About approval of Rules of certification and issue of the certificate of the supplier of aeronautical servicing, and also the certified requirements imposed to suppliers of aeronautical servicing

According to subitem 41-27) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" PRIKAZYVAYU:

1. Approve:

1) Rules of certification and issue of the certificate of the supplier of aeronautical servicing according to appendix 1 to this order;

2) the Certified requirements imposed to suppliers of aeronautical servicing according to appendix 2 to this order.

2. Declare invalid the order of the acting minister on investments and development of the Republic of Kazakhstan of February 6, 2015 No. 117 "About approval of Rules of certification and issue of the certificate of body of servicing of air traffic and (or) service of operation of the radio engineering equipment and communication of the aeronautical organization, and also the Certified requirements imposed to bodies of servicing of air traffic and (or) services of operation of the radio engineering equipment and communication of the aeronautical organization" (No. registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan 10452, published on April 13, 2015 in information system of law of Ad_let).

3. To provide to committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of certification and issue of the certificate of the supplier of aeronautical servicing

Chapter 1. General provisions

1. These rules of certification and issue of the certificate of the supplier of aeronautical servicing (further - Rules) are developed according to subitem 41-27) of Item 1 of Article 14, articles 35-1 and 35-2 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services".

2. These rules determine procedure:

1) carrying out certification and issue of the certificate of the supplier of aeronautical servicing;

2) suspension (response) of the certificate of the supplier of aeronautical servicing, modification and (or) amendments in it;

3) safety of flights in case of change in functional systems of air traffic management.

3. In Rules the following terms and determinations are used:

1) authorized body in the sphere of civil aviation - the central executive body performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

2) authorized organization in the sphere of civil aviation (further - authorized organization) - the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

3) the emergency notification (service of the emergency notification) - the services provided for the notification of the relevant organizations on the aircrafts needing the help of search and rescue services, and rendering necessary assistance to such organizations;

4) service of management of aeronautical information - the service created in specifically established action area which bears responsibility for provision of the aeronautical information (data) necessary for safety, regularity and efficiency of air navigation;

5) aeronautical servicing - activities which include air traffic management, provision of communication systems, navigation and observation, meteorological and search and rescue ensuring flights, provision of aeronautical information.

These types of servicing are provided to users of airspace at all stages of flight (approach, around airfield and on route);

6) the supplier of aeronautical servicing - the legal entity, providing air traffic management and (or) other aeronautical servicing;

7) the certificate of the supplier of aeronautical servicing (further - the certificate) - the document certifying compliance of the supplier of aeronautical servicing to certified requirements;

8) airfield meteorological body - the service located in airfield, intended for meteorological ensuring flights of aircrafts;

9) dispatching servicing of air traffic - the services provided for the purpose of:

prevention of collisions between aircrafts and aircrafts with obstacles in the maneuvering area;

accelerations and regulations of air traffic;

10) servicing of air traffic - flight and information servicing, the emergency notification, dispatching servicing of air traffic (district dispatching servicing, dispatching servicing of approach or airfield dispatching servicing);

11) body of servicing of air traffic - body of dispatching servicing of air traffic, the center of flight information or collection point for the reports concerning servicing of air traffic by the supplier of aeronautical servicing;
