About the general requirements imposed to professional training on retraining, advanced training and skills training of workers in the state organizations

According to part 2 of Article 122 of the Labor code of the Republic of Tajikistan the Government of the Republic of Tajikistan decides:

Approve the General requirements imposed to professional training, retraining, advanced training and skills training of workers in the state organizations (are applied).

The general requirements imposed to professional training, retraining, advanced training and skills training of workers in the state organizations

1. General provisions

1. The general requirements imposed to professional training, retraining, advanced training p on skills training of workers in the state organizations (further - these Requirements) determine general requirements, obligations, organizational procedure, privileges and financing of professional training, retraining, advanced training and skills training of workers in the state organizations.

2. Accomplishment of these Requirements is performed by all state organizations which are financed by republican and local budgets, and the employees cooperating with employers based on employment or collective agreements and contracts, except for government employees.

3. The purpose of these Requirements is increase in skill level of the worker, development of new specialties, reduction of knowledge and skills in compliance with work market requirements, increase in professional skills and knowledge of the worker in connection with implementation of innovative technologies and studying of experience of the advanced countries.

4. These Requirements regulate activities of the state organizations in the field of professional training, retraining, advanced training and skills training of workers.

2. The general requirements imposed to professional training, retraining, advanced training and skills training of workers in the state organizations

5. Professional training of employees of the state organizations is carried out for acquisition, improvement knowledge, additional knowledge for the realization of new type of professional activity and skills necessary in future professional activity in the state organizations.

6. Professional training of employees of the state organizations is carried out also for receipt of additional qualification in need of professional training to certain period of activities and change of position in the state organizations.

7. Retraining of employees of the state organizations is considered advanced training of employees of the state organizations and is carried out for updating of their knowledge and professional skills in connection with increase in modern polls to the level of their qualification, professional training, questions of the new appeared qualifications.

8. Skills training of employees of the state organizations is development of new experiments for fixing of theoretical knowledge of employees of the state organizations and are carried out in case of advanced training, acquisition of pilot skills and their fruitful use during the course of performance of the job responsibilities.

9. Development of the program of skills training from employees of the state organizations is independent form of additional professional training which comes to an end with the report on skills training with obligatory state certification.

10. Professional training, retraining, advanced training and skills training of employees of the state organizations is carried out each 3 years, but less once in 5 years.

3. The rights and obligations of the employer and workers on professional training, retraining, advanced training and skills training of workers

11. Rights and obligations of the employer:

- determines need and amount of professional training, retraining, advanced training and skills training of workers for the purpose of ensuring functioning and organization development;

- creates conditions to the workers having professional training, retraining, advanced training and skills training, for combination of work with training, provided by the Labor code of the Republic of Tajikistan, the employment contract, the agreement and collective agreements;

- creates conditions for professional training, retraining and enhancement of knowledge, additional training in professions, ensuring advanced training of workers directly on production or in educational institutions of professional education;

- upon termination of training in organizations of professional education the corresponding qualification by profession is appropriated to the worker and employed according to the received qualification;

- general professional education of the worker is considered in case of advanced training, determination of the amount of compensation and promotion to higher position;

- the guarantees and compensations provided to the workers combining work with training are provided only on principle place of employment;

- renders assistance to the educational institutions implementing technical and professional programs in professional training, retraining, advanced training and skills training of personnel.

12. Rights and obligations of workers:

- workers have the right to professional training, retraining and advanced training, including training in new professions and specialties; the workers having professional training, retraining and advanced training in coordination with the employer can be exempted from work or perform work on the terms of part-time;

- the workers having professional training, retraining and advanced training use the guarantees provided by the Labor code of the Republic of Tajikistan, the employment contract, the agreement and collective agreements;

- the worker upon completion of professional training, retraining and advanced training shall work the term approved by the parties in the agreement of training at the employer;

- in case of termination of the employment contract to the term established by the agreement of training at the initiative of the worker or at the initiative of the employer owing to fault of the worker, the worker compensates to the employer of costs, connected with its training is pro rata to the underfulfilled working off term.

4. Organization of preparation, retraining, advanced training and skills training

13. Workers go to rates of professional training, retraining, advanced training and skills training based on the documents submitted by the employer.
