RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

of December 22, 2017 No. 1010

About additional measures for enhancement of procedure for carrying out obligatory technical inspection of vehicles

(as amended of the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 15.02.2019 No. 136)

For the purpose of ensuring increase in efficiency of carrying out obligatory technical inspection of vehicles the Cabinet of Ministers decides:

1. Take into consideration that according to the resolution of the President of the Republic of Uzbekistan of July 11, 2017 No. PP-3127 "About measures for further enhancement of system of safety control of traffic" provides step-by-step transfer since January 1, 2018 to subjects of entrepreneurship - legal entities of function of divisions of Public service of traffic safety of the Ministry of Internal Affairs of the Republic of Uzbekistan regarding carrying out obligatory technical inspection of passenger vehicles of physical persons (further - passenger vehicles of physical persons), except for cargo, passenger and special vehicles, with establishment of fixed prices for the rendered services and requirements for interaction with law-enforcement bodies.

2. Determine that:

since January 1, 2018 when carrying out obligatory technical inspection of vehicles check of technical condition of passenger vehicles of physical persons can be also performed by subjects of entrepreneurship - legal entities;

since January 1, 2021 carrying out obligatory technical inspection of passenger vehicles of physical persons is performed by subjects of entrepreneurship - legal entities.

3. Make since January 1, 2018 changes and amendments to the resolution of the Cabinet of Ministers of January 31, 2003 No. 54 "About approval of the Regulations on procedure for carrying out obligatory technical inspection of vehicles" (the joint venture of the Republic of Uzbekistan, 2003, No. 1, the Art. 12) according to appendix.

4. To the Ministry of Internal Affairs of the Republic of Uzbekistan:

together with the Ministry of Finance of the Republic of Uzbekistan till January 15, 2018 to review the sizes of rates of the payments levied for carrying out obligatory technical inspection of vehicles, having provided introduction of the differentiated sizes of rates of payments separately for legal entities and physical persons, taking into account class of vehicle;

provide permanent monitoring and the comprehensive analysis of the existing practice and efficiency of carrying out entrepreneurship by subjects - legal entities of checks of technical condition of passenger vehicles of physical persons;

following the results of monitoring and the analysis, and also taking into account transfer to subjects of entrepreneurship - to legal entities of function of divisions of Public service of traffic safety of the Ministry of Internal Affairs of the Republic of Uzbekistan regarding carrying out obligatory technical inspection of passenger vehicles of physical persons, till October 1, 2018 to make offers on further enhancement of procedure for carrying out technical inspection of vehicles;

organize extended coverage in mass media of the purposes and contents of this resolution, including procedure for conducting check of technical condition of passenger vehicles of physical persons;

together with the interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

5. To Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent in coordination with territorial financial bodies to approve the extreme amount of payment for services of subjects of entrepreneurship in a month - legal entities on conducting check of technical condition of passenger vehicles of physical persons.

6. To impose control of execution of this resolution on the Minister of Internal Affairs of the Republic of Uzbekistan P. R. Bobozhonov.

Appendix

to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of December 22, 2017 No. 1010

Changes and additions made to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of January 31, 2003 No. 54 "About approval of the Regulations on procedure for carrying out obligatory technical inspection of vehicles"

1. To exclude from preamble of the word of "Article 13".

2. In appendix:

a) in Item 1 of the word "developed according to article 13 of the Law" shall be replaced with words "according to the Law";

b) add Item 2 with paragraphs the second - the fourth the following content:

"For assessment of conformity of technical condition and the equipment of vehicles by bodies of GSBDD can be attracted on contractual basis, irrespective of organizationally - legal forms, service station of the ministries and departments, other organizations, and also belonging to private owners (further - STO).

Assessment of conformity of technical condition and the equipment of vehicles of category M1, of the technical regulations belonging to physical persons, requirements or standards, rules, regulations of traffic safety can be also carried out by subjects of entrepreneurship - legal entities (further - Subjects).

At the same time physical persons - owners of vehicles of category M1 for assessment of conformity of technical condition and the equipment of the vehicle can address at the choice to bodies of GSBDD, STO or to Subjects";

c) in Item 5:

to exclude the paragraph of the sixth;

add with subitems "d" and "e" of the following content:

"e) in case of their registration (re-registration) in bodies of GSBDD, irrespective of earlier fixed terms of passing of the next technical inspection;

d) after one year from the date of their registration (re-registration) in bodies of GSBDD, irrespective of year of their release (except as specified, specified in the subitem "an" of this Item)";

e) state Item 7 in the following edition:

"7. For carrying out by bodies of GSBDD of technical inspection of vehicles charges in the sizes approved by the Ministry of Internal Affairs in coordination with the Ministry of Finance of the Republic of Uzbekistan are levied.

For carrying out repeated technical inspection of the vehicles recognized defective in case of primary (previous) technical inspection charges in the established sizes are levied.

The amounts of charges for carrying out technical inspection go to the corresponding local budget";

e) state the Section II in the following edition:

"II. The organization and the checklist of technical condition of the vehicles belonging to physical persons

8. Technical condition of vehicles of physical persons can be performed:

GSBDD diagnostic stations;

HUNDRED;

Subjects (the category M1, vehicles used for public conveyance, having except driver's seat no more than eight places for sitting).
