About the address of seeds of agricultural plants within the Eurasian Economic Union

The state members of the Eurasian Economic Union which further are referred to as with state members

based on the Agreement on the Eurasian Economic Union of May 29, 2014,

proceeding from mutual interest of state members in cooperation in the field of seed farming of agricultural plants for the purpose of market development of seeds of agricultural plants and growth in volumes of production of competitive agricultural products of state members,

recognizing feasibility of standardization of requirements in spheres of the address of seeds of agricultural plants, testing of grades and seed farming of agricultural plants within the Eurasian Economic Union (further - the Union),

observing the principles of mutual respect, equality and openness,

agreed as follows.

Article 1

For the purposes of this agreement concepts which mean the following are used:

"the unified register of grades of agricultural plants" - the general information resource containing data on grades of the agricultural plants included in national registers;

"testing of grade" - actions for determination of economic and biological properties of grade, and also signs of distinguishability, uniformity and stability of grade for the purpose of its inclusion in the national register;

"the national register" - the register of the grades of the agricultural plants allowed (permitted, recommended) to use in the territory of state member, created according to the legislation of state member;

"the address of seeds of agricultural plants" - movement of seeds of agricultural plants from the territory of one state member on the territory of other state member (including through the territory of the state which is not the member of the Union), their storage and realization;

"sowing (landing) qualities of seeds of agricultural plants" - set of quality factors of seeds of the agricultural plants characterizing suitability of seeds for crops (landing);

"agricultural plants" - grain, leguminous, groat, feed, industrial, oil-bearing, essential oil-bearing, vegetable, melon, fruit, berry, medicinal crops, and also potatoes and grapes;

"seeds of agricultural plants" - actually seeds of plants, saplings, fruits, parts of aggregate fruits, compound fruits, bulbs, tubers and other generative and vegetative parts of plants intended for reproduction and (or) reproduction of grades of agricultural plants;

"seed farming" - activities for production, movement, storage, realization and use of seeds of agricultural plants;

"grade" - group of agricultural plants within the lowest of botanical taxons which is determined by degree of expressiveness of the signs characterizing this genotype or combination of genotypes differs from other groups of agricultural plants of the same botanical taxon in one or several signs or degree of expressiveness of signs and is stable;

"high-quality qualities of seeds of agricultural plants" - set of the signs characterizing belonging of seeds of agricultural plants to certain grade.

Article 2

This agreement regulates the legal relationship connected with the address within the Union of seeds of agricultural plants, except for seeds of agricultural plants which genetic program of grades contains genetically engineered material.

Article 3

1. The address of seeds of agricultural plants within the Union is performed in the presence of the documents containing data on their high-quality and sowing (landing) qualities and which are drawn up in Russian and state language (state languages) of state member (if it is stipulated by the legislation state member).

If seeds of agricultural plants are processed by chemical or biological medicines, their address within the Union is performed in packed form in the presence in addition to the documents specified in paragraph one of this Item also of information in Russian and state language (state languages) of the state member (if it is stipulated by the legislation state member) about the name of chemical or biological medicine specified in accompanying documents these seeds and on their marking (label).

2. State members recognize the documents containing the data on high-quality and sowing (landing) qualities of seeds of agricultural plants issued by other state members according to the list approved by the Eurasian economic commission (further - the Commission) based on offers of state members.

Article 4

1. For the purpose of information support of the activities connected with the address of seeds of agricultural plants within the Union, the Commission creates the unified register of grades of agricultural plants (further - the unified register).

2. The unified register is created based on data on the grades containing in the national registers and provided by state members in the Commission in electronic form with use of the integrated information system of the Union.

The procedure for forming and maintaining the unified register is determined by the Commission.

Article 5

For the purpose of unification of approaches to carrying out high-quality identification of agricultural plants, state members provide to determination of high-quality and sowing (landing) qualities of seeds of agricultural plants application of the single methods determined by Council of the Commission.

Article 6

State members take the measures directed to standardization of the legislation regulating questions of testing of grades and seed farming. The list died, the state members directed to standardization of the legislation, and terms of such unification are determined by the Supreme Eurasian economic council.

Article 7

Before entry into force of the acts of Council of the Commission adopted according to Article 5 of this agreement in state members methods of carrying out high-quality identification of agricultural plants, the determinations of high-quality and sowing (landing) qualities of seeds of agricultural plants established by the legislation of state members are applied.

Article 8

This agreement is the international treaty signed within the Union and enters the right of the Union.

Article 9

The disputes connected with interpretation and (or) application of this agreement are permitted according to the procedure, the defined Agreement on the Eurasian Economic Union of May 29, 2014.

Article 10

By agreement of state members the changes which are drawn up by separate protocols and being integral part of this agreement can be made to this agreement.
