This Federal Law establishes the bases and procedure for appointment and implementation of monthly payment in connection with the birth (adoption) of the first child.

Article 1

1. Determine that in connection with the birth (adoption) of the first child the citizens of the Russian Federation who are constantly living in the territory of the Russian Federation have the right to monthly payment.

2. The right to monthly payment in connection with the birth (adoption) of the first child arises if the child is given birth (is adopted) during the period from January 1, 2018 to January 1, 2023, is citizen of the Russian Federation and if the size of the average per capita income of family does not exceed the 2-fold size of subsistence minimum of able-bodied population established in the subject of the Russian Federation according to Item 3 of article 4 of the Federal Law of October 24, 1997 No. 134-FZ "About subsistence minimum in the Russian Federation".

3. Monthly payment in connection with the birth (adoption) of the first child is performed to the woman who gave rise (adopted) the first child, to either the father (adoptive father) or the child's guardian in case of the death of the woman, the father (adoptive father), the announcement their dead of deprivation of their parent rights or their restriction in the parent rights or in case of cancellation of adoption of the child.

4. Monthly payment in connection with the birth (adoption) of the first child is appointed by territorial authority of Fund of pension and social insurance of the Russian Federation.

5. Monthly payment in connection with the birth (adoption) of the first child is performed in the amount of subsistence minimum for children, No. 134-FZ established in the subject of the Russian Federation according to Item 3 of article 4 of the Federal Law of October 24, 1997 "About subsistence minimum in the Russian Federation".

5.1. If in the subject of the Russian Federation according to article 4 of the Federal Law of October 24, 1997 No. 134-FZ "About subsistence minimum in the Russian Federation" the size of subsistence minimum on the main social and demographic national groups is established differentially taking into account social and economic features and climatic conditions of the areas located in such subject of the Russian Federation in case of determination of the right to monthly payment in connection with the birth (adoption) of the first child and the amount of this payment the size of subsistence minimum of able-bodied population and size of subsistence minimum for children established at the place of residence (stay) or actual accommodation of the citizen specified in the statement for purpose of monthly payment in connection with the birth (adoption) of the first child are used.

5.2. Monthly payment in connection with the birth (adoption) of the first child is subject to recalculation in procedure without application since month of change of the size of subsistence minimum for children established in the subject of the Russian Federation. Provision of monthly payment in connection with the birth (adoption) of the first child after recalculation is performed also in procedure without application.

6. Procedure of monthly payment in connection with the birth (adoption) of the first child, the procedure for the request for purpose of the specified payment, and also the list of documents (copies of the documents, data) necessary for its appointment, and the standard application form about purpose of monthly payment in connection with the birth (adoption) of the first child are established by the federal executive body performing functions on development and realization of state policy and normative legal regulation in the sphere of work and social protection of the population.

7. For the purpose of uniform application of this Federal Law explanations according to the procedure, determined by the Government of the Russian Federation can be published.

Article 2

1. The citizen has the right to submit the application for purpose of monthly payment in connection with the birth (adoption) of the first child at any time within three years since the birth of the child.

2. Monthly payment in connection with the birth (adoption) of the first child is performed since the birth of the child if the request for its appointment followed no later than six months since the birth of the child. In other cases the specified payment is performed since month of the request for its appointment.

3. Monthly payment in connection with the birth (adoption) of the first child is appointed for a period of up to achievement of one year by the child of age. After this term the citizen submits the new application for purpose of the specified payment at first for a period of up to achievement of two years by the child of age, and then for a period of up to achievement of age of three years by it and submits documents (the copy of documents, the data) necessary for its appointment.

4. The territorial authority of Fund of pension and social insurance of the Russian Federation a month before the termination of term to which monthly payment in connection with the birth (adoption) of the first child was appointed directs with use of the federal state information system "Single Portal of the State and Municipal Services (Functions)" the notification on need of filing of application on purpose of the specified payment to the new period.

5. The application for purpose of monthly payment in connection with the birth (adoption) of the first child is submitted by the citizen at the place of residence (stay) or in case of lack of the confirmed residence (stay) - in the place of the actual accommodation at territorial authority of Fund of pension and social insurance of the Russian Federation is direct or with use of the federal state information system "Single Portal of the State and Municipal Services (Functions)" or through the multipurpose center of provision of the state and municipal services.

6. The application for purpose of monthly payment in connection with the birth (adoption) of the first child can be submitted by the citizen in the last month of the period to which the specified payment is appointed. In this case the specified payment is appointed since the month following after month of submission of this statement.
