About approval of the Regulations on procedure for holding qualification examination on the admission to notarial activities and protest of its results

(as amended of the Order of the Ministry of Justice of the Republic of Moldova of 03.11.2017 No. 934)

Based on part (3) article 21 of the Law No. 69 of April 14, 2016 on the organization of notarial activities (The official monitor of the Republic of Moldova, 2016, 588) I ORDER to Art. No. 277-287,:

1. Approve Regulations on procedure for holding qualification examination on the admission to notarial activities and protest of its results, according to appendix.

2. Declare invalid the Order of the Minister of Justice No. 170 of April 30, 2009 about approval of the Regulations on carrying out tender on substitution of vacant positions of the notary (The official monitor of the Republic of Moldova, 2009, Art. No. 99-100, 419).

3. Publish this order in the Official monitor of the Republic of Moldova.

Regulations on procedure for holding qualification examination on the admission to notarial activities and protest of its results

I. General provisions

1. The regulations on procedure for holding qualification examination on the admission to notarial activities and protest of its results establish stages of qualification examination on the admission to profession of the notary (further - examination), the procedure of the admission to examination, conditions of the organization and procedure for holding examination, estimation, consideration of objections and approval of their results.

2. Examination will be organized by the Ministry of Justice as required, but no more than two times a year, and held by the Commission on licensing.

3. The person which passed professional training and wishing to be allowed to notarial activities (further - the candidate) can participate in examination.

II. Examination stages

4. Examination consists of two stages:

1) the I stage – written task;

2) the II stage – oral task.

5. The first stage consists of the answer to three theoretical questions from the civil law, law of civil procedure, the notarial legislation and the notarial procedure.

6. The second stage consists of the answer to three practical questions from notarial activities.

7. The subject and the bibliography of theoretical and practical questions is annually developed by the Commission on licensing and published on the web page of the Ministry of Justice, and according to the decision of Notarial chamber and on its web page. In case of development of subject and the bibliography the Commission on licensing can consult with regular teachers in the field of the right.

9. The commission on licensing prepares questions for written and oral task, proceeding from the published subject and the bibliography, by the following rules:

1) matters of argument of the doctrine of the right or notarial practice shall not contain;

2) questions shall be accurately formulated, make unambiguous and objective sense not to leave the place for interpretation;

3) questions shall provide the balanced content from scope of examination and have the complexity corresponding to content of subject and the bibliography according to examination stage;

4) time allocated for the decision shall not exceed time allocated for carrying out examination task.

10. The purpose of written task consists in examination of the candidate in the areas containing in subject and is given in writing on paper or on the computer.

11. The purpose of oral task consists in check of practical and professional skills of the candidate, its capability to apply theoretical knowledge in practical cases. Members of the commission can ask about licensing to the candidate questions for refining of answers to practical questions.

III. The admission to examination, conditions of the organization of examination

12. Information on holding examination is published on the web page of the Ministry of Justice, and according to the decision of Notarial chamber and on its web page at least in 45 working days prior to date of its carrying out.
