1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of determination of deficit and surplus of electrical energy in single electric utility system of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of determination of deficit and surplus of electrical energy in single electric utility system of the Republic of Kazakhstan (further - Rules) are developed according to subitem 70-29) of article 5 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" and determine procedure for determination of deficit and surplus of electrical energy in single electric utility system of the Republic of Kazakhstan (further - EEC of Kazakhstan).

2. In these rules the following basic concepts are applied:

1) deficit of electrical energy - lack of technical capability at the power making organizations of the Republic of Kazakhstan developments of electrical energy in the amounts sufficient for complete satisfaction of requirement of economy and the population of the Republic of Kazakhstan in electrical energy, including amount of reserves of capacity;

2) surplus of electrical energy - availability at the power making organizations of the Republic of Kazakhstan of technical capability of development of electrical energy in the amounts exceeding actual demand of economy and the population of the Republic of Kazakhstan taking into account maintenance of required amounts of reserves of capacity;

3) system of the balancing electricity market - the hardware and software established at the system operator and which is the central mechanism on receipt of all information necessary for forming of the daily schedule, management of the balancing market, calculation of hourly imbalances of electrical energy, market clearing price, the price of the balancing market of electrical energy, cost of the balancing electric power, and also carrying out calculations between participants of the balancing market of electrical energy.

3. Other concepts used in these rules are applied according to the legislation of the Republic of Kazakhstan.

Chapter 2. Procedure for determination of deficit and surplus of electrical energy in single electric utility system of Kazakhstan

Paragraph 1. Procedure for determination of deficit and surplus of electrical energy in single electric utility system of Kazakhstan

4. The system operator in the settlement way for every month determines technical capability by providing all regions of the Republic of Kazakhstan with electrical energy taking into account necessary amount of stand-by capacities.

5. Forecast deficit and surplus of electrical energy in EEC of Kazakhstan and its parts is determined by the system operator on the basis:

1) the balance estimation of electrical energy for the forthcoming seven-year period;

2) necessary amounts of the reserves of capacity determined according to Paragraph 5 of the Power grid rules approved by the order of the Minister of Energy of the Republic of Kazakhstan of December 18, 2014 No. 210 (it is registered in the Register of state registration of regulatory legal acts No. 10899);

3) the approved schedules of repairs of the generating equipment of the power making organizations of the Republic of Kazakhstan, considering availability of technology restrictions on development of electrical energy at power plants;

4) the approved schedules of repairs of power grid objects of the National power grid;

5) handling capacity of the power lines connecting power shortage regions with energy surplus nodes of generation;

6) lack of electric communications between separate parts of EEC of Kazakhstan.

Paragraph 2. Procedure for confirmation by the system operator of deficit of electrical energy when forming the daily schedule

6. The subjects of the wholesale market planning acquisition of the electrical energy made outside the Republic of Kazakhstan send to the system operator request online through system of the balancing electricity market.

7. For deficit confirmation the system operator considers the possibility of acquisition of the electrical energy made outside the Republic of Kazakhstan according to Paragraph 1 of Chapter 2 of these rules.

8. The system operator rejects online the request for import in real time, in case of surplus of the electric power in EEC of Kazakhstan or its parts.

9. The system operator adjusts online the request in real time, in case of excess of the declared amount of the imported electrical energy over the size of its deficit.

10. In case of confirmation by the system operator online of the request for acquisition of the electrical energy made outside the Republic of Kazakhstan, amounts of the imported electrical energy join in the approved daily schedule.
