.

11. The means received from payment for use of data from the register and the Unified licensed register are enlisted in the Government budget of Ukraine according to the procedure, established by the Ministry of Finance.
