I ORDER:

1. Approve the Procedure for registration and issue of licenses for the right of import, export of alcohol of ethyl, cognac and fruit, ethyl alcohol of the rectified grape, ethyl alcohol rectified fruit, alcoholic beverages and tobacco products which is applied.

2. Assign functions on registration and issue of licenses for the right of import, export of alcohol ethyl, cognac and fruit, to alcoholic beverages and tobacco products to department of non-tariff regulation of department of regulation of foreign economic activity.

3. To provide to department of non-tariff regulation of department of the external economic policy together with legal support division of foreign economic activity of legal department registration of this order in Ministry of Justice of Ukraine in the time established by the legislation.

4. Declare invalid order МВЭСторга of Ukraine of 17.06.96 No. 342 (with changes and amendments) registered in Ministry of Justice of Ukraine 20.06.96 for No. 319/1344.

5. To impose control of execution of this order on the Deputy State secretary Stetsenko V. O.

Procedure for registration and issue of licenses for the right of import, export of alcohol of ethyl, cognac and fruit, ethyl alcohol of the rectified grape, ethyl alcohol rectified fruit, alcoholic beverages and tobacco products

This Procedure determines the mechanism of consideration and issue of licenses for the right of import, export of alcohol of ethyl, cognac and fruit, ethyl alcohol of the rectified grape, ethyl alcohol rectified fruit, alcoholic beverages and tobacco products in the Ministry of Economic Development and Trade of Ukraine.

1. General provisions

1.1. Licenses for the right of import, export of alcoholic beverages and tobacco products are issued to the subjects of business activity registered in accordance with the established procedure irrespective of pattern of ownership.

1.2. Licenses for the right of import, export of alcohol of ethyl and fruit, ethyl alcohol of the rectified grape, ethyl alcohol of the rectified fruit are issued only to the state companies or the organizations which are specially authorized on it by the Cabinet of Ministers of Ukraine; licenses for the right of import, export of alcohol cognac are issued only to the specialized cognac enterprises which list is approved by the Cabinet of Ministers of Ukraine.

1.3. Licenses for the right of import, export of alcohol of ethyl, cognac and fruit, ethyl alcohol of the rectified grape, ethyl alcohol rectified fruit, alcoholic beverages and tobacco products are issued by the Ministry of Economic Development and Trade of Ukraine.

1.4. The license for the right of import, export of alcohol of ethyl, cognac and fruit, ethyl alcohol of the rectified grape, ethyl alcohol rectified fruit, import of export of alcoholic beverages, import, export of tobacco products is issued separately on each type of foreign economic activity.

2.1. For receipt of the license the following documents are submitted:

the statement for receipt of the license for the right of import, export of alcohol of ethyl, cognac and fruit, ethyl alcohol of the rectified grape, ethyl alcohol rectified fruit, alcoholic beverages and tobacco products in form according to appendix 1;

the copy of the payment order (with original mark of bank about payment) about transfer in the local budget of annual payment for the license.

2.2. Subjects of business activity of Ukraine are responsible for reliability of the documents filed to the Ministry of Economic Development and Trade of Ukraine.

2.3. The statement for receipt of the license and documents for execution of licenses (further - documents) go to the Ministry of Economic Development and Trade of Ukraine the authorized person of the applicant or are sent by the registered mail.

The statement for receipt of the license and documents attached to it are accepted personally by specialists of department of non-tariff regulation in specially certain room at the scheduled time according to the description of documents which are enclosed to the application for receipt of the license according to sample (appendix 2) which copy is issued to the applicant with mark about date of reception of an application and documents and the signature of person which accepted them.

2.4. During documents acceptance their check on completeness and primary registration is performed. On documents the print of special number seal "For registration" with indication of date of documents acceptance and entrance number is put and the corresponding logging of registration is made.
