About authorization system in the field of economic activity

This Law determines legal and organizational basis of functioning of authorization system in the field of economic activity and establishes procedure for activities of allowing bodies, authorized to issue documents of allowing nature, and administrators.

Article 1. Main terms

1. In this Law terms are used in such value:

authorization system in the field of economic activity set of the relations settled by the legislation arising between allowing bodies, administrators and subjects of housekeeping in connection with issue of documents of allowing nature, renewal, cancellation of documents of allowing nature;

allowing bodies are the subjects of provision of administrative services, their officials authorized according to the law to issue documents of allowing nature;

the document of allowing nature - permission, the conclusion, the decision, approval, the certificate, other document in electronic form (record about availability of permission, the conclusion, decision, approval, the certificate, other document in the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming) which the allowing body shall issue to the subject of housekeeping in case of provision to it the rights to carrying out certain actions concerning implementation of economic activity or types of economic activity and/or without availability of which the subject of housekeeping cannot carry out certain actions concerning implementation of economic activity or types of economic activity;

the paragraph the fifth is excluded;

the paragraph of the sixth is excluded;

object on which the document of allowing nature is issued (further - object) - natural resources, the parcel of land, soil cover of the parcels of land, construction, the building, the room, the equipment, equipment and mechanisms which are put into operation or are designed, separate transaction, economic activity of certain type, work and service, and also documents which are used by the subject of housekeeping in the course of passing of the conciliation (allowing) procedure (the project documentation on construction of facilities, land management documentation, town-planning documentation, mountain branch);

the declaration on implementation of economic activity (further - the declaration) - the document by which the subject of managing notifies allowing body on the compliance to requirements of the legislation to certain type of economic activity (including material and technical resources, qualification of personnel - if it is caused by features of implementation of the corresponding type of economic activity) and based on which acquires the right to implementation of the declared type of economic activity and bears the responsibility provided by the law.

the form and the notification procedure of the administrator or the relevant allowing organ of compliance of material and technical resources of the subject of managing to requirements of the legislation and entering of it of record into the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming are established by the Cabinet of Ministers of Ukraine

the principle of acquiescence - the principle according to which the subject of housekeeping acquires the right to carrying out certain actions concerning implementation of economic activity or types of economic activity without receipt of the relevant document of allowing nature under condition if the subject of housekeeping or person authorized by it file in accordance with the established procedure the application and documents in full, but in the time established by the law the document of allowing nature or the decision on refusal in its issue is not issued or not directed;

the paragraph the eleventh is excluded;

the allowing (conciliatory) procedure - set of actions which are performed by administrators and allowing bodies during approval (consideration), registration, provision of the conclusions and so forth prior to receipt of the document of allowing nature;

the paragraph the thirteenth is excluded;

specially authorized body concerning authorization system in the field of economic activity (further - authorized body) - the central executive body determined by the Cabinet of Ministers of Ukraine;

the subject of managing - the legal entity of Ukraine or other state irrespective of its form of business and pattern of ownership performing economic activity registered in the procedure established by the legislation except public authorities and local government bodies, and also the physical person - the entrepreneur, including the investor who is agreement party about distribution of products according to the Law of Ukraine "About agreements on distribution of products", his contractor, subcontractor, the supplier and other partner performing the works provided by the agreement on distribution of products based on agreements with the investor.

The terms "administrator", "center of provision of administrative services" and "subject of provision of administrative service" in this Law are used in the value determined in the Law of Ukraine "About administrative services".
