About approval of Rules of determination of compliance of the power transferring organizations to requirements imposed to activities for transfer of electrical energy

1. Approve the enclosed Rules of determination of compliance of the power transferring organizations to requirements imposed to activities for transfer of electrical energy.

2. To provide to department of power industry and coal industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication, except for:

1) Items 6, 7 Rules which become effective since January 1, 2018;

2) Items 9, 10, 11, 12 Rules which become effective since January 1, 2020;

3) Items 13, 14 Rules which become effective since January 1, 2022.

Rules of determination of compliance of the power transferring organizations to requirements imposed to activities for transfer of electrical energy

Chapter 1. General provisions

1. Rules of determination of compliance of the power transferring organizations to requirements imposed to activities for transfer of electrical energy (further - Rules) are developed according to subitem 30-4) of article 5 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" (further - the Law) and determine procedure for determination of compliance of the power transferring organizations to requirements imposed to activities for transfer of electrical energy.

2. In these rules the following concepts and determinations are used:

1) dispatching technology management - the process performed by the dispatcher and intended for the solution of tasks of control and management of the modes of functioning of power networks by means of the automated systems of dispatching and technology management, and also acceptance and processing of messages from physical persons and legal entities on premises of origin or emergence of the technology violations requiring taking measures of reaction and elimination of refusals and damages;

2) power networks - set of substations, distributing devices and the power lines connecting them intended for transfer of electrical energy;

3) the process chart - the technical document regulating procedure for accomplishment of engineering procedure of electric installation work, and containing structure of transactions, means of mechanization, expense of resources, quality requirements and actions for safety of works, individual protection equipment.

Other concepts and determinations used in these rules are applied according to the legislation of the Republic of Kazakhstan in the field of power industry.

Chapter 2. Procedure for determination of compliance of the power transferring organizations to requirements imposed to activities for transfer of electrical energy

3. Determination of compliance of the power transferring organizations to requirements imposed to activities for transfer of electrical energy is carried out by body for the state energy supervision and control in the following cases:

1) in case of unscheduled inspection concerning the specific checked subject;

2) in case of preventive control with visit of subject (object);

3) in case of preventive control without visit of subject (object);

4) for receipt of information (number and date of issue) provided by part three of Item 5 of Rules of implementation of activities by subjects of the natural monopolies approved by the order of the Minister of national economy of the Republic of Kazakhstan of August 13, 2019 No. 73 (it is registered in the Register of state registration of regulatory legal acts No. 19242).

4. The body for the state energy supervision and control can involve experts in case of determination of compliance of the power transferring organizations to requirements imposed to activities for transfer of electrical energy.

5. The body for the state energy supervision and control determines compliance of the power transferring organizations to the requirements specified in Item 6 of article 13-1 of the Law of the Republic of Kazakhstan "About power industry".

6. Compliance to the power transferring organization to the requirement for availability of dispatching technology management proves to be true based on availability of means and documentation specified in appendix 1 to these rules.
