About approval of the Regulations on determination, the description, representation and labeling of the flavored grape and wine-making products

Based on provisions of article 13 of the Law on grapes and wine No. 57-XVI of March 10, 2006 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 64-68, 193), with subsequent changes and amendments, DECIDES: the Government

1. Approve Regulations on determination, the description, representation and labeling of the flavored grape and wine-making products it (is applied).

2. The regulations on determination, the description, representation and labeling of the flavored grape and wine-making products become effective after three months from the date of its publication in the Official monitor of the Republic of Moldova.

3. To impose control over the implementation of this resolution on the Ministry of Agriculture, regional development and the environment.

Regulations on determination, the description, representation and labeling of the flavored grape and wine-making products

The regulations on determination, the description, representation and labeling of the flavored grape and wine-making products (further - the Provision) shift Item 5 of part IV of appendix II and Items 1 and 3 - 9 parts II of appendix VII to the Provision (EU) No. 1308/2013 of the European Parliament and Council of December 17, 2013 about organization of general regulation of the agricultural markets and cancellation of the Provision (EEC) No. 922/72, (EEC) No. 234/79, (EU) No. 1037/2001 and (EU) No. 1234/2007 of the Council published in the Official magazine of the European Union by L 347 of December 20, 2013 and shift partially the Provision (EU) No. 251/2014 of the European Parliament and Council of February 26, 2014 about determination, the description, representation, labeling and protection of geographical instructions to the flavored grape and wine-making products and cancellation of the Provision (EEC) of 1601/91 Council, published in the Official magazine of the European Union by L 84 of March 20, 2014.

Chapter I Scope

1. This Provision establishes regulations for determination, descriptions, representations and labeling of the flavored grape and wine-making products, special requirements to engineering procedures and methods of the analysis for receipt of the flavored grape and wine-making products, stages of the organization, production and sale of the flavored grape and wine-making products with the protected name of the place of origin and with the protected geographical specifying, and also requirements to traceability and assessment procedures of compliance.

2. This Provision is applied to the flavored grape and wine-making products specified in Item 4, of tariff line items made in the Republic of Moldova or imported, falling under action 2205 and 220600 (220600399, 220600599, 220600899) the Combined commodity nomenclature approved by the Law No. 172 of July 25, 2014.

Chapter II Terminology

3. In the context of this provision the concepts specified in article 2 of the Law on grapes and wine No. 57-XVI of March 10, 2016 of article 2 of the Law No. 66-XVI of March 27, 2008 on protection of geographical instructions, names of places of origin and the guaranteed traditional products, in Item 3 of appendix No. 1 to the Order of the Government No. 356 of June 11, 2015 (further - the Technical regulation "Organization of the Grape and Wine-making Market"), and also the following concepts are used:

fragrances - products:

1) not intended for consumption in this form, but which are added to foodstuff to give them or to change their smell and/or taste;

2) consisting or formed of the following categories: aromatic substances, natural aromatic substances, aromatic medicines;

aromatic substance - certain chemical with aromatic properties;

natural aromatic substance - the aromatic substance received as a result of the corresponding physical, fermentative or microbiological processes of raw materials of vegetable or microbiological origin both in the raw condition, and after their processing for consumption by the person, as a result of one or several traditional processes of preparation (the cabin, cutting, drying, fermentation, extraction, crushing, mixing, soaking, etc.). Natural fragrances correspond to the substances which are found in the natural form in the nature;

aromatic medicine - the product which is not fragrance, received from:

the foodstuff received as a result of physical, fermentative or microbiological processes, both of the crude raw raw materials and after its processing for consumption by the person, as a result of one or several traditional processes of preparation (the cabin, cutting, drying, fermentation, extraction, crushing, mixing, soaking, etc.), and/or the raw materials of the vegetable or microbiological origin which is not foodstuff, received as a result of physical, fermentative or microbiological processes, taken in the natural form or processed as a result of one or several traditional processes of preparation (the cabin, cutting, drying, fermentation, extraction, crushing, mixing, soaking, etc.).

the commercial name of product - the specific name of any flavored grape and wine-making product provided by this Provision;

the description - the terms used on the label and on packaging in accompanying documents when transporting of the flavored grape and wine-making product, in trade documents, in particular in tax delivery notes and commodity transport delivery notes, and also in promotional materials;

representation - the terms used on the label and on packaging including in promotional materials and within promotion actions, on images, and also on reservoirs, including on bottle and on cover;

labeling - any words, trademarks, trademarks, designations drawn or the written elements, brands, the relief or printed elements or attached to reservoir with the flavored grape and wine-making products and placed on any packaging, in the accompanying document, the note, on the label, on the film or the throat label, accompanying or concerning product.

Chapter III Determination and classification of the flavored grape and wine-making products

4. The flavored grape and wine-making products represent products received from products of the grape and wine-making sector specified in the Technical regulation "Organization of the Grape and Wine-making Market" which were flavored and are classified by the following categories:

1) the flavored wines;
