About approval of Rules of the organization of activities of ambassadors extraordinary and plenipotentiary of the Republic of Kazakhstan in combination and ambassadors extraordinary and plenipotentiary of the Republic of Kazakhstan with the place of dislocation in the Republic of Kazakhstan

According to Item 2 of article 9 of the Law of the Republic of Kazakhstan of March 7, 2002 "About diplomatic service of the Republic of Kazakhstan" I DECIDE:

1. Approve the enclosed Rules of the organization of activities of ambassadors extraordinary and plenipotentiary of the Republic of Kazakhstan in combination and ambassadors extraordinary and plenipotentiary of the Republic of Kazakhstan with the place of dislocation in the Republic of Kazakhstan.

2. This Decree becomes effective after ten calendar days after day of its first official publication.

Rules of the organization of activities of ambassadors extraordinary and plenipotentiary of the Republic of Kazakhstan in combination and ambassadors extraordinary and plenipotentiary of the Republic of Kazakhstan with the place of dislocation in the Republic of Kazakhstan

1. General provisions

1. Ambassadors extraordinary and plenipotentiary of the Republic of Kazakhstan in combination (further - ambassadors in combination), ambassadors extraordinary and plenipotentiary of the Republic of Kazakhstan with the place of dislocation in the Republic of Kazakhstan (further - nonresident ambassadors) are appointed and respond the President of the Republic of Kazakhstan.

2. Ambassadors in combination and nonresident ambassadors perform the activities according to the Constitution of the Republic of Kazakhstan, the Vienna convention on the diplomatic intercourses of April 18, 1961, the Vienna convention on the consular intercourses of April 24, 1963, the Law of the Republic of Kazakhstan of March 7, 2002 "About diplomatic service of the Republic of Kazakhstan" (further - the Law), Regulations on the diplomatic and equated to it representation of the Republic of Kazakhstan, the approved Presidential decree of the Republic of Kazakhstan of February 4, 2004 No. 1287, these rules, other regulatory legal acts, international treaties of the Republic of Kazakhstan taking into account the legislation of the state of stay (accreditation) or rules of the international organization, and also the universally recognized norms of international law.

3. Ambassadors in combination, nonresident ambassadors in the activities are accountable to the Minister of Foreign Affairs of the Republic of Kazakhstan.

4. Nonresident ambassadors are the political government employees with the permanent place of dislocation in the Republic of Kazakhstan authorized by the President of the Republic of Kazakhstan to represent the Republic of Kazakhstan in the relations with one or several foreign states and the international organizations.

5. Appointment and dismissal of nonresident ambassadors are performed according to the procedure of external staff rotation of diplomatic service according to the subitem 1) of Item 2 of article 15 of the Law and in terms, stipulated in Item 4 articles 15 of the Law.

6. Within realization of foreign policy of the Republic of Kazakhstan ambassadors in combination and nonresident ambassadors represent, and also protect all legal means and by methods of the right and interests of citizens and the organizations of the Republic of Kazakhstan.

7. Ambassadors in combination and nonresident ambassadors on permanent basis inform the Ministry of Foreign Affairs of the Republic of Kazakhstan (further - the Ministry) on the current internal political and social and economic situation, the pursued foreign policy, the main events which are taking place in the country of accreditation and the international organization.

8. Ambassadors in combination and nonresident ambassadors in accordance with the established procedure make in the Ministry offers on development of the bilateral relations with the state of accreditation or the international organization.

9. In coordination with the Ministry ambassadors in combination and nonresident ambassadors render assistance to state bodies and the organizations of the Republic of Kazakhstan in questions of establishment and development of cooperation of the Republic of Kazakhstan with the state of accreditation or the international organization.

For the purpose of realization of the assistance specified in this Item of Rules ambassadors in combination and nonresident ambassadors have the right in coordination with the Ministry to request and receive in accordance with the established procedure from state bodies and the organizations of the Republic of Kazakhstan required materials and documents.

10. Ambassadors in combination approve with the Minister of Foreign Affairs of the Republic of Kazakhstan departures from the state of stay in official journeys, including departures to the countries of accreditation in combination.

11. For the purpose of realization of the functions nonresident ambassadors leave in official journeys to the country of accreditation.

Duration and frequency of business trips are determined in coordination with the Minister of Foreign Affairs of the Republic of Kazakhstan.

12. In the states where foreign institutions of the Republic of Kazakhstan are located (further - foreign institutions) and nonresident ambassadors, functions according to the order by limits of means (expenses) provided by funding plans, with the right of the first signature of the documents forming the basis for issue of money, material values, and also credit and settlement obligations are appointed, are assigned by the order of the Minister of Foreign Affairs of the Republic of Kazakhstan to Charges d'Affaires ad interim in cases, chargês d'affaires and consuls general of the relevant foreign institutions.

13. Nonresident ambassadors are provided with traveling expenses according to the legislation of the Republic of Kazakhstan.

14. During official journeys to the countries of accreditation to nonresident ambassadors the expenses connected with hiring of motor transport and use of communication, except as specified sending to the countries where there are foreign institutions are paid, or the specified expenses are performed at the expense of the host party.

15. During official journeys to the countries of accreditation nonresident ambassadors are provided with money on entertainment costs, except as specified sending to the countries where there are foreign institutions.
