1. Approve the enclosed Regulations of the Ministry of Industry and Trade of the Russian Federation.

Regulations of the Ministry of Industry and Trade of the Russian Federation

I. General provisions

1.1. The regulations of the Ministry of Industry and Trade of the Russian Federation (further - Regulations) establish general rules of the organization of activities of the Ministry of Industry and Trade of the Russian Federation (further - the Ministry) on realization of the powers in the established field of activity, including rules of the internal organization of activities of the Ministry and the rule of interaction with being under authority of the Ministry by Federal Agency for Technical Regulation and Metrology (further - federal agency), and also the subordinated organizations.

1.2. Regulations No. 4-FKZ "About the Government of the Russian Federation" is developed according to the Federal constitutional Law of November 6, 2020 (The Russian Federation Code, 2020, No. 45, the Art. 7061), the Federal Laws, acts of the President of the Russian Federation, the Regulations on the Ministry of Industry and Trade of the Russian Federation approved by the order of the Government of the Russian Federation of June 5, 2008 No. 438 "About the Ministry of Industry and Trade of the Russian Federation" (The Russian Federation Code, 2008, No. 24, Art. 2868; 2021, No. 30, the Art. 5787) (further - Regulations on the Ministry), the Regulations of the Government of the Russian Federation approved by the order of the Government of the Russian Federation of June 1, 2004 No. 260 (The Russian Federation Code, 2004, No. 23, Art. 2313; 2021, No. 37, the Art. 6530) (further - Regulations of the Government of the Russian Federation), the Regulations on bill activities of the Government of the Russian Federation approved by the order of the Government of the Russian Federation of April 30, 2009 No. 389 "About measures for enhancement of bill activities of the Government of the Russian Federation" (The Russian Federation Code, 2009, No. 19, Art. 2346; 2020, No. 36, the Art. 5618) (further - Regulations on bill activities of the Government of the Russian Federation), other acts of the Government of the Russian Federation.

The regulations of federal agency are developed by federal agency and affirm his head in coordination with the Ministry.

Structure and staff list of the Ministry

1.3. The structure and the staff list of central office of the Ministry and the foreign office of the Ministry affirm the Minister of Industry and Trade of the Russian Federation (further - the Minister) within the salary fund and number (without personnel on protection and servicing of buildings) established by the Government of the Russian Federation taking into account the Register of positions of Federal public civil service approved by the Presidential decree of the Russian Federation of December 31, 2005 No. 1574 (The Russian Federation Code, 2006, No. 1, Art. 118; 2021, No. 44, the Art. 7398) (further - the Register of positions of Federal public civil service), and the acts determining the normative number of the relevant divisions.

1.4. The structure of the Ministry includes management of the Ministry (The minister and deputy ministers, including the First Deputy Minister, the secretary of state - the deputy minister (further - deputy ministers), assistants (advisers) to the Minister, structural divisions on the main activities - departments.

In departments departments are formed. The staff list of structural divisions joins the positions of Federal public civil service provided by the Register of positions of Federal public civil service.

1.5. Fields of activity and competences of structural divisions are determined in regulations on the structural divisions approved by the order of the Ministry. Powers of heads in the Ministry

1.7. The minister will organize work of the Ministry and bears the personal responsibility for accomplishment of the functions assigned to the Ministry, and also for realization of state policy in the established field of activity, the organization and implementation of internal financial control and internal financial audit in the Ministry, represents the Ministry in the relations with other public authorities, citizens and the organizations, signs agreements and other documents of civil nature on behalf of the Ministry, and also performs other powers established by the legislation of the Russian Federation.

Deputy ministers represent the Ministry of single questions of spheres of its activities, perform separate functions of the Minister of implementation of powers of the representative of the employer on behalf of the Russian Federation, will organize and coordinate implementation of functions of the Ministry, including coordination and control of activities of structural divisions, the foreign office of the Ministry, the subordinated organizations according to the Regulations, distribution of obligations between deputy ministers (further - distribution of obligations) and other acts of the Ministry, office contracts, and also orders of the Minister.

1.9. According to distribution of obligations deputy ministers in case of provision of appropriate authority by it can sign orders of the Ministry of single questions of the organization of activities of the Ministry, and also based on the powers of attorney issued by the Minister to sign agreements and other documents of civil nature on behalf of the Ministry.

1.10. In the order on distribution of obligations are specified:

a) special powers of the Minister;

b) powers of each deputy minister;

c) structural divisions, the foreign office of the Ministry, and also the organizations subordinated to the Ministry which coordination and control of activities are exercised by the corresponding deputy minister;

d) the scheme of temporary fulfillment of duties of the Minister by deputy ministers for the period of its absence in connection with disease, leave, business trip or on other bases, stipulated by the legislation the Russian Federation;

e) the scheme of temporary fulfillment of duties of deputy ministers for the period of their absence in connection with disease, leave, business trip or on other bases, stipulated by the legislation the Russian Federation;

e) the federal agency which is under authority of the Ministry with which the corresponding deputy minister performs interaction.

1.11. According to the decision of the Minister and according to distribution of obligations the deputy minister:

a) interacts (including corresponds) with public authorities and local government bodies, citizens and the organizations, and also the First Deputy Prime Minister of the Russian Federation, the Deputy Prime Minister of Russia - the plenipotentiary of the President of the Russian Federation in the Far Eastern Federal District, Deputy Prime Ministers of Russia and the Deputy Prime Minister of Russia - the Chief of staff of the Government of the Russian Federation (further - Deputy Prime Ministers of Russia), the Russian Government Office, Administration of the President of the Russian Federation, Federal Assembly of the Russian Federation (further - Federal Assembly), Audit Chamber of the Russian Federation;

b) coordinates and controls work of structural divisions of the Ministry, gives instructions to their heads (further - heads of structural divisions);

c) interacts (including gives instructions) with federal agency and the subordinated organizations;

d) holds meetings with representatives of public authorities, local government bodies and organizations;

e) considers the addresses which arrived in the Ministry, documents and materials;

e) considers and vises the draft documents represented for the signature to the Minister;

g) approves drafts of acts and other documents, and in the cases established by the legislation of the Russian Federation signs the conclusions on them;

h) performs other powers, stipulated by the legislation the Russian Federation, Regulations and orders of the Ministry.

1.12. Information on appointment of deputy managers of federal agency and heads of structural divisions in 10-day time goes to the Russian Government Office the head of the administrative department.

1.13. The head of the structural unit represents the Ministry according to the powers determined in the Regulations, regulations on structural division, official regulations and also based on personal written errands of the Minister and deputy ministers.

1.14. According to the Regulations, regulations on structural division, official regulations, orders of the Minister and deputy ministers (according to distribution of obligations) the head of the structural unit:

a) performs direct management of structural division, bears the personal responsibility for accomplishment of the functions and powers assigned to structural division, and also for condition of performing discipline;

b) interacts with other structural divisions of the Ministry;

c) interacts (including corresponds) with the trade missions of the Russian Federation in foreign states, with structural divisions of federal executive bodies and federal agency, the organizations, structural divisions of the Russian Government Office and Administration of the President of the Russian Federation subordinated to the Ministry, and also for single questions with deputy federal ministers, heads of the Federal Services and federal agencies and their deputies according to the powers established by the Minister;

d) provides preparation in accordance with the established procedure of drafts of acts and other documents of the Ministry;

e) provides consideration of the addresses which arrived in the Ministry, drafts of acts and other documents, and also preparation of the conclusions on them;

e) provides within the competence consideration of individual and collective addresses of citizens and the organizations and information requests about activities of the Ministry and signs answers to them, and also conducts reception of citizens according to the schedule approved by the deputy minister (according to distribution of obligations);

g) distributes obligations between the deputies, and also determines job responsibilities of employees of structural division;

h) provides holding the actions connected with passing of Federal public civil service by employees of structural division;

i) attracts in need of established procedure to study of the questions carried to fields of activity of the Ministry, scientific and other organizations, scientists and specialists;

j) based on the issued Minister (person fulfilling its duties) of powers of attorney signs agreements and other documents of civil nature on behalf of the Ministry;

k) holds meetings with representatives of public authorities, local government bodies and organizations for the questions carried to its competence;

l) performs other powers established by the Regulations, regulations on structural division and orders (instructions) of the Minister and his deputies (according to distribution of obligations).

The head of the administrative department performs the organization of personnel work in central office of the Ministry according to article 44 of the Federal Law of July 27, 2004 No. 79-FZ "About the public civil service of the Russian Federation" (The Russian Federation Code, 2004, No. 31, Art. 3215; 2020, No. 31, the station 5027), will organize preparation of documents concerning the persons appointed to position and dismissed by the Minister and the deputy minister to whom powers of the representative of the employer are assigned. The head of Department of regulation of foreign trade and development of system of the trade missions performs the organization of personnel work in the foreign office of the Ministry according to article 44 of the Federal Law of July 27, 2004 No. 79-FZ "About the public civil service of the Russian Federation", will organize preparation of documents concerning the persons appointed to position and dismissed by the Minister and the deputy minister to whom powers of the representative of the employer are assigned.

1.15. For temporary absence of the Minister in connection with disease, leave, business trip or on other bases, stipulated by the legislation the Russian Federation, the Minister appoints temporarily fulfilling its duties of one of deputy ministers.

In case of temporary absence of the deputy minister execution of its powers is assigned to one of deputy ministers according to the scheme of temporary fulfillment of duties of deputy ministers provided by distribution of obligations between the Minister and his deputies.

Administrative regulations and standards of the state services

1.16. The ministry according to the procedure and the terms established by the Government of the Russian Federation will organize development of administrative regulations of implementation of the state control (supervision) and provision of the state services which determine the ministerial procedures providing implementation of functions of the Ministry, effective work of its structural divisions and officials, and also realization of the rights of citizens.

1.17. The ministry develops and claims according to the Standard regulations of interaction of federal executive bodies approved by the order of the Government of the Russian Federation of January 19, 2005 No. 30 (The Russian Federation Code, 2005, No. 4, Art. 305; 2021, No. 44, the Art. 7409) (further - Standard regulations of interaction), lists of the provided state services, and also provides their publication.

1.18. The federal agency develops and approves lists of the state services provided to them according to Standard regulations of interaction, and also provides their publication.
