In pursuance of resolutions of the President of the Republic of Uzbekistan of June 21, 2017 No. PP-3077 "About measures for further support of the domestic export organizations and enhancement of foreign economic activity", of November 3, 2017 "About measures for further liberalization of foreign trade activity and support of subjects of entrepreneurship" and of November 6, 2017 No. PP-3377 "About additional measures for support of domestic exporters of fruit and vegetable products, grapes, melon cultures, bean, and also dried vegetables and fruit" the Cabinet of Ministers decides No. PP-3351:

1. Approve Regulations on export procedure of the fresh, dried and processed fruit and vegetable products according to appendix No. 1.

2. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 2.

3. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 3.

4. To the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

5. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzagrotekhsanoatholding N. S. Otazhonov.

Regulations on export procedure of the fresh, dried and processed fruit and vegetable products

Chapter 1. General provisions

1. This Provision according to resolutions of the President of the Republic of Uzbekistan of September 19, 2016 No. PP-2603 "About additional measures for stimulation of export of fruit and vegetable products, grapes and melon cultures", of June 21, 2017 No. PP-3077 "About measures for further support of the domestic export organizations and enhancement of foreign economic activity" and of November 6, 2017 No. PP-3377 "About additional measures for support of domestic exporters of fruit and vegetable products, grapes, melon cultures, bean, and also dried vegetables and fruit" determines procedure of export of the fresh, dried and processed fruit and vegetable products.

2. In this Provision the following basic concepts are applied:

fruit and vegetable products - vegetables, fruits, bean, grapes and melon cultures, dried vegetables and fruit (the Commodity Nomenclature of Foreign Economic Activity code 07, 08, 1202);

fresh fruit and vegetable products - vegetables, fruits, bean, grapes and melon cultures according to the list according to appendix No. 1 to this Provision;

the dried and processed fruit and vegetable products - the vegetables, fruits, grapes and melon cultures which are not included in the list of fresh fruit and vegetable products according to appendix No. 1 to this Provision;

exporters are subjects of entrepreneurship - the residents of the Republic of Uzbekistan which signed export contracts (agreements) with nonresidents of the Republic of Uzbekistan or exporting without export contract (agreement) based on invoice;

invoice - the invoice for export of fruit and vegetable products;

the export contract - the economic agreement signed between the exporter and the nonresident of the Republic of Uzbekistan for export of fruit and vegetable products.

Chapter 2. Export of fruit and vegetable products

3. Export of fresh fruit and vegetable products is performed under direct agreements when obtaining by exporters in foreign currency of 100 percent advance payment from the cost of the shipped products.

Under this JSC Uzagroeksport it is allowed to perform export of fresh fruit and vegetable products with the following provisions:

at least 30 percent of advance payment from the cost of the shipped fruit and vegetable products, and on the rest open the confirmed bank letter of credit or the guarantee of the first-class foreign bank is drawn up;

without advance payment, opening of the confirmed bank letter of credit or registration of guarantee of the first-class foreign bank - to the trading houses of JSC Uzagroeksport, and also the leading foreign import organizations which are reliable and long-term partners opened abroad for the list approved by the decision of the Cabinet of Ministers of the Republic of Uzbekistan.

Exporters can deliver fresh fruit and vegetable products on the foreign markets under the terms, specified in paragraphs three and the fourth this Item, on the basis of the commission agreement signed with JSC Uzagroeksport.

4. Export of the dried and processed fruit and vegetable products can be performed by exporters, including JSC Uzagroeksport, for foreign currency without advance payment, opening of the letter of credit, registration of guarantee of bank and availability of the policy on insurance of the export contract upon policy and commercial risks.
