1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of determination of deficit and surplus of electrical energy in single electric utility system of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of determination of deficit and surplus of electrical energy in single electric utility system of the Republic of Kazakhstan (further - Rules) are developed according to subitem 70-29) of article 5 of the Law of the Republic of Kazakhstan "About power industry" (further - the Law) and determine procedure for determination of deficit and surplus of electrical energy in single electric utility system of the Republic of Kazakhstan (further - EEC of Kazakhstan).

2. In these rules the following basic concepts are applied:

1) system of the balancing market - the hardware and software intended for giving by subjects of the wholesale market of electrical energy of purchasing requests and requests for sale, forming of the daily schedule of production consumption of electrical energy, determination of amounts of the centralized biddings by electrical energy for digital mayner, determination of amounts of the centralized biddings by electrical energy for the power making organizations, introduction of the adjustments of the approved daily schedule, forming of the actual values of production consumption of electrical energy of subjects of the wholesale market of electrical energy, calculation of hourly imbalances of electrical energy, calculation of the hourly prices of purchase and sale of electrical energy approved by the system operator in the wholesale market of electrical energy, and also hourly purchase prices (sale) of the balancing electric power and purchase (sale) of negative imbalances;

2) deficit of electrical energy - lack of technical capability at the power making organizations of the Republic of Kazakhstan (including the generating capacities of the installations which are in reserve) developments of electrical energy in the amounts sufficient for complete satisfaction of requirement of economy and the population of the Republic of Kazakhstan in electrical energy;

3) surplus of electrical energy - availability of technical capability at the power making organizations of the Republic of Kazakhstan (taking into account the generating capacities of the installations which are in reserve) developments of electrical energy in the amounts exceeding actual demand of economy and the population of the Republic of Kazakhstan.

Other concepts used in these rules are applied according to the Law.

Chapter 2. Procedure for determination of deficit and surplus of electrical energy in EEC of Kazakhstan

4. Forecast deficit and surplus of electrical energy in EEC of Kazakhstan and its parts is determined by the system operator on the basis:

1) the approved schedules of repairs of the generating equipment of the power making organizations of the Republic of Kazakhstan, considering availability of technology restrictions on development of electrical energy at power plants;

2) the approved schedules of repairs of power grid objects of the National power grid;

3) handling capacity of the power lines connecting power shortage regions with energy surplus nodes of generation;

4) lack of electric communications between separate parts of EEC of Kazakhstan;

5) the planned hourly production volumes and (or) consumption of electrical energy by subjects of the wholesale market of electrical energy the forthcoming month;

6) purchasing requests and applications for sale of electrical energy submitted by subjects of the wholesale market of electrical energy in system of the balancing market when forming the daily schedule of production consumption of electrical energy.

Forecast deficit and surplus of electrical energy in EEC of Kazakhstan and its parts is adjusted by the system operator based on technical capability of power networks under the terms of ensuring reliable work of EEC of Kazakhstan and its parts.

5. Subjects of the wholesale market of electrical energy, except for the operator of the market of centralized trade and the single purchaser of electrical energy (further - the Single purchaser), no later than the 20th day of every month previous planned by means of system of the balancing market are provided to the system operator by the planned hourly production volumes and (or) consumption of electrical energy the forthcoming month.
