About approval of the Regulations on regulation of employment relationships in self-government institutions of citizens

In pursuance of the Program of complex measures for further enhancement of the activities of self-government institutions of citizens approved by the Presidential decree of the Republic of Uzbekistan of February 3, 2017 No. UP-4944 "About Measures for Further Enhancement of Institute Waved", the Cabinet of Ministers decides:

1. Approve Regulations on regulation of employment relationships in self-government institutions of citizens according to appendix.

2. To the ministries and departments in two weeks to bring the regulatory legal acts adopted by them into accord with this resolution.

3. To impose control of execution of this resolution on Information analysis department concerning education, science and youth policy of the Cabinet of Ministers of the Republic of Uzbekistan.

Regulations on regulation of employment relationships in self-government institutions of citizens

Chapter 1. General provisions

1. This Provision according to the Presidential decree of the Republic of Uzbekistan of February 3, 2017 No. UP-4944 "About Measures for Further Enhancement of Institute Waved" determines procedure for regulation of employment relationships in self-government institutions of citizens.

Chapter 2. Procedure for regulation of employment relationships with the chairman (aksakal) and workers of descents of citizens

2. The chairman (aksakal) and workers of descent of citizens (the responsible secretary and others) perform the activities in compliance the legislation.

3. Labor obligations and the rights of the chairman (aksakal) and workers of descents of citizens, and also questions of their relation are concretized taking into account the regulations governing employment relationships in the local acts adopted by self-government institutions of the citizens approved as the chairman (aksakal) of descent of citizens.

4. For the purpose of execution of powers of descent of citizens the chairman (aksakal) of descent of citizens on the decision Kengasha of descent of citizens has the right to attract inhabitants of descent of citizens to accomplishment of separate works on the basis of the civil service provision agreement.

5. The chairman (aksakal) of descent of citizens has the right to sign employment contracts with the unoccupied persons living in the territory of makhally for their attraction to social jobs, with compensation by fund of social jobs under the Ministry of employment and employment relationships of the Republic of Uzbekistan.

Chapter 3. Compensation of employees of self-government institutions of citizens

6. Compensation of the chairman (aksakal) and workers of descent of the citizens entering into staff of descent of citizens is performed in the form of official pay rate on the basis of the Single scale of charges on compensation. Grades in compensation of this employee category are established by the resolution of the Cabinet of Ministers of July 17, 2017 No. 500 "About establishment of categories on single scale of charges to workers of descents of citizens".

Surcharges and allowances to the chairman (aksakal) and workers of descent of citizens are established according to collective agreements, and also other local acts adopted by the employer in coordination with trade-union committee or other representative body of workers.

7. Payments of award and surcharges for the account of non-budgetary sources are performed:

to chairmen (aksakals) of descent of citizens - solutions of hokim of the respective areas (cities) - chairmen of the board on coordination of activities of self-government institutions of citizens of the area (city);

to other workers of descent of citizens - solutions of hokim of the respective areas (cities) based on representation of the chairman (aksakal) of descent of citizens.

8. Conditions and the amount of compensation to the citizens who are not workers of descent of citizens are established by Kengash of descent of citizens.

Remuneration payment to the citizens attracted to execution of powers of descent of citizens is performed at the expense of non-budgetary sources, stipulated by the legislation.

Chapter 4. Mode of working hours of the chairman (aksakal) and workers of descent of citizens

9. The mode of working hours of the chairman (aksakal) and workers of descent of citizens is established by the regulations approved by Kengash of descent of citizens proceeding from forty-hour six-day business week.

10. In self-government institutions of citizens taking into account features of the organization of activities of descent of citizens for execution of the powers established by the legislation the summed-up account of working hours, with separation of the working day into parts is kept from 7-00 to 22-00 o'clock.

The working schedule in the conditions of flexible working hours of workers of descent of citizens affirms the chairman (aksakal) of descent of citizens, taking into account optimization of execution by workers of job responsibilities, and the schedule of working hours of the chairman (aksakal) of descent of citizens - Kengash of descent of citizens.

The working schedule of the chairman (aksakal) and workers of descent of citizens with indication of time of their stay directly in descent of citizens is hung out for public inspection.

11. The chairman (aksakal) and workers of descent of citizens is granted annual paid labor leave lasting 24 working days.

Chapter 5. Final provisions

12. The termination of powers of the chairman (aksakal) and workers of descent of citizens is performed according to the procedure, provided by the Law "About Self-government Institutions of Citizens" and regulations governing employment relationships of chairmen (aksakals) and workers of descent of citizens.

13. Disputes in the field of regulation of employment relationships of chairmen (aksakals) and workers of descent of citizens are permitted according to the procedure, stipulated by the legislation.
