ORDER OF THE MINISTER OF INVESTMENTS AND DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of delivery of health care to passengers in civil aviation

(as amended on 07-03-2023)

According to subitem 41-71) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" PRIKAZYVAYU:

1. Approve the enclosed Rules of delivery of health care to passengers in civil aviation.

2. To provide to committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printed publicity materials;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of delivery of health care to passengers in civil aviation

Chapter 1. General provisions

1. These rules of delivery of health care to passengers in civil aviation (further - Rules) are developed according to subitem 41-71) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) and determine procedure for delivery of health care to passengers during their stay onboard the air vehicle and on airport site.

2. In case of accomplishment of the international flights these rules are applied in the part which is not contradicting the international treaties ratified by the Republic of Kazakhstan, and also to the legislation of the country in the territory from the territory or through the territory of which such flights are performed.

3. The first and pre-medical medical care onboard the air vehicle appear to passengers and aircraft crew.

5. In case of delivery of health care, including to foreign air passengers, use of medicines and medical products expired, use of medical products, not passed checking and registration in the procedure for the Republic of Kazakhstan, and also medicines and medical products established by the legislation which are available for the patient, except as specified, is not allowed if they are appointed the health worker.

When using the medicines and medical products which are available for the patient and appointed by the doctor entry in Blanca of delivery of health care onboard the air vehicle in form, according to appendix 7 to these rules is made (further - the Form of delivery of health care onboard the air vehicle).

6. In these rules the following concepts and terms are used:

1) airline – the legal entity having the air operator certificate of civil air vehicles;

2) civil aviation organization – the legal entity performing activities in the field of civil aviation;

3) first aid is complex of urgent basic actions for rescuing of human life, the prevention of complications in case of the emergency conditions, and also for the purpose of decrease in threat for health and the life of injured person in case of medical emergency which are carried out on site incidents by the victim (self-help) or other person which is nearby (mutual assistance) before arrival of health workers.

First aid can be persons without medical education including who had the corresponding training, according to the procedure, determined by authorized body;

4) set of first aid of "first aid kit" (further – set of first aid) – the set of medical products intended for first-aid treatment onboard the air vehicle;

5) the airport – the complex of constructions intended for acceptance and sending air vehicles, servicing of airborne transportations and having airfield, air terminal, other necessary constructions and the equipment for these purposes;

6) the air vehicle – the device supported in the atmosphere due to its interaction with air excepting interaction with the air reflected from earth's (water) surface;

7) aircraft flight – movement of the air vehicle on earth's (water) surface and in airspace from start of take-off run in case of take-off (separation from terrestrial or surface of the water in case of vertical take-off) before the end of run (release of landing strip without stopping) or contacts of earth's (water) surface in case of vertical landing;

8) aircraft crew – faces of aeronautical personnel to which according to the procedure, established by authorized body in the field of civil aviation or authorized body in the field of the state aircraft, execution of certain obligations on management and servicing of the air vehicle on accomplishment of flights is entrusted;

9) universal preventive set of "universal precaution kit" (further – universal preventive set) – the set of medical products onboard the air vehicle intended for the organization and holding primary actions in case of identification of sick (corpse), suspicious on diseases of infectious diseases, quarantine infections, contagious viral hemorrhagic fevers, malaria and infectious diseases of not clear etiology;

10) the flight attendant – person belonging to aeronautical personnel who for the benefit of safety and for the purpose of servicing of passengers and (or) carriage of goods carries out obligations onboard the air vehicle charged to it by the operator or the aircraft commander, but not being member of flight crew;

11) medical kit – set of medicines and medical products intended for rendering the first and pre-medical medical care, and also for prevention of spread of infectious diseases;

12) pre-medical medical care – the medical care provided by average health workers independently or as a part of multidisciplinary team, including promotion of health, assessment of condition of the patient, statement of the pre-medical diagnosis, purpose of the plan of pre-medical interventions, execution of pre-medical manipulations and procedures and patient care, persons with disability and the dying people;

13) medicine – the means representing or containing the substance or combination of substances coming into contact with human body, intended for treatment, prevention of diseases of the person or recovery, correction or change of its physiological functions by means of pharmacological, immunological or metabolic impact or for diagnosis of diseases and condition of the person;

14) decontamination – the procedure, for elimination of the infectious or toxic agent on the surface of body of the person or animal, in product or on the product prepared for consumption or on other objects, including ferrycrafts which represents risk for health of passengers;

15) the passenger – the physical person which is not part of crew and transported on the air vehicle according to the air transport agreement or on other legal causes;

16) passenger cab – part of the air vehicle, equipped with passenger seats and intended for accommodation of passengers;

17) infectious and parasitic diseases - diseases of the person which emergence and distribution is caused by impact on it biological environmental factors of dwelling and possibility of transfer of disease from the sick person, animal to the healthy person;

18) the member of cabin crew – person belonging to aeronautical personnel who for the benefit of safety and for the purpose of servicing of passengers and (or) carriage of goods carries out the obligations onboard the air vehicle charged to it by the operator or the aircraft commander, but not being the member of flight crew;

19) emergency medical service – the medical care provided in case of sudden sharp diseases and conditions, exacerbation of the chronic diseases which are not posing explicit threat of life of the patient;

20) set of medical means of "medical kit" (further – set of medical means) – the set of medicines and medical products intended for rendering pre-medical medical care onboard the air vehicle;

21) medical aid station – structural division of civil aviation organization, providing medical care according to these rules and the current legislation of the Republic of Kazakhstan;

22) the operator – the physical person or legal entity which is engaged in operation of civil air vehicles or offering the services in this area

23) task for flight – the document of the established form containing the necessary information about crew, the air vehicle, determining route and objective of the flight (flights);

24) safety of flight – the package of measures, the flights providing safe carrying out in case of which the risk of damnification of life or to human health or drawings damage to property is reduced to acceptable level and is supported at this or more low level by means of continuous process of identification of sources of danger and control of risk factors;

25) the member of flight crew - the person belonging to aeronautical personnel, having the existing certificate of aeronautical personnel to whom the obligations connected with control of the air vehicle during airborne time are assigned;

26) the international flight – aircraft flight in case of which the air vehicle crosses border of foreign state;

27) the emergency medical care – the medical care provided in case of sudden sharp diseases and conditions, exacerbation of the chronic diseases requiring immediate medical intervention for prevention of essential harm to health and (or) elimination of threat of life.

Chapter 2. Procedure for delivery of health care in medical aid station of the airport and onboard the air vehicle during its parking

7. Medical care to passengers and aircraft crew appears health workers of medical aid station (further - first-aid post) on airport site, and also onboard the air vehicle during its parking.
