Based on parts (1) and (9) article 9 of the Law No. 78-XV of March 18, 2004 on foodstuff (The official monitor of the Republic of Moldova, 2004, Art. No. 83-87, 431), with subsequent changes and amendments, and article 6 of the Law No. 10-XVI of February 3, 2009 on the state supervision of public health (The official monitor of the Republic of Moldova, 2009, No. 67, the Art. 183), with subsequent changes and amendments, DECIDES: the Government

1. Approve Sanitary regulations about establishment of specific conditions and detailed procedures of placement in the market of the plastic kitchen ware on the basis of polyamide and melamine occurring or sent from People's Republic of China and from Hong Kong Special Administrative Region of People's Republic of China it (is applied).

2. The specified Regulations become effective after 3 months from the date of publication.

3. Realization of the plastic kitchen ware on the basis of polyamide and melamine occurring or sent from People's Republic of China and from Hong Kong Special Administrative Region of People's Republic of China imported on the market legally before entry into force of the specified Regulations, before exhaustion of inventories is allowed.

4. To impose control over the implementation of this resolution on the Ministry of Health, work and social protection (The national agency of public health).

The sanitary regulations about establishment of specific conditions and detailed procedures of placement in the market of the plastic kitchen ware on the basis of polyamide and melamine occurring or sent from People's Republic of China and from Hong Kong Special Administrative Region of People's Republic of China (further – Regulations) shift provisions of Regulations (EU) No. 284/2011 of the Commission of the March 22, 2011 establishing specific conditions and detailed procedures for import of the plastic kitchen ware on the basis of polyamide and melamine occurring or sent from People's Republic of China and from Hong Kong Special Administrative Region of People's Republic of China published in the Official magazine of the European Union by L 77 of March 23, 2011.

I. General provisions

1. These Regulations establish the necessary legal base, specific conditions and detailed procedures of placement in the market of the plastic kitchen ware on the basis of polyamide and melamine occurring or sent from People's Republic of China (further – China) and from Hong Kong Special Administrative Region of People's Republic of China (further – Hong Kong).

2. In the context of these Regulations the determinations provided in the Sanitary regulations on the materials and products intended for contact with foodstuff approved by the Order of the Government No. 308 of April 29, 2011 and in the Sanitary regulations about the materials and products from plastic intended for contact with foodstuff approved by the Order of the Government No. 278 of April 24, 2013 including the specific determinations stated below are used:

plastic kitchen ware – plastic materials as they are described in Item 2 of Sanitary regulations on the materials and products from plastic intended for the contact with foodstuff approved by the Order of the Government No. 278 of April 24, 2013;

physical control – sampling for carrying out analyses and laboratory tests, and also the control necessary for check of observance of requirements concerning release of primary aromatic amines (AAR) and formaldehyde established in the Sanitary regulations about the materials and products from plastic intended for contact with foodstuff approved by the Order of the Government No. 278 of April 24, 2013.

II. Import conditions

3. The plastic kitchen ware on the basis of polyamide and melamine occurring or sent from China and Hong Kong is placed in the market of the Republic of Moldova only if the importer represents to the National agency of public health for each batch the completed declaration of conformity according to Items 19 and 20 of Sanitary regulations on the materials and products intended for the contact with foodstuff approved by the Order of the Government No. 308 of April 29, 2011, confirmatory that this batch conforms to the requirements concerning release of primary aromatic amines and formaldehyde, established in Item 5, in appendix to these Regulations and, respectively, in appendix No. 1 to the Sanitary regulations about the materials and products from plastic intended for contact with foodstuff approved by the Order of the Government No. 278 of April 24, 2013.

4. The declaration is constituted in the Romanian or English languages.

5. The declaration specified in Item 3 of these Regulations is followed by the protocol of laboratory researches, with indication of:

1) for kitchen ware on the basis of polyamide – analysis results, confirmatory that it does not release in foodstuff or in food simulators of primary aromatic amines in the found quantity; the limit of detection is applied to the amount of primary aromatic amines; for the purpose of the analysis the detection limit for primary aromatic amines is set at the 0,01 level of mg/kg of foodstuff or food simulators;

2) for kitchen ware on the basis of melamine – analysis results, confirmatory that it does not release in foodstuff or in food simulators formaldehyde in the quantity exceeding 15 mg/kg of food.
