Rules of expenditure of funds for actions for deportation or administrative expulsion of foreign citizens and stateless persons out of limits of the Russian Federation in case of impossibility of establishment of inviting party

1. These rules determine according to Item 6 of Article 31 and Item 2 of article 34 of the Federal law "About Legal Status of Foreign Citizens in the Russian Federation" (further hereinafter is referred to as - the Law) procedure for expenditure of funds for actions for deportation or administrative expulsion of foreign citizens and persons without citizenship out of limits of the Russian Federation due to the lack, loss or the termination of legal causes for their further stay (residence) in the Russian Federation if establishment of inviting party is impossible.

2. The concepts used in these rules mean the following:

"deportation" - forced expulsion of the foreign citizen (stateless person) from the Russian Federation in case of loss or the termination of legal causes for its further stay (residence) in the Russian Federation;

3. The funds allocated for actions for deportation or administrative expulsion of foreign citizens and persons without citizenship are spent:

a) on acquisition of travel documents for the foreign citizen (stateless person) which is subject to deportation or administrative expulsion, and in the cases established by the legislation of the Russian Federation - also travel documents for the officials of territorial authority of Federal Bailiff Service or territorial authority of the Ministry of Internal Affairs of the Russian Federation of the Russian Federation accompanying the specified foreign citizen (stateless person) and also on carrying out by Federal Bailiff Service concerning foreign citizens (stateless persons) which are subject to administrative expulsion, laboratory researches on new koronavirusny infection (COVID-19) by method of the polymerase chain reaction (PCR);

b) on content of the foreign citizen (stateless person) in specially allotted premises of the border service before execution of the decision on administrative expulsion, and also in the special facility of the Ministry of Internal Affairs of the Russian Federation or its territorial authority intended for content of foreign citizens (stateless persons) which are subject to administrative expulsion out of limits of the Russian Federation in the form of exclusion out of limits of the Russian Federation, deportation or readmission;

c) document creation, necessary for implementation of deportation or administrative expulsion of the foreign citizen (stateless person);

d) making of other actions which are directly connected with deportation or administrative expulsion of the foreign citizen (stateless person).

4. Financial provision of actions for deportation or administrative expulsion of foreign citizens and persons without citizenship is performed by the federal executive bodies authorized by the Law to perform such actions.

The expenses connected with holding the specified actions are performed at the expense of means of the federal budget within limits of the budget obligations and the amounts of financing of the expenses on the specified purposes of the corresponding codes of budget classification of the Russian Federation considered on the personal accounts of receivers of means of the federal budget opened in territorial authority of the Federal Treasury to the federal state institutions which are under authority of the federal executive bodies authorized by the Law to perform the specified actions.

The specified federal executive bodies exercise control of use of funds of the federal budget for actions for deportation or administrative expulsion of foreign citizens and persons without citizenship according to the procedure, established by the legislation of the Russian Federation.
