1. Approve enclosed:

Rules of establishment of aerodrome environs;

Rules of allocation on aerodrome environs of subbands;

Rules of permission of the disagreements arising between the supreme executive bodies of the government of subjects of the Russian Federation and federal executive bodies authorized by the Government of the Russian Federation in case of coordination of the draft decision about establishment of aerodrome environs.

2. Recognize invalid:

Items 58 - 60 Federal rules of use of airspace of the Russian Federation approved by the order of the Government of the Russian Federation of March 11, 2010 No. 138 "About approval of Federal rules of use of airspace of the Russian Federation" (The Russian Federation Code, 2010, No. 14, Art. 1649; 2011, No. 37, Art. 5255);

Rules of establishment of aerodrome environs

1. These rules determine procedure for establishment of aerodrome environs.

2. The decision on establishment of aerodrome environs (further - the decision) is made:

a) concerning airfields of the state aircraft - the Ministry of Defence of the Russian Federation;

b) concerning airfields of experimental aircraft - the Ministry of Industry and Trade of the Russian Federation;

c) concerning airfields of civil aviation - Federal Air Transport Agency.

3. The decision includes:

a) text and graphical descriptions of location of borders of aerodrome environs and the subbands allocated on it, the list of coordinates of characteristic points of these borders in the system of coordinates used for maintaining the Single state real estate register (borders of aerodrome environs are established on external borders of the subbands allocated in such territory, at the same time borders of aerodrome environs and subbands allocated on it can be crossed with borders of the territorial zones established by rules of land use and building, and borders of the parcels of land);

b) the list of restrictions of use of the parcels of land and (or) the real estate objects located on them and implementation of economic and other activity according to the Air code of the Russian Federation (further - restrictions of use of real estate objects and implementation of activities).

4. The draft decision is prepared:

the builder who performs construction and reconstruction of the constructions intended for take-off, landing, taxing and the parking of aircrafts (further - constructions of airfield), - in case of architectural and construction designing for the purpose of construction, reconstruction of constructions of airfield;

the operator of airfield - concerning the airfields put into operation about day of entry into force of the Federal Law "About Modification of Separate Legal Acts of the Russian Federation regarding Enhancement of Procedure for Establishment and Use of Aerodrome Environs and the Sanitary Protection Zone". The operator of airfield in these rules is understood as the operator of airfield of civil aviation (for airfields of civil aviation), the organization performing operation of airfield of experimental aircraft (for airfields of experimental aircraft), federal executive body under which authority the airfield of the state aircraft, or the organization authorized by the specified federal executive body is (for airfields of the state aircraft).

5. The explanatory note containing the following information is attached to the draft decision:

a) the data on airfield entered in the State register of airfields and helidromes of civil aviation of the Russian Federation (for airfields of civil aviation), or the State register of airfields and helidromes of the state aircraft of the Russian Federation (for airfields of the state aircraft), or the State register of airfields and helidromes of experimental aircraft of the Russian Federation (for airfields of experimental aircraft), including about earlier established borders of airfield, except for the data which are the state secret;

b) general characteristic of aerodrome environs, including graphical materials (in the presence) from structure of documents of territorial planning or town-planning zoning;

c) reasons for the offered borders of aerodrome environs and subbands allocated on it in the part concerning safety of flights of aircrafts;

d) reasons for the offered borders of aerodrome environs and subbands allocated on it, including the corresponding calculations of dispersion of pollution of atmospheric air, physical impact on atmospheric air and risk assessment for health of the person;

e) reasons for the offered restrictions of use of real estate objects and implementation of activities.

6. Preparation of the draft decision and information, specified in Item 5 of these rules, is performed taking into account provisions of item 4 of article 47 of the Air code of the Russian Federation and Item 3 of part 7 of article 4 of the Federal law "About Modification of Separate Legal Acts of the Russian Federation regarding Enhancement of Procedure for Establishment and Use of Aerodrome Environs and the Sanitary Protection Zone", and also on the basis of results of the conducted researches, including research works in the part concerning safety of flights of aircrafts, perspective development of airfield and exception of negative impact of the equipment of airfield and flights of aircrafts on health of the person and the environment.
