About the special mode of innovative activities of technology parks

This Law determines legal and economic basis of introduction and functioning of the special mode of innovative activities of the technology parks "Semiconductor Technologies and Materials, Optoelectronics and Touch Equipment" Kiev), "Institute of electric welding of name E. O. Patton" (Kiev), "Institute of monocrystals" (Kharkiv), Uglemash (Donetsk), "Institute of technical thermophysics" (Kiev), "The Kiev polyequipment" (Kiev), "Intellectual information technologies" (Kiev), Ukrinfotekh (Kiev), Agrotekhnopark (Kiev), What Ukraine (Donetsk), "Scientific and educational devices" (Sumy), "Textiles" (Kherson), "Resources of Donbass" (Donetsk), "The Ukrainian microbiological center of synthesis and the latest technologies" (UMBITsENT) (Odessa), "Yavoriv" (The Lviv region), "Machine-building technologies" (Dnipropetrovsk) (further - technology parks).

Section I. GENERAL PROVISIONS

Article 1. The terms used in this Law

For the purposes of this Law terms are used in the following value:

1) the technology park (technopark) - the legal entity or group of the legal entities (further - members of the technology park) acting according to cooperation agreement without creation of the legal entity and without consolidation of deposits for the purpose of creation of organizational bases of project implementation of technology parks on production implementation of the knowledge-intensive developments, high technologies and ensuring industrial release of products, competitive in the world market;

2) cooperation agreement without creation of the legal entity and without consolidation of deposits of members of the technology park (further - the agreement) - the agreement between legal entities - members of the technology park, containing the information about the list of members of the technology park, their rights and obligations, priority activities of the technology park, governing bodies and governing body of the technology park, their powers and procedure for adoption of decisions by them, procedure for financing of activities of governing bodies and governing body, procedure for acceptance of new members of the technology park and exception of number of members of the technology park, procedure for liquidation of the technology park (cancellation of the agreement);

3) members of the technology park - legal entities - the subjects of scientific, scientific and technical, business activity who signed among themselves the agreement according to this Law;

4) governing body of the technology park - legal litsoodin from members of the technology park which on behalf of members of technopark opens the special account of the technology park and to whom under the agreement functions of the current management of activities of the technology park, including on execution of projects of the technology park, use in the procedure for means of the special account of the technology park established by this Law, to control of use of means of special accounts of members of the technology park, check and preparation of offers on modification or the termination of project implementation of the technology park, preparation of activities reports of the technology park, representation of interests of members of the technology park in public authorities and local government bodies, to the conclusion according to the legislation of agreements on behalf of the technology park are assigned, and other functions according to the agreement;

5) joint business - the company created for project implementation of the technology park one of founders of which is the technology park or the member of the technology park, and others - residents or nonresidents whose total fee in authorized capital constitutes the amount in national currency, equivalent at least 50 000 US dollars;

6) the project of the technology park - the set of documents prepared by the technology park including the description of the interconnected actions of the technology park determining his participants and joint businesses (contractors of the project), collaborators and producers of products by carrying out scientific research, technical, process, design design, release of pilot batches and industrial production of innovative products, and also on financial, personnel, marketing and commercial provision of production implementation of the new goods and provision of services which passed the examination in the procedure established by the Cabinet of Ministers of Ukraine and entered in the state register which conducts the central executive body realizing state policy in the field of scientific and technical and innovative activities. The nomenclature and amounts of import to Ukraine of materials, the equipment, equipment, necessary for project implementation of the technology park, component parts and other goods, and also amounts of experimental, pilot and industrial production of innovative products are determined by the central executive body, realizing state policy in the field of scientific and technical and innovative activities individually for each project;

7) the special mode of innovative activities - the legal regime providing the state support on stimulation of activities of technology parks, their participants and joint businesses for project implementation on priority activities of technology parks;

8) priority activities technology parkaekonomichesk and socially caused directions of scientific and technical and innovative activities of the technology park which correspond certain legislation to scientific and technical and innovative priorities and are directed to industrial production of competitive high-tech and innovative products and saturation of the domestic market by it and ensuring the export potential of the state.

Article 2. Coverage of this Law

Operation of this Law extends to technology parks, their participants and the joint businesses which are carrying out projects of technology parks on priority activities of technology parks.

Section II. SPECIAL MODE of INNOVATIVE ACTIVITIES

Article 3. Special mode of innovative activities of technology parks

The special regime of innovative activities is introduced for the technology park for a period of 15 years and is effective in case of project implementation of the technology park.

The state assistance of innovative activities of technology parks is performed by the state financial support and target subsidizing of projects of technology parks.

Article 4. State registration of the technology park

State registration of the technology park is performed by the central executive body, realizing state policy in the field of scientific and technical and innovative activities. To technopark the certificate on state registration of the established sample is granted. The basis for state registration of the technology park is its inclusion in the list of technoparks provided in preamble of this Law.

Article 5. Projects of technology parks

Projects of technology parks which realization is enabled according to requirements of this Law are developed according to priority activities of technology parks.
