About creation of the Agency on technical supervision

No. 369-378, 755), for the purpose of optimization of bodies with functions of control and supervision in the field of safety of production facilities, construction and town planning, geodesy and cartography, fire safety and civil protection, according to appendix to the Law No. 131 of June 8, 2012 on the state control of business activity (The official monitor of the Republic of Moldova, 2012, Art. No. 181-184, 595), with subsequent changes and amendments, and to the Law No. 185 of September 21, 2017 on modification and amendments in some legal acts (The official monitor of the Republic of Moldova, 2017, Art. No. 371-382, 632) DECIDES: the Government

1. Accept the offer of the Ministry of Economy and Infrastructure on creation of the Agency on technical supervision in subordination of the Ministry of Economics and infr of structure by merging (merge) of the Main state inspectorate for technical supervision of hazardous production facilities, the State inspection in construction with territorial inspections, both in subordination of the Ministry of Economy and Infrastructure, State inspectorate for geodetic, technical supervision and the mode in subordination of the Agency of land relations and the inventory.

2. The technical supervision agency is successor of the rights and obligations of the Main state inspectorate for technical supervision of hazardous production facilities, the State inspection in construction, the State inspectorate for geodetic, technical supervision and the mode.

3. The property, established posts established in the staff list and the budget for 2017 of the Main state inspectorate for technical supervision of hazardous production facilities, the State inspection in construction, the State inspectorate for geodetic, technical supervision and the mode to transfer to technical supervision Agency.

4. The hired personnel of the Main state inspectorate for technical supervision of hazardous production facilities, the State inspection in construction to transfer to the State inspectorate for geodetic, technical supervision and the mode to technical supervision Agency according to the labor law.

5. To the Ministry of Economy and Infrastructure together with the Ministry of Agriculture, regional development and the environment, the Agency of land relations and inventory, the Main state inspectorate for technical supervision of hazardous production facilities, the State inspectorate in construction, the State inspectorate for geodetic, technical supervision and the mode:

1) till 5 working days from the date of publication of this resolution to create the commission on reorganization of the specified divisions and to provide the organization and carrying out the first commission session;

2) till 2 months and 7 days from the date of publication of this resolution:

a) provide by means of the commission on reorganization consolidation (merge) according to the procedure, established by the legislation, the Main state inspectorate for technical supervision of hazardous production facilities, the State inspection in construction,

The state inspectorate for geodetic, technical supervision and the mode and transfer of their property to the Agency on technical supervision according to requirements of the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901 of December 31, 2015 (The official monitor of the Republic of Moldova, 2016, No. 1, the Art. 2), with subsequent changes and amendments;

b) provide creation of internal structure of the Agency on technical supervision which includes:

council on resolution of disputes according to part provisions (5) article 30 of the Law No. 131 of June 8, 2012 on the state control of business activity;

the divisions responsible for labor safety, fire safety and civil protection, supervision of the market in the field of construction materials and dangerous production objects / the equipment, the division responsible for the analysis and risks assessment, and also control planning;

c) submit to the Government for approval:

regulations on the organization and functioning of the Agency on technical supervision, and also changes in other regulations regulating activities of the Main state inspectorate for technical supervision of hazardous production facilities, the State inspection in construction, the State inspectorate for geodetic, technical supervision and the mode;

structure and extreme number of the Agency on technical supervision.

6. To the head of the Agency on technical supervision within 10 working days after approval of its structure and extreme number to approve the staff list.

7. To heads of the Main state inspectorate for technical supervision of hazardous production facilities, the State inspection in construction, the State inspectorate for geodetic, technical supervision and the mode till 5 working days from the date of publication of this resolution to initiate the procedure of the notification of personnel of divisions on reorganization of bodies and if necessary, its transfer to the Agency on technical supervision according to provisions of the labor law.

To perform release of the workers refusing transfer to the Agency on technical supervision according to the labor law.

8. To perform expenses on accomplishment of this resolution for the account and within the budgetary appropriations approved in the government budget for 2017.

9. To the agency of the state services to make necessary changes to cadastral documentation on the owner's request according to provisions of this resolution.

10. In appendix No. 3 to the Order of the Government No. 690 of November 13, 2009. "About approval of the Provision 06 organizations and functioning of the Ministry of Economics, structure and extreme number of its central office" (2009, Art. No. 166-168, 768), with subsequent changes and amendments, line item "The main state inspectorate for technical supervision of hazardous production facilities" to replace the official monitor of the Republic of Moldova with line item "Technical supervision agency".

11. The Section I of appendix No. 3 to the Order of the Government No. 662 of November 10, 2009. "About approval of the Provision, structure and extreme number of the Ministry of Regional Development and Construction" (2009, Art. No. 163-164, 730), with subsequent changes and amendments, to declare the official monitor of the Republic of Moldova invalid.
