About measures of the state support of the subjects of the Kyrgyz Republic injured with the current situation on the Kyrgyz-Kazakhstan frontier

For the purpose of rendering the state support to the subjects of the Kyrgyz Republic injured with the current situation on the Kyrgyz-Kazakhstan frontier according to the omission of goods through frontier during the period since October 10, 2017, to permission of the specified situation, according to article 29 of the Tax Code of the Kyrgyz Republic, articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Recognize the events which took place in 2017 in connection with situation on the Kyrgyz-Kazakhstan frontier as circumstances which could not be provided or prevented or to provide perhaps, but it is impossible to prevent, for the purpose of support of injured subjects of the Kyrgyz Republic concerning tax, customs, social payments and crediting.

2. Approve:

- structure of the Commission on assessment of the extent of the damage caused as a result of delay of goods and products on the Kyrgyz-Kazakhstan frontier (further - the Commission), according to appendix 1;

- Regulations on the Commission according to appendix 2.

3. Commissions:

- till December 1, 2017 to make assessment and to determine the extent of the damage caused to subjects of the Kyrgyz Republic, including carriers of freight;

- before resolving the situation step by step to approve the list of subjects of the Kyrgyz Republic, the injured events which took place on the Kyrgyz-Kazakhstan frontier.

4. To the Ministry of Economics of the Kyrgyz Republic to organize documents acceptance from injured subjects of the Kyrgyz Republic (with provision of the respective rooms, office equipments, establishment of phones for consultation, etc.).

5. The State Tax Service under the Government of the Kyrgyz Republic to grant delay or payment by installments of payment of tax debt as of November 1, 2017 to subjects of the Kyrgyz Republic according to the list approved by the Commission without charge of percent on outstanding amount and penalty fee on the shortage amount.

6. To the Ministry of Economics of the Kyrgyz Republic together with the State Customs Service under the Government of the Kyrgyz Republic to develop and introduce the bill of the Kyrgyz Republic to two weeks "About introduction of amendments to the Law of the Kyrgyz Republic "About customs regulation in the Kyrgyz Republic" of December 31, 2014 No. 184", providing:

- provision of delay and/or payment by installments of payment of tax debt to subjects of entrepreneurship to which the damage as a result of force majeure circumstances, without collection of payment of customs payments and percent for provision of delay and/or payment by installments for a period of up to six months is caused;

- provision to subjects of the Kyrgyz Republic of delay and/or payment by installments of payment of the amounts of tax debt as of January 1, 2018 which causes damage as a result of force majeure circumstances (without provision of the bank guarantee, pledge and the guarantee), without charge of percent for provision of delay and/or payment by installments;

- provision of delay and/or payment by installments to subjects of the Kyrgyz Republic according to the written application for up to 3 years.

7. To grant to social fund of the Kyrgyz Republic delay and/or payment by installments concerning outstanding amounts on insurance premiums and financial sanctions of subjects of the Kyrgyz Republic to which the economic damage is caused during force majeure circumstances, without provision of the bank guarantee, pledge and the guarantee, for the term provided according to the legislation in the sphere of the national social insurance.

8. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 13.12.2023 No. 675

9. Bring in the order of the Government of the Kyrgyz Republic "About the "Financing of Subjects of Entrepreneurship of the Kyrgyz Republic for Improvement of Quality and Safety of Products through Implementation of International Standards of Quality, including System of Management of Safety of the Food Products Based on the Principles of Risk Analysis and Determination of Critical Control Points (HASSP)" Project of October 13, 2017 No. 669 the following change:

- in appendix to the above-stated resolution:

add Chapter 6 with Item 17 of the following content:

"17. In first-priority procedure to allocate borrowing facilities to the subjects of the Kyrgyz Republic injured with the current situation on the Kyrgyz-Kazakhstan frontier in 2017, based on the decision of the Commission.".

10. Recommend:

- To National Bank of the Kyrgyz Republic to carry out target credit auctions for the purpose of minimization of negative consequences from restriction of access control on the Kyrgyz-Kazakhstan frontier for economy of the Kyrgyz Republic;

- to financial credit institutions of the Kyrgyz Republic and the Russian-Kyrgyz Fund of development to make restructuring of credit debt of the injured subjects of the Kyrgyz Republic included in the list approved by the Commission.

11. To impose control of execution of this resolution on department of economy and investments, department of finance and credit policy of Government office of the Kyrgyz Republic.

12. This resolution becomes effective from the date of official publication.
