1. Conduct on January 15, 2018 - on February 28, 2019 in the territory of the Russian Federation experiment on marking of tobacco products by means of identification and to monitoring of turnover of tobacco products (further - experiment).

2. Approve the enclosed Regulations on carrying out experiment on marking of tobacco products by means of identification and to monitoring of turnover of tobacco products.

3. Determine that the federal executive bodies authorized on ensuring carrying out experiment are the Ministry of Industry and Trade of the Russian Federation, the Ministry of Finance of the Russian Federation, the Ministry of Agriculture of the Russian Federation, the Ministry of Telecom and Mass Communications of the Russian Federation, Federal Security Service of the Russian Federation, the Federal Tax Service, the Federal Customs Service and Federal Service for the Oversight of Consumer Protection and Welfare (further - authorized bodies).

4. Agree with the offer of Operator-TsRPT limited liability company on implementation by the specified society on a grant basis of functions of the operator of the information system used for the purpose of carrying out experiment (further - information system).

5. Recommend to the operator of information system to determine till November 30, 2017:

requirements to ensuring the information security containing in information system and to ensuring information security when using information and communication technologies within the experiment.

6. Provide to the Ministry of Industry and Trade of the Russian Federation:

a) coordination and monitoring of work of the participants of turnover of tobacco products participating in experiment;

b) till December 15, 2017 in coordination with authorized bodies:

development and approval of methodical recommendations about carrying out experiment and scheduled plan of carrying out experiment;

approval of requirements to information system, requirements to ensuring the information security containing in information system and to ensuring information security when using information and communication technologies within the experiment;

c) till July 1, 2018, till December 31, 2018 and till February 28, 2019, together with authorized bodies - evaluating results of experiment and submission of the corresponding reports to the Government of the Russian Federation.

7. To the Federal Tax Service, the Federal Customs Service and Federal Service for the Oversight of Consumer Protection and Welfare when implementing of the established functions to consider the data transferred by participants of experiment to information system.

Regulations on carrying out experiment on marking of tobacco products means of identification and to monitoring of turnover of tobacco products

1. This Provision establishes procedure for carrying out experiment on marking of tobacco products means of identification and to monitoring of turnover of the tobacco products which are in civil circulation in the territory of the Russian Federation (further - experiment).

2. The purposes of experiment are:

a) approbation of completeness, efficiency, effectiveness and sufficiency of mechanisms of marking of tobacco products means of identification for providing:

confirmations of authenticity of goods;

counteractions illegal to import to the Russian Federation, to production and turnover of tobacco products (including counterfeit);

interactions of participants of turnover of tobacco products for the purpose of exception of dumping and use of others unforeseen the legislation of schemes of turnover of tobacco products;

standardization and unification of accounting procedures of turnover of tobacco products;

b) determination of feasibility of transition to obligatory marking of tobacco products means of identification in the fiscal purposes (regarding excises) in case of refusal from marking of tobacco products special and (or) excise stamps;

c) in case of decision making about introduction of obligatory marking of tobacco products means of identification - development of offers on introduction of amendments to the legislation of the Russian Federation:

in the sphere of protection of public health from impact of environmental tobacco smoke and consequences of consumption of tobacco;

about taxes and fees;

about customs affairs;

about technical regulation.

3. Participants of experiment are:

a) the federal executive bodies authorized by the Government of the Russian Federation on ensuring carrying out experiment;

b) producers, importers of tobacco products (since July 1, 2018), the organizations of wholesale and retail trade (further - subjects of the address of tobacco products);

c) the operator of the information system used for the purpose of carrying out experiment (further - information system).

4. Subjects of the address of tobacco products participate in experiment on voluntary basis. For participation in experiment by subjects of the address of tobacco products applications according to the procedure, established according to Item 5 of this provision are submitted.

For carrying out experiment by the Ministry of Industry and Trade of the Russian Federation in coordination with the federal executive bodies authorized by the Government of the Russian Federation on ensuring carrying out experiment methodical recommendations, including about the following questions affirm:

e) registration of participants of experiment in information system;

e) entering of information into information system, including structure of the information provided by participants of experiment;

g) monitoring and assessment of results of experiment;
