About some questions of special economic zones

According to the subitem 2) of article 10 of the Law of the Republic of Kazakhstan "About special economic and industrial zones" the Government of the Republic of Kazakhstan DECIDES:

1. Create the special economic zone "Astana Technopolis" for the period till 2042.

2. Approve enclosed:

Regulations on the special economic zone "Astana Technopolis", its target indicators of functioning and critical level of not achievement of target indicators;

Regulations on the special economic zone "Astana — the New City", its target indicators of functioning and critical level of not achievement of target indicators.

3. This resolution becomes effective from the date of its signing.

Regulations on the special economic zone "Astana Technopolis"

1. General provisions

1. The special economic zone "Astana — the Technopolis" (further – SEZ) is located in the territory of the city of Astana in borders according to the enclosed plan.

The territory of SEZ constitutes 688,6 of hectare and is integral part of the territory of the Republic of Kazakhstan.

2. SEZ is created for the purpose of:

1) innovative development of the city of Astana by investment attraction and use of the available and attracted advanced technologies, know-how, creation of modern infrastructure;

2) creations of highly effective, including high and competitive technology productions in the field of processing industry;

3) the accelerated development of new technologies, further enhancement of organizational, economic and social conditions of carrying out researches, development of new technologies, rendering assistance in their commercialization;

4) the accelerated development of the city of Astana by investment attraction to the social sphere, the field of health care.

3. Activities of SEZ are regulated by the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "About special economic and industrial zones", this Provision and other regulatory legal acts of the Republic of Kazakhstan.

4. The list of priority types of activity of SEZ answering the purpose of its creation and also procedure for inclusion of priority types of activity in the specified list are determined by the authorized state body performing state regulation in the field of creation, functioning and abolition of special economic and industrial zones in coordination with authorized body by state planning and the authorized body performing management in the field of ensuring receipts of taxes and other obligatory payments in the budget.

5. Projects implementation on types of activity will be enabled mainly with use of projects on scientific developments of the Astana Business Campus park of the autonomous organization of education of "Nazarbaev Universitet".

6. Control of SEZ is exercised according to the Law of the Republic of Kazakhstan "About special economic and industrial zones".

3. The taxation in the territory of SEZ

7. The taxation in the territory of SEZ is regulated by the tax legislation of the Republic of Kazakhstan.

4. Customs regulation

8. Customs regulation in the territory of SEZ is performed according to provisions of the customs legislation of the Eurasian Economic Union and the Republic of Kazakhstan.

9. In the territory of special economic zone or its part customs procedure of free customs zone is effective.

10. The territory of SEZ in which customs procedure of free customs zone is applied is the customs control zone. The territory of SEZ shall be equipped for the purpose of carrying out customs control. Requirements to arrangement of the territory of SEZ, including requirements for barrier and equipment of perimeter of such territory system of video surveillance, are established by authorized body in the field of customs affairs.

11. In the territory of SEZ places of temporary storage of goods according to the procedure, determined by the customs legislation of the Eurasian Economic Union and the Republic of Kazakhstan can be created.

12. In the territory of SEZ the goods placed under customs procedure of free customs zone, and also the goods of the Eurasian Economic Union which are not placed under customs procedure of free customs zone, and the foreign goods placed under other customs procedures can take place and be used.

13. The goods imported on the territory of SEZ and placed under customs procedure of free customs zone are considered as being out of customs area of the Eurasian Economic Union for the purposes of application of customs duties, taxes, and also measures of non-tariff regulation.

14. The customs transactions connected with temporary storage, customs declaring, customs clearance and release of goods, and also carrying out customs control in the territory of SEZ are performed according to the procedure, determined by the customs legislation of the Eurasian Economic Union and the Republic of Kazakhstan.

5. Environmental protection

15. Implementation of activities in SEZ is based on rational and effective use of natural resources by means of creation of conditions for transition to sustainable development and environmental protection on the basis of balance of economic, social and ecological aspects of improvement of quality of life.

6. Procedure and terms of abolition of SEZ

16. SEZ is abolished after the term for which it was created. SEZ is abolished by the Government of the Republic of Kazakhstan.

7. Final provisions

17. Early abolition of SEZ is performed according to the Law of the Republic of Kazakhstan "About special economic and industrial zones".

18. The activities of SEZ which are not settled by this Provision are performed according to the current legislation of the Republic of Kazakhstan and the Eurasian Economic Union.
