ORDER OF THE MINISTER OF INVESTMENTS AND DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of medical examination and survey in civil aviation of the Republic of Kazakhstan

(as amended on 07-03-2023)

According to Item 3 of article 54 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" PRIKAZYVAYU:

1. Approve the enclosed Rules of medical examination and survey in civil aviation of the Republic of Kazakhstan.

2. To provide to committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printed publicity materials;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of medical examination and survey in civil aviation of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of medical examination and survey in civil aviation of the Republic of Kazakhstan (further - Rules) are developed according to Item 3 of article 54 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and on the basis of standards and recommended practice of International Civil Aviation Organization (IKAO).

2. These rules determine procedure for medical examination and survey in civil aviation of the Republic of Kazakhstan and establish the requirements for medical examination, medical examination in the field of civil aviation shown to aeronautical personnel and also the categories of persons which are subject to obligatory medical examination and medical examination.

3. These rules extend to service employees of authorized organization in the field of civil aviation, airline (operators) and civil aviation organizations, the health workers participating in medical examination and survey, aeronautical personnel, and also categories of persons which are subject to obligatory medical examination and medical examination.

4. Citizens of the Republic of Kazakhstan and foreign citizens who arrive in aviation educational institutions undergo medical examination according to these rules.

5. In these rules the following terms and determinations are used:

1) the flight surgeon – the medical specialist having the higher medical education and preparation in the field of aviation medicine, providing professional health of persons on whom the aviation safety, and also health of air passengers depends in case of their address;

2) aviation medicine – the field of medicine devoted to studying of questions of medical support of aviation flights;

3) the aviation medical inspector – the aviation inspector of authorized organization in the field of civil aviation having qualification and work experience in the field of aviation medicine and the representative on implementation of certification, control and supervision in the field of civil and experimental aviation;

4) the aviation medical center (further – AMTs) – the legal entity performing medical examination in the field of civil aviation;

5) the aviation medical expert (further – the expert) – the doctor having the certificate of the aviation medical expert which had training and having practical skills and the working life in the field of aviation medicine appointed by authorized organization in the field of civil aviation for carrying out medical surveys of the faces which are directly tied with accomplishment and flight servicing of air vehicles and their maintenance, air traffic maintenance to receipt of certificates or qualification marks;

6) aeronautical personnel – the physical persons having special and (or) professional training, performing activities for accomplishment and flight servicing of air vehicles, airborne transportations and aerial works, maintenance of air vehicles, the organization and air traffic maintenance, air traffic control;

7) the certificate of aeronautical personnel – the document confirming qualification and powers of aeronautical personnel;

8) authorized body in the field of civil aviation (further – authorized body) – the central actuator performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

9) authorized organization in the field of civil aviation (further – authorized organization) – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, aviation safety and aviation safety;

10) extralight aircraft (further – SLA) – the civil aviation using air vehicles with the maximum certified take-off mass less than seven hundred fifty kilograms, other flight vehicles and auxiliary devices;

11) the profile specialist – the health worker with the higher medical education having the certificate in the field of health care;

12) easy aircraft (further – LA) – the civil aviation using air vehicles with the maximum certified take-off mass less than five thousand seven hundred kilograms including helicopters with the maximum certified take-off mass less than three thousand hundred eighty kilograms;

13) expanded medical examination – medical examination which is carried out by the expert with execution of the general report, reports of the ophthalmologist, LOR and recommendations of other specialists;

14) the consulting physician – the flight surgeon who is taking out medical recommendations about the specialty according to health of physical person / applicant;

15) medical examination - inspection of physical person for the purpose of establishment or confirmation of the fact of availability or absence at it of disease, determination of the state of health, and also temporary disability, professional and other suitability;

16) medical examination – establishment or confirmation of availability or absence at aeronautical personnel of disease, determination of the state of health, and also temporary disability, professional suitability to work in the taken-up change;

17) the medical certificate – the document of the established sample issued by positive results of medical examination, confirming the applicant's compliance to requirements imposed to the validity for health reasons and the providing admission to professional activity;

18) the owner of the medical certificate – the physical person having the existing medical certificate;

19) the applicant – the physical person who submitted the application for obtaining or prolongation of the medical certificate;

20) the external pilot – physical person which performs necessary actions on flight execution of the unmanned aerial vehicle and which manipulates relevant organs of flight control during flight time.

Chapter 2. Procedure for performing medical examination

6. The applicant on obtaining, prolongation, renewal of the medical certificate, signs and represents to the expert the application according to appendix 1 to these rules (further – the statement) in which specifies whether it underwent earlier medical examination, reports date, the place and results of the last medical examination.

The applicant inform the expert on whether took place failures in issue, cancellations, suspensions of action of the medical certificate, about the reasons of such refusal, the personal, family and heritable anamnesis earlier.

When passing medical examination the applicant on passing of medical examination gives the expert information on availability at it of the diseases known to it and the flights constituting danger to accomplishment.

7. Medical examination is carried out by the expert. In the presence of the disease providing regular medical examinations, the expert appoints additional surveys and recommendations for ensuring proper monitoring.

8. Tasks of medical examination are:

1) validity determination for health reasons to work and/or training in the field of civil aviation;

2) identification and prevention of early forms of diseases, risk factors and functional variations in the state of health.

9. The following categories of persons are subject to medical examination:

1) the persons arriving for study and studying for the pilot;

2) pilots of commercial aviation (the airplane, the airship, the helicopter and the air vehicle with system of increase in lifting force);

3) pilots of polynomial crew;

4) linear pilots of airline (the airplane, the helicopter and the air vehicle with system of increase in lifting force);

5) navigators;

6) flight engineers;

7) aircraft mechanics;

8) flight radio operators;

9) operators;

10) private pilots (the airplane, the airship, the helicopter and the air vehicle with system of increase in lifting force);

11) pilots are glider pilots;

12) pilots of free aerostat;

13) flight attendants;

14) the air traffic controllers and persons arriving for study and studying for the air traffic controller;

15) external pilots;

16) pilots of LA and SLA.

10. The medical certificate is issued to persons listed in subitems 1), 2), 3), 4), 5), 6), 7), 8), 9), 10), 11), 12), 14) and 15) of Item 9 of these rules in form, according to appendix 2 to these rules.

The medical certificate and 16) of Item 9 of these rules is issued to persons listed in subitems 13) in form, according to appendix 3 to these rules.

11. Medical examination is carried out:

1) for initial receipt of the medical certificate;

2) for prolongation of the medical certificate;

3) for renewal of the medical certificate (after suspension).

12. Types of medical certificates:

1) to persons belonging to subitems 1), 2), 3) and 4) of Item 9 of these rules "The medical certificate of 1 class" is issued;

2) to persons belonging to subitems 5), 6), 7), 8), 9), 10), 11), 12) and 13) of Item 9 of these rules the medical certificate 2 classes" is issued ";

3) to persons belonging to subitems 14) and 15) of Item 9 of these rules the medical certificate 3 classes" is issued ";

4) to persons belonging to the subitem 16) of Item 9 of these rules "The medical certificate LA and SLA" is issued.

13. For receipt of the medical certificate the following documents are filed:

1) statement;

2) data on dynamic (dispensary) observation of the patient according to the loose leaf 5 to the medical record of the ambulatory patient provided by form of the medical accounting documentation used in the out-patient and polyclinic organizations, approved by the order of the acting minister of health care of the Republic of Kazakhstan of October 30, 2020 No. KR DSM-175/2020 "About approval of forms of accounting documentation in the field of health care" (it is registered in the State register of regulatory legal acts of the Republic of Kazakhstan at No. 21579);

3) the certificate of passing of psychiatric, narcological surveys (in case of initial medical examination);

4) the military ID or the assigned certificate represented by persons liable for call-up and recruits, except for persons which are not subject to military accounting;

5) the copy of the certificate on disease to the applicants dismissed for health reasons from state bodies (The Ministry of Defence of the Republic of Kazakhstan, Air service of Committee of homeland security of the Republic of Kazakhstan, National guard of the Republic of Kazakhstan) according to appendix 6 to Rules of conducting military-medical examination in the Armed Forces of the Republic of Kazakhstan approved by the order of the Minister of Defence of the Republic of Kazakhstan of December 21, 2020 No. 716 "About approval of Rules of conducting military-medical examination and Regulations on the commissions of military-medical examination in Armed Forces of the Republic of Kazakhstan" (it is registered in the State register of regulatory legal acts of the Republic of Kazakhstan at No. 21869).

14. For prolongation and renewal of action of the medical certificate the following documents are filed:

1) statement;

2) previous medical certificate;

3) report of the previous medical examination.

15. Issue of the medical certificate 1, of 2, 3 class and class of LISLA is performed in AMTs.

Performing medical examination in AMTs is performed based on its certificate and certificates of the expert.

16. Prolongation and renewal of action of medical certificates is performed:

1) for the medical certificate 1, 2 and 3 classes experts of AMTs;

2) for the medical certificate of class of LISLA experts of AMTs or experts of the medical organizations.

17. The expert before medical examination checks the statement for performing medical examination and signs it together with the applicant.

After signing of the statement the expert checks reliability of the facts in the statement by means of information systems of the Ministry of Health of the Republic of Kazakhstan.

18. In case of identification of the doubtful facts in the signed statement specifying concealment of the diseases known to the applicant and constituting danger to accomplishment of flights, the expert sends the original of the statement with the transmittal letter to authorized organization for transfer of materials to authorized body for acceptance of administrative measures.

19. In one day prior to - and during medical examination the day off is provided to the applicant.

20.  No. 958 is excluded according to the Order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of 29.12.2018

21. The applicant depending on class of the received medical certificate undergoes medical examination on compliance of his health to the following requirements (further – Requirements):

to requirements for medical examination to the state of health imposed to the applicant on receipt of the medical certificate of 1 class according to appendix 4 to these rules;

to requirements for medical examination to the state of health imposed to the applicant on receipt of the medical certificate of class 2 according to appendix 5 to these rules;

to requirements for medical examination to the state of health imposed to the applicant on receipt of the medical certificate of class 3 according to appendix 6 to these rules;

to requirements for medical examination to the state of health imposed to the applicant on receipt of the medical certificate LA and SLA according to appendix 7 to these rules.

22. In case of medical examination the expert in indications determines amount of physical examination in case of medical examination according to appendix 8 to these rules and appoints survey of consulting physicians.

The psychological techniques applied for the purpose of professional psychological selection of the candidate for training in specialties of civil aviation to receipt of the medical certificate and the owner of the medical certificate are carried out according to appendix 8-1 to these rules.

23. Consulting physicians write down data of physical examination, the diagnosis in medical documentation, certify recommendations about the profile the signature and personal seal and fill in the report on form, according to appendices 9, the report of surgical survey on form according to appendix 10, the report on ophthalmologic survey on form according to appendix 11 and the report on otorinolaringologichesky inspection on form according to appendix 12 to the presents.

The profile specialists involved to medical examination this physical examination, the diagnosis, recommendations about the profile, assure the signature and personal seal.

Reports of consulting physicians and profile specialists are stored within 10 years.

24. The expert writes down in medical documentation data of physical examination, the diagnosis, recommendations of profile specialists, consulting physicians and fills in the report on medical examination (further – the Report) in form according to appendix 13 to these rules. Accuracy of the data of physical examination is certified by the signature and personal seal of the expert.

Reports of the expert are stored within 10 years.

Coding of diagnoses is carried out according to MKB-11.

In case of report layout corrections are prohibited.

The original of the report is stored in archive of the expert, the copy of the report (certified by the expert's seal) is provided to the applicant. The electronic copy of the report is provided in authorized organization within 3 working days from the date of issue of the certificate for evaluating. The medical certificate is issued to the applicant in day of report layout and pronouncement of the medical certificate.

The aviation medical inspector of authorized organization carries out assessment of the report of medical examination on compliance to requirements, 6 and 7 these rules provided in appendices 4, of 5,.

25. By results of medical examination the medical certificate in the following formulations is taken out:

1) it is suitable for work;

2) it is suitable for work with restrictions, according to Item 26 of these rules;

3) needs treatment (improvement) with the subsequent medical examination;

4) it is unusable to work.

26. The expert sets restriction in the medical certificate.

When the decision on the validity is possible only in case of restriction establishment, the expert estimates the state of health of the applicant and if necessary consults with flight operation specialists, air traffic control specialists or other specialists. In case of determination of restriction the capabilities, skills and experience of the applicant relating to the activities which are carried out by it aircraft type, types and nature performed flights and works are evaluated.

In case of incomplete compliance of the applicant to requirements of 6 and 7 these rules provided in appendices 4, of 5, provided that this condition does not threaten aviation safety, it is established restriction codes according to appendix 14 to these rules.

In the presence of four and more diseases and syndromes, and also the risk factors which are mutually burdening each other and threatening aviation safety the decision on worthlessness to work on set of diagnoses is passed.

At the same time such risk factors as age, sex, addictions are considered.

27. Owners of medical certificates not zamedlitelno notify the expert from the moment of emergence of the factors reducing the validity of their health such as:

1) carrying out surgery or invasive procedure;

2) purpose of regular acceptance of any medicine;

3) receipt of considerable damage which involves inability to carry out professional obligations of the appropriate certificate of aeronautical personnel (further - the certificate);

4) disease which involves inability to carry out professional obligations of the appropriate certificate;

5) pregnancy and childbirth;

6) hospitalization;

7) for the first time purpose of the adjusting lenses.

28. Owners of certificates do not carry out professional privileges and obligations according to the certificates, qualification marks or certificates if:

1) they are informed on any decrease in their medical validity which can entail impossibility of safe implementation of these rights and obligations;

They accept 2) or use any ordered or not ordered medicines which can interfere with safe implementation of the rights and obligations of the appropriate certificate;

3) receive any medical, surgical or other treatment which can pose safety hazard of flights.

Owners of the medical certificate address the expert in case of any disease and/or exhaustion, in case of any doubts concerning the state of health, in case of any cases connected with health and/or health which can affect capability safely to carry out its obligations.

At the same time the owner of the medical certificate and the employer are responsible for failure to meet requirements of Item 27 and this Item.

29. In case of identification at the applicant of the diseases interfering further work (training) according to Requirements, the expert takes out the medical certificate about worthlessness.

In case of disagreement with the expert opinion the applicant within 5 working days addresses to authorized organization. In case of disagreement with the decision of authorized organization it appeals it judicially.

30. Persons recognized unusable to further work (training) go to the medical organizations for the place of attachment for further treatment.

31. The statement from the Register of medical certificates in form according to appendix of 15 these rules is issued to the applicant recognized unusable to work (training) (further - the Magazine).

32. Effective period of the medical certificate begins with expiry date of the previous medical certificate.

The owner of the medical certificate undergoes medical examination for renewal of action of the medical certificate in day, convenient for it, but no more than in 45 calendar days prior to expiration of the existing medical certificate.

Effective periods of medical certificates:

1) the medical certificate of 1 class of persons belonging to subitems 1), 2), 3) and 4) of Item 9 of these rules is valid within 12 months from the date of its initial receipt or the termination of effective period of the previous medical certificate;

2) the medical certificate 2 classes of persons belonging to subitems 5), 6) and 7) of Item 9 of these rules is valid within 12 months from the date of its initial receipt or the termination of effective period of the previous medical certificate;

3) the medical certificate 2 classes of persons belonging to subitems 8), 9), 10), 11) and 12) of Item 9 of these rules is valid within 60 months from the date of its initial receipt or the termination of effective period of the previous medical certificate and before achievement of age of 40 years; at the age of 40-49 years the medical certificate is valid within 24 months from the date of its initial receipt or the termination of effective period of the previous medical certificate; after achievement of age of 50 years the medical certificate is valid within 12 months from the date of its initial receipt or the termination of effective period of the previous medical certificate;

4) the medical certificate 2 classes of persons belonging to the subitem 13) of Item 9 of these rules is valid within 60 months from the date of its initial receipt or the termination of effective period of the previous medical certificate;

5) the medical certificate 3 classes of persons belonging to subitems 14) and 15) of Item 9 of these rules is valid within 24 months from the date of its initial receipt or the termination of effective period of the previous medical certificate and before achievement of age of 50 years; after achievement of age of 50 years the medical certificate is valid within 12 months from the date of its initial receipt or the termination of effective period of the previous medical certificate;

6) the medical certificate LA and SLA of persons belonging to the subitem 16) of Item 9 of these rules is valid within 60 months from the date of its initial receipt or the termination of effective period of the previous medical certificate and before achievement of age of 40 years; at the age of 40-49 years the medical certificate is valid within 24 months from the date of its initial receipt or the termination of effective period of the previous medical certificate; after achievement of age of 50 years the medical certificate is valid within 12 months from the date of its initial receipt or the termination of effective period of the previous medical certificate.

33. Results of medical researches, consultations of consulting physicians, reports of medical surveys and all records are kept in the personal record of the applicant in the expert's office.

34. The owner of the certificate of aeronautical personnel is not allowed to accomplishment of service duties without medical certificate and with the expired effective period of the medical certificate.

Delay by the expert of AMTs or the expert of the medical organizations (for the medical certificate of class LA and SLA) the next medical examination of the owner of the certificate who carries out flights in the region or outside the Republic of Kazakhstan, remote from the venue of medical examination is allowed provided that such delay will be granted only as exception, and will not exceed:

1) one period lasting 6 months for the member of flight crew of the air vehicle which is occupied with non-commercial transportations or accomplishment of aerial works;

2) two consecutive periods lasting 3 months everyone for the member of flight crew of the air vehicle which is occupied with commercial transportations provided that in each case the corresponding person receives the positive medical certificate after survey at the expert of this region or, in the absence of such expert at the doctor (in the presence of the certificate of the specialist) having permission (on medical examination) to be engaged in medical practice in this region. The conclusion about medical examination is sent to authorized organization, granted this certificate;

3) one period lasting no more than 24 months if medical examination is performed by the expert appointed by authorized organization in the territory of whom temporarily there is applicant. The conclusion about medical examination is sent to authorized organization, granted this certificate; the report on medical examination of the expert who is outside the Republic of Kazakhstan is sent to civil aviation organization and the expert who issued the medical certificate.

In case of emergency situations and act of gods (natural disasters, act of war) the expert extends the validity of the medical certificate on effective period of emergency situations and act of gods (natural disasters, act of war) or for the term determined by authorized organization with possibility of the subsequent prolongation for the term of no more than 45 calendar days.

35. Action of the medical certificate of 1 class extends to medical certificates 2, 3 classes and LA and SLA.

36. Effective periods of medical certificates are reduced to 6 months:

1) in case of achievement of age of 60 years for owners of the certificate of the linear pilot of airline (the airplane, the helicopter, the air vehicle with system of increase in lifting force), certificates of the pilot of commercial aviation (the airplane, the helicopter, the airship, the air vehicle with system of increase in lifting force) and the certificates of the pilot of polynomial crew (airplane) which are carrying out commercial air transportations;

2) in case of achievement of age of 40 years for owners of certificates of the linear pilot of airline (the airplane, the helicopter, the air vehicle with system of increase in lifting force) and certificates of the pilot of commercial aviation (the airplane, the helicopter, the airship), carrying out the commercial flights on public conveyance managed by one pilot.

37. Effective period of the medical certificate is reduced on medical indications with indication of specific terms and reasons for change of effective period which is reflected in the Magazine and the report of the expert.

38. The medical certificate is signed by the expert and certified it by seal.

39. The expert does not disclose results of the carried-out medical surveys and other data which became known to him in connection with accomplishment of service duties, except cases, stipulated by the legislation.

40. In case of receipt of information menacing to aviation safety, the expert informs authorized organization and administration of civil aviation organization (in the presence) within a day after its obtaining.

41. The expert of 1 class performs issue, prolongation and renewal of the medical certificate of all classes.

42. The expert 2 classes performs issue, prolongation and renewal of the medical certificate 2, 3 classes and LA and SLA.

43. The expert of class LA and SLA performs prolongation, renewal of the medical certificate of class LA and SLA.

44.  No. 958 is excluded according to the Order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of 29.12.2018
